WITH WAIVER
JULIETA J. ARCANGEL, of legal age, widow, Filipino, with address at No. 39 Brgy.
Harapin Ang Bukas, Mandaluyong City; GERARDO J. ARCANGEL, Filipino, of legal
age, married to Analyn O. Arcangel, Filipino, with same as above, BENJAMIN J.
ARCANGEL, Filipino, of legal age, married to Abigael R. Arcangel, with address same
as above, And BELINDA A. MAGNO, Filipino, of legal age, married to Jeffrey M.
Magno with address same as above.
WITNESSETH THAT:
WHEREAS, the HEIRS/ together with Luis I. Arcangel (forced heir of Bernardo M.
Arcangel), executed an Extra Judicial Settlement dated 26 June 2019, wherein they
allocated unto themselves one-half undivided portion of the PROPERTY;
WHEREAS, for the administration and better enjoyment of the PROPERTY, the
HEIRS/CO-OWNERS hereby agree to formalize its partition, use, and maintenance
through this DEED OF PARTITION WITH WAIVER;
NOW, THEREFORE, for and in consideration of the foregoing premises, the HEIRS/
CO-OWNERS agree on the following:
2. The distribution of the lots indicated on the Site Development Plan shall be as
follows:
3. All taxes, and fees assessed on the PROPERTY by any national or local
government office, agency or entity shall be paid by the HEIRS/CO-OWNERS in
equal share;
4. The expenses for the demolition of the existing building shall be shared equally
by the HEIRS/CO-OWNERS;

5. Notwithstanding the partition or allocation of the PROPERTY as herein provided,
the HEIRS/CO-OWNERS agree NOT TO SELL, LEASE or ENCUMBER the
PROPERTY to any person who is not a party to this agreement;
