Witness: Respondent
Facts culled from the Respondent:
Plaintiff and Respondent married on March 18, 1996;
They have been living separately for three (3) years, because of Plaintiff’s nagging behavior
which is counterproductive for the entire family;
Respondent is now living alone in his condominium unit;
Since their marriage, respondent has been a responsible provider for his family;
Their first years together were very peaceful;
Respondent loves his family so much;
They only started fighting in 2011 when Elenita suspected that Respondent has a child out of
wed lock named Elaine;
This was brought about by “chismis” from Elenita’s friends and mah-jong co-players, Emily
Mayor and Conching Estrada;
The couple has one child named Francine S. Magdaleno, 15 years old;
She has been studying in Xavier High School, a prestigious private school in Makati City, since
grade school. All her financial and economic needs are being provided by Respondent until now;
Francine is staying with her mother during weekdays; however, she goes to his father on
weekends;
Respondent was diagnosed by a psychiatrist, Dr. Angelina Urias of the Philippine General
Hospital, to be a habitual drinker in May 2015. This was a troubled time for the family but they
were able to overcome this problem;
There may be times when Respondent and Plaintiff would quarrel, but they always fix their
issues;
Respondent underwent psychological intervention and rehabilitation for two (2) and was cleared
in June 2017;
Francine told the Respondent that her mother has been acting crazy lately, fearful that
Respondent will fly to the United States with their daughter;
Plaintiff was dating a colleague from work, Mr. Baldomero Yabut, for three (3) months now;
Since 2017, Respondent dated one woman, Ms. Nanette Natividad, who was a childhood
sweetheart. They dated once only and thereafter, Respondent did not see her again;
Respondent contends that it was impossible for him to have a prior marriage, because he
obtained a Certificate of No Marriage with the National Statistics Authority before he and
Elenita wed in 1996;
Plaintiff and Respondent have several real properties, a lot located in Imus, Cavite, their
residential house in Poblacion, Makati, a house in San Andres Bukid, Manila worth
PhP940,000.00, and the condominium unit where he resides. They also own one Innova car,
which Elenita herself uses;
Respondent also has a small house and lot which he inherited from his parents located in Paco
Manila;
Right now, Respondent is working as a Finance Executive in ABO Banking Corp. in Makati
City.
