REPLAY TO THE DEFENDANT MOTION TO DISMISS THE CITY OF MODESTO

RULE 12(b)(6)

Claimant's (Plaintiff's) El Cam Bey, Executor for the CAMERON ROBINSON Trust, &
Noble Bernis Earl McGill El-Bey has no opposition to the Defendants Motion to dismiss the City
of Modesto; not for the absence of a claim which relief can be granted, but as the Defendant has
correctly stated, this is a County level issue and not an issue for the City of Modesto. The
Claimants do believe there is enough prima facie evidence, set before the court to continue this
claim and grant relief; but as the City of Modesto has stated they are not a proper party to grant
relief.

CONCLUSION

For these reasons set fourth the Claimant's (Plaintiff's), no longer wish to pursue the City
of Modesto, and respectfully move they be dismissed as a Defending party in this case. The
Claimants will continue to pursue Stanislaus county recorder (Donna Linder) & Modoc county
recorder (Kristen Depaul), for violating our human rights, & our tribal ways and traditions as
Aborigines on this land pursuant to our Aborigine Charter & Fee Schedule.
