TRADEMARK APPLICATION

Trademark - is a word, a group of words, sign, symbol, logo or a combination thereof that identifies and
differentiates the source of the goods or services of one entity from those of others. 

Procedure for Application:

1. File an application with the Intellectual Property Office of the Philippines (“IPO”) or through their
website at https://www.ipophil.gov.ph/etm-file-trademark/, and pay the filing fees.
2. IPO will conduct an examination of the application and requirements. If application and
requirements are complete, proceed to the next step.
3. Application will be published for opposition for 30 days, subject to payment of fees.
4. If there is no opposition, IPO will issue a Certificate of Registration. Certificate of Registration is valid
for 10 years, and may be renewed for a period of 10 years at a time, subject to the requirements for
maintenance of a trademark registration.
5. Registered Trademark will be published by the IPO, subject to payment of fees.

Requirements for Filing:

a. Two (2) accomplished application forms;


b. Drawing of the mark; and
c. Payment of Fees.

Duration of Processing:
According to IPO, average processing time is 2.6 months. However, the processing time may be extended if there is
an opposition to the registration of the mark.

Requirements for Maintenance of a Trademark:

a. Timely submission of a Declaration of Actual Use (“DAU”);

Period for submission of the DAU:


i. Within three (3) years from the filing of the trademark application or within 3 years from the
international registration date or subsequent designation date.
ii. Within one (1) year from the fifth (5th) anniversary of the registration of the mark or within
1 year from the 5th anniversary of the statement of grant of protection.
iii. Within one (1) year from the fifth (5th) anniversary of each renewal.
iv. As per Rule 204 of IPO MC No. 17-010, a DAU must be submitted for renewed registrations
within one (1) year from the date of renewal of the registration. This requirement only
applies for registered marks due for renewal on 01 January 2017 and onwards, regardless of
the filing date of the Request for Renewal.
