This report covers the period beginning on November 17, 2020, through February
16, 2021. During this period, PEESA was amended by Section 1242 of the
National Defense Authorization Act for Fiscal Year 2021, enacted on January 1,
2021. Accordingly, for any activities that would be covered by the amendments to
PEESA, the applicable period runs from January 1, 2021 through February 16,
2021.

Consultations
The amendments made to PEESA by the FY2021 NDAA require consultation with
the governments of Norway, Switzerland, the United Kingdom, and member
countries of the EU before imposing any sanctions, and a description in the report
of the nature of the consultations and any concerns raised by the specified
governments.
Consultations with allies and partners have been ongoing and robust. The
Department of State has consulted widely with foreign governments via
demarches, persistent engagement with Ambassadors and high-level government
representatives in European capitals, and meetings with EU Member States and
other relevant European countries in Washington, D.C. through February 2021.
State Department officials conducted extensive outreach from August 2020 to
February 2021 with high-level German government officials and members of the
German parliament.
The Department of State sent pre-notification of the January 19, 2021 imposition
of sanctions pursuant to Section 232 of the Countering America's Adversaries
Through Sanctions Act (CAATSA) on KVT-RUS and its vessel known as the
FORTUNA to the EU and 13 countries, including Norway, Switzerland, and the
United Kingdom.
Responses to the pre-notification of sanctions action and consultations ranged from
appreciation of and disagreement with action taken by the U.S. government to
disrupt construction of the Nord Stream 2 pipeline through U.S. diplomatic
engagement and the threat of sanctions action. Central and Eastern European
counterparts continue to strongly urge the United States to oppose the Nord Stream
2 project. During engagements and consultations, some countries cited concerns,
as in the past, over the imposition of what is perceived as “extra-territoriality” of
the sanctions actions and have made statements public. The German government
remains fully committed to the Nord Stream 2 project, insisting it is both a
necessary and commercial undertaking. Germany firmly rejects U.S. sanctions as
an attack on German and EU sovereignty.
Since the January 2021 inauguration, the Biden Administration has continued
consultations, including pre-notifying the governments of Norway, Switzerland,
the United Kingdom, and EU member states prior to the submission of this report.
