When a person is unable to fulfill his obligation due to a fortuitous event or force majeure, his obligation

to comply is extinguished; hence, he shall not responsible for loss or damage caused to another resulting
from the non-performance of his obligation due to a fortuitous event except in the following conditions:
1. When the law expressly so provides;
2. When stipulated by the parties that the happening of an event fortuitous in nature shall not
exempt the debtor from his liability; and
3. When the nature of the obligation requires the assumption of risk.
