I was delighted to meet you on April 28, 2009, to discuss in general t~rms the conti!"!t of
my second Annual Report and the shared responsibilities of various key players under
the Public Servants Disclosure Protection Act. .
Since our meeting, I have appeared before the Standing Co'mmittee on Gover'lment.
Operations and Estimates on May 12 as well as the Standing Committee on National
Finance on May 26, 2009. I am pleased to report that I have received very strong
support for our approach in dealing with cases and our overall direction on prevention
and education.
In that respect, your role and leadership continue to be instrumental. I would appreciate
meeting with you, perhaps in the fall, to discuss specifi.c initiatives we plan to undertake,
in cooperation with the Office of the Chief Human Resources Officer.
On another note, I would like to seek your agreement to change the applied title that is
used to designate my Office. Before my appointment, for the Federal Identity Program
requirements, the organization has been registered as follows: Public Sector Integrity
C3nada (PSIC) IlntE~grite du secteur public Canada (ISPC). Early on my mandate, it
has become clear that this title is not appropriate. This title does not provide sufficient
clarity about my role as an independent Agent of Parliament and is not in keeping with
the titles of the offices of other Agents of Parliament. Such a lack of clarity may lead
some individuals to conclude that my Office is not independent.

I therefore request that the applied title of the Office be changed to the following: Office

About us
The Office of the Public Sector Integrity Commissiomir of Canada is an independent Agency of Parliament, created in
2007 by the Public Servants Disclosure Protection Act. Our Office was established to enhance public confidence in our
Mandate
Our Office offers a safe, confidential and independent mech~nism for public servants and members of the public to
. disclose potential wrongdoing in the federal public sector. Our Office investigates disclosures of alleged wrongdoing and
complaints of reprisal. It also protects public servants against reprisals for making such disclosures or cooperating in
good faith in i~vestigations.
Guiding principles
Our Office Is guided at all times by the public interest. It protects the right to fairness of all persons involved in a
Three key principles guide the work of our Office: Inform, Protect and Prevent, with the goal of building trust together.
Reports
The Commissioner presents an Annual Report to Parliament within 90 days of the end of each fiscal year. The Report
provides an overview of the work of our Office. The Commissioner must also present a case report to Parliament on any
founded wrongdoing within 60 days. .

I submitted a protected disclosure in good faith to the Office of the Public Sector Integrity
Commissioner (PSIC), which the PSJC received on September 16,2009. In my disclosure,l

The list of vulnerabilities was compiled, based on discussions I had with a number of
people during the first two years of my mandate" as well as our own experience in
facing the significant challenges of implementing new legislation, creating a new
institution and working to positively influence the culture of the public service. This is not
something that can be done overnight, as I am sure you appreciate.
Such a list is always somewhat subjectiv~, and we felt it was importanUovalidate it. To
do so, my Office worked in close collaboration with Alan Latourelle, Chief Executive
Officer of Parks Canada and Chair of the steering committee' for the Heads of Federal
Agencies, who has played a critical leadership role in identifying and addressing the
needs of SDAs. He has been instrumental in coordinating efforts among key
stakeholders and helping to ensure that SDAs have been afforded an effective, voice .

Further, and to maintain impartiality, we also partnered with Scott Serson, a retired
public sector Deputy Minister and former President of the Public Service Commission of
Canada, who agreed to take on the project of interviewing key stakeholders to learn
more about work currently underway. to identify possible solutions to targeted problems
and to uncover any additional issues.

In his "Findings and Conclusions" (see deck enclosed), Mr Serson confirmed the
following:
• Reactions to PSIC Chapter 1 were very positive and considered as having "raised
the bar" on SDA concerns and galvanized more action on them.
• From the point of view of those working in small departments and agencies there
appear to be two primary concerns at this point: 1
D While there has been. progress on some elements of previous reports over
the years, it seems slow given the challenges they face, and
D The current fiscal pressures on Govemment could lead to a scaling back of
work underway and indeed to new demands on SDAs as part of an effort to
eliminate the deficit. '.
Central Agencies have to playa key role in coordinating and championing initiatives to
address the risks in SDAs. To tlJis end, we recently met with the Secretary of the
Treasury Board, Michelle d'Auray, and the Chief Human Resources Officer, Daphne
Meredith, to debrief them on the results of the stakeholder interviews. The proposed
strategies highlighted in our Annual report may not be new nor revolutionary (some of
them have been discussed for quite a while, e.g. shared services). However, we believe
that it is important to focus resources, time and energy on the' efficient delivery of a
smaller number of commitments in order to demonstrate meaningful results ..
• Developing a plan to provide all SDAs with much needed and adequate shared
services;
• Providing a clear and systematic portfolio engagement approach;
• Broadening the orientation scope for new appointees; and
• Establishing a roster of experts and/or "pathfinding" service to identify sources of
ad~ce.· .
From our perspective, the meeting was very fruitful and we feel there is a joint
commitment to act on a number of initiatives. I intend to report on the progress achieved
in my next annualreport.
On a separate note, consultations were also held with Executives (APEX) and Union
participants on systemic problems that could give rise to wrongdoings. Mr. Tony Dean.

proposed that emphasized the critical importance of leadership in creating a culture that
values and supports ethical behaviour. Highlights from these ongoing consultations will
also be featured in my 3rd Annual Report and will likely be discussed at a Symposium
on integrity in p~blic institutions, that we are currently planning for the fall of 2010.

concerns 'Of wrongdoing can be difficult and daunting. As yeu will see in Chapter 1, we
have developed a decision-making guide for petential disclesers, which we hepe will
help inferm their cheice as te whether ~r not to make a disclosure.
The statistics we previde in Chapter 2 shew that the number of inquiries 'Our Office
received in 2009-10 increased significantly. We also launched nine new investigatiens
last year, which include both disclosure and reprisal cases. Chapter 3 'Outlines cur
efforts to build upcn our previeus work regarding the unique challenges facing small
federal agencies; we engaged APEX an'd the Natienal Jeint Ceuncil in identifying and
addressing systemic conditions that lead te an environment where wrcngdeing could

Mr. DJon joined the Sussex Circle as an Associate following an extensive and diverse
career in the federal Public Service, in 2009. He has wide experien~ in the justice
domain, senior management, policy development, human resources managem.ent,
finance, and information tedmology.
Bom in Montreal, Mario Dion com.pleted his law degree at the University of Ottawa in
1979 and was called to the Quebec Bar the following year.

He immediately started his career in the ~blic Service as Legal C&unsel in the
Department of the Solicitor General of Canada In 1984, J:1e was promoted to Senior
Counsel to the Correctional Service of Canada, a legal management position. In 1987,
Mario Dion was promoted to the National Parole Board.
From 1988 to 1992, Mr. Dion left the Deparhnent of Justice to become Assistant Deputy
!vlinister at Correctional Service of Canada. Initially he was responsible for Research,
Policy and Communications, and subsequently for Operations and Programs.
In 1995, Mr. Dion was appointed Associate Deputy Minister of Justice. In addition to his
corporate role, he assumed responsibility for Civil law issues and all operations in the
Quebec Region. He was an Associate at the Department of Justice for a period of eight

In 2003, Mr. Dion was appointed Deputy Minister at Indian Residential Schools
Resolution Canada Canada's largest class action settlement was negotiated during his
. tenure and will result in a lasting resolution of all claims.
Finally, between 2006 and 2009, he was Chair and Deputy Head of the National Parole
Board, the second largest tribunal at the federal level. He successfully oversaw the
Board's strategic review, in 2008.
Since he left the Public Service, Mr. Dion has been retained by several clients
(Correctional Servic;e of Canada, the Immigration and Refugee Board, the Truth and
Reconciliation Commission and l/Universit~ de Montreal) to conduct enquiries and
provide advice on legal and organizational issues. He has also been appointed as
Commissioner ad hoc to review complaints under the Access to Wonnation and Privacy
Acts. .
