\".J

Dear Minister:

I was delighted to meet you on April 28, 2009, to discuss in general t~rms the conti!"!t of
my second Annual Report and the shared responsibilities of various key players under
the Public Servants Disclosure Protection Act. .

Since our meeting, I have appeared before the Standing Co'mmittee on Gover'lment.
Operations and Estimates on May 12 as well as the Standing Committee on National
Finance on May 26, 2009. I am pleased to report that I have received very strong
support for our approach in dealing with cases and our overall direction on prevention
and education.

In that respect, your role and leadership continue to be instrumental. I would appreciate
meeting with you, perhaps in the fall, to discuss specifi.c initiatives we plan to undertake,
in cooperation with the Office of the Chief Human Resources Officer.

In addition, we do want to pursue actively some recommendations in our Annual Report

that pertain to small federal agencies, which remain vulnerable and have limited
capacities. I intend to have discussions with both the Clerk 'of the Privy Council and the
Secretary of Treasury Board with a view to collectively find practical solutions. Other key
stakeholders such as the Council of Heads of Agencies will be also conSUlted.

On another note, I would like to seek your agreement to change the applied title that is
used to designate my Office. Before my appointment, for the Federal Identity Program
requirements, the organization has been registered as follows: Public Sector Integrity
C3nada (PSIC) IlntE~grite du secteur public Canada (ISPC). Early on my mandate, it
has become clear that this title is not appropriate. This title does not provide sufficient
clarity about my role as an independent Agent of Parliament and is not in keeping with
the titles of the offices of other Agents of Parliament. Such a lack of clarity may lead
some individuals to conclude that my Office is not independent.

... 2
I . .',

I therefore request that the applied title of the Office be changed to the following: Office
a
of the Public Sector Integrity Commissioner I Commissariat I'integrite du
secteur public. This title is the one. used in our Act (under Section 39).The acronym
(PSIC in English and ISPC in French) would remain unchanged since the acronym is in
use for government data systems and to change it would not be feasible.

I wish you a fruitful end of parliamentary session and look forward to seeing you in the .
fall.

Yours sincerely,

Christiane Ouimet

Dear Ms. Ouimet:

C \ _
I write in response to your letter of May 1,2009, in which you
request legal assistance in relation to an investigation commenced in
December 2008 by the Auditor General pursuant to section 14 of the Public.
Servants Disclosure Protection Act (PSOPA). You wish to receive legal
assistance pursuant to the Treasury Board Policy on Legal Assistance and
Indemnification. A copy of the Policy is appended hereto.

The Policy provides that legal assistance requests by Crown

servants relating to internal investigations are ineligible. Under the Policy,
investigations under the PSDPA are considered internal to the operations of the
public service. Consequently, I regret to inform you that your request is
ineligible under paragraph 6.1.11 of the Policy and cannot be ;;tpproved.

As you know, the PSOPA provides that legal advice may be

accessed by a person who is or has been involved in an investigation under the
PSOPA. Consequently, you could choose to seek support for legal costs under
the PSOPA.

Should you have any questions resp.ecting this decision, please

do not hesitate to contact my counsel, Me Yvan Roy, at (613) 957~5792.

Sincerely yours,

\0~

Dear~rs,

In our 2008-09 AnlJua/ Report Building Trust Together. A Shared Responsibility, my

Office highlighted in Chapter 1 a number of risks and vulnerabilities in Small
Departments and Agencies (SDA) that could increase the risk of wrongdoing if left
unaddressed. Some risk-mitigation ,strategies were identified, and we felt it was our
respons, ibility to follow-up on them while respecting the distance required to be
maintained in our role as an Agent of Parliament. I had previously written to your·
predecessor in this regard, given the importance of these issues. '

The list of vulnerabilities was compiled, based on discussions I had with a number of
people during the first two years of my mandate" as well as our own experience in
facing the significant challenges of implementing new legislation, creating a new
institution and working to positively influence the culture of the public service. This is not
something that can be done overnight, as I am sure you appreciate.

Such a list is always somewhat subjectiv~, and we felt it was importanUovalidate it. To
do so, my Office worked in close collaboration with Alan Latourelle, Chief Executive
Officer of Parks Canada and Chair of the steering committee' for the Heads of Federal
Agencies, who has played a critical leadership role in identifying and addressing the
needs of SDAs. He has been instrumental in coordinating efforts among key
stakeholders and helping to ensure that SDAs have been afforded an effective, voice .

...12
-2

Further, and to maintain impartiality, we also partnered with Scott Serson, a retired
public sector Deputy Minister and former President of the Public Service Commission of
Canada, who agreed to take on the project of interviewing key stakeholders to learn
more about work currently underway. to identify possible solutions to targeted problems
and to uncover any additional issues.
. .
In his "Findings and Conclusions" (see deck enclosed), Mr Serson confirmed the
following:

• Reactions to PSIC Chapter 1 were very positive and considered as having "raised
the bar" on SDA concerns and galvanized more action on them.
• From the point of view of those working in small departments and agencies there
appear to be two primary concerns at this point: 1
D While there has been. progress on some elements of previous reports over
the years, it seems slow given the challenges they face, and
D The current fiscal pressures on Govemment could lead to a scaling back of
work underway and indeed to new demands on SDAs as part of an effort to
eliminate the deficit. '.

Central Agencies have to playa key role in coordinating and championing initiatives to
address the risks in SDAs. To tlJis end, we recently met with the Secretary of the
Treasury Board, Michelle d'Auray, and the Chief Human Resources Officer, Daphne
Meredith, to debrief them on the results of the stakeholder interviews. The proposed
strategies highlighted in our Annual report may not be new nor revolutionary (some of
them have been discussed for quite a while, e.g. shared services). However, we believe
that it is important to focus resources, time and energy on the' efficient delivery of a
smaller number of commitments in order to demonstrate meaningful results ..

Some of the initiatives to advance the SDA agenda include:

• Developing a plan to provide all SDAs with much needed and adequate shared
services;
• Providing a clear and systematic portfolio engagement approach;
• Broadening the orientation scope for new appointees; and
• Establishing a roster of experts and/or "pathfinding" service to identify sources of
ad~ce.· .

From our perspective, the meeting was very fruitful and we feel there is a joint
commitment to act on a number of initiatives. I intend to report on the progress achieved
in my next annualreport.

On a separate note, consultations were also held with Executives (APEX) and Union
participants on systemic problems that could give rise to wrongdoings. Mr. Tony Dean.
former Secretary of the Cabinet and Head of the Ontario Public Service. was
instrumental in the facilitation of the consultations. Valuable recommendations were

... /3
-3

proposed that emphasized the critical importance of leadership in creating a culture that
values and supports ethical behaviour. Highlights from these ongoing consultations will
also be featured in my 3rd Annual Report and will likely be discussed at a Symposium
on integrity in p~blic institutions, that we are currently planning for the fall of 2010.

If you wish to discuss any of these issues and initiatives further, I would be pleased to
meet with you.

Yours sincerely.

The Report highl!ghts key activities my Office has undertaken te deliver on 'Our

The statistics we previde in Chapter 2 shew that the number of inquiries 'Our Office
received in 2009-10 increased significantly. We also launched nine new investigatiens
last year, which include both disclosure and reprisal cases. Chapter 3 'Outlines cur
efforts to build upcn our previeus work regarding the unique challenges facing small

As you know, the Public Accounts Committee has now decided to formally subpoena my

predecessor. I~ was unclear during ,yesterday afternoon's meeting ~hen the Clerk may have

to appear and there was also some discussion about inviting Mr. Lynch. There is one issue

that your office is currently not privy to and th?t the Clerk must be briefed on. A former

senior official at the office has retained counsel in order to pursue a claim for

constructive dismissal. I will be pleased to provide details to a PCO officer to ensure

Wayne is not blind-sided.

I would appreciate a call at your convenience'.
