What is CTP insurance and who does
it cover?
Compulsory Third Party (CTP) Personal Injury Insurance,
commonly known as Green Slip insurance, is required
before you can register a motor vehicle in NSW. CTP
provides compensation for people injured in a motor
vehicle accident, but cover for injuries to the driver who
causes the accident are limited. CTP protects the owner
of a motor vehicle and any other person who at any time
drives the vehicle (whether or not with the consent of
the owner) against claims for liability in respect of the
death or injury to a person caused by the fault of the
owner or driver.

CTP covers the cost of all reasonable medical treatment


for a person (other than the driver who causes an
accident) injured in a motor vehicle accident. Depending
on the injured person’s individual circumstances, cover
may also include loss of wages, the cost of care services
and compensation for pain and suffering.

The CTP scheme also covers children up to the age of


16 years who are injured in a motor vehicle accident,
regardless of fault. Injured children have all their
necessary treatment, rehabilitation and care expenses
met in full.

CTP provides limited cover for injuries sustained by the


driver who causes the motor accident. Anyone injured in
a motor vehicle accident, including the driver, may be
entitled to claim up to $5,000 in cover using the
Accident Notification Form (ANF). This applies to medical
expenses and/or lost earnings incurred within six months
of the motor vehicle accident. The ANF must be lodged
within 28 days of the date of the accident. If the injuries
of the driver at fault are deemed to be catastrophic, the
driver may be covered under the Lifetime Care and
Support (LTCS) Scheme.

Period of cover
CTP operates for the period of registration of the vehicle
and must be paid before you can register or renew your
registration with the Roads and Traffic Authority of NSW
(RTA). GIO new business Green Slip notices do not show
the term of insurance, as cover DOES NOT commence
until registration has been completed with the RTA.

If CTP and registration are renewed after the due date,


you may be personally liable if you cause an injury to
another person. If you try to renew your registration after
the ‘use by date’ shown on the RTA portion of the Green
Slip, a new CTP Policy will be required to either
re-establish the registration or renew the registration for
12 months, depending on the current type of
registration.

If the vehicle has long term registration, the insurance


operates for one (1) year of the long term registration.

Lifetime Care and Support Scheme


The Lifetime Care and Support Scheme provides cover for
everyone catastrophically injured in a motor vehicle
accident, regardless of who caused it. Catastrophic
injuries include spinal cord injury, a moderate to severe
brain injury, multiple amputations, severe burns or
blindness. The Lifetime Care and Support Scheme helps
provide medical treatment, rehabilitation and services
including daily personal and nursing care, domestic help,
respite care, home and transport modifications and is
funded by the Medical Care and Injury Services (MCIS)
Levies which are included in the cost of a Green Slip.

What is the Motor Accidents Authority


and what is its role?
The Motor Accidents Authority of NSW (MAA) is a
government body appointed to oversee the NSW CTP
Scheme. The MAA is often referred to as the NSW CTP
Regulator.

The MAA ensures that the CTP scheme operates correctly


and fairly. The MAA is also required to find a balance

between affordable CTP premiums, appropriate insurance
cover and compensation for people injured in motor
vehicle accidents.

Other functions of the MAA include, overseeing pricing


and setting of Premium Relativities.

CTP premiums
Who sets CTP prices?
In NSW, CTP is provided by licensed insurance companies
who each set their own prices. The MAA does not set
CTP prices however they provide CTP insurers with
Premium Relativities (see below MAA Premium Relativities
and how they affect CTP premiums) based on the vehicle
classification and the zone in which the vehicle is
garaged. CTP insurers set prices based on the MAA’s
Premium Relativities, and then submit prices to the MAA
for approval.

MAA Premium Relativities and how they affect


CTP premiums
Every year the MAA completes analysis of CTP claims
costs for each vehicle classification and rating zone.
Based on that analysis, the MAA then determines
Premium Relativities for vehicle classification and zone
relative to a Metropolitan Class 1 Motor Car. Premium
Relativities are the same for all CTP insurance companies.
Insurers apply the MAA Premium Relativities to their
individual rating structures, in order to derive their CTP
premiums.

What determines the price of CTP?


A number of factors are used to determine the price of
CTP insurance. They include the location where the
vehicle is normally kept/garaged (zones are set by the
MAA) and the vehicle classification, which is determined
by its shape and usage.

Insurers may also apply other factors such as the age of


the vehicle, age of driver(s) or owner(s) and any motor
vehicle insurance history. If any of these factors change,

then the premium may change as a result.

Can CTP prices be discounted or changed?


Once CTP prices are approved by the MAA, insurers
cannot discount or change their premiums unless there is
a change to a customer’s rating factors.

Renewing the registration of your vehicle
Step 1 Pink Slip – Safety inspection
›› If your RTA registration renewal
certificate indicates that your vehicle
requires a safety inspection, you must
obtain a road worthiness certificate
(Pink Slip) from an authorised safety
inspection centre.
›› Confirmation of the safety inspection is
sent to the RTA electronically by the
safety inspection centre (eSafety check).
Step 2 Green Slip – CTP insurance
›› All vehicles registered in NSW must
obtain a Green Slip from a CTP insurer
before they can be registered at
the RTA.
›› Confirmation of CTP is sent to the RTA
electronically by GIO after it is
paid (eGreenslip).
Step 3 Registration – Registered with RTA
›› Once the vehicle has undergone a
safety inspection (if required) and a
Green Slip has been purchased,
registration can be completed at
the RTA.
›› You should check with the RTA to
confirm your eligibility to register your
vehicle electronically.

Driver Cover Plus
CTP pays compensation for people injured in a motor
vehicle accident, but cover for injuries to the driver who
causes the accident are limited. GIO CTP Green Slips
come with Driver Cover Plus for eligible drivers. Full
details are contained in the Driver Cover Plus Policy in
this booklet.

eGreenslips and eRegistration


GIO provides an eGreenslip service which enables you to
take out or renew your CTP, then complete your
registration electronically with the RTA by telephone or
over the internet.

For vehicles other than those requiring a new registration,


GIO sends an electronic confirmation of your payment and
CTP details to the RTA (eGreenslip transmission). Allow up
to 1 hour for your eGreenslip to be received by the RTA, if
you pay by telephone, online or at a GIO office. Allow up
to 2 business days if paying at a Post Office and up to 5
business days if paying by mail.

A copy of your paid Green Slip will also be sent to you by


mail, however if you are eligible to register your vehicle
electronically, you can do so without having to take your
CTP Green Slip and registration papers to an RTA Motor
Registry.

You should check with the RTA to confirm your eligibility to


register your vehicle electronically.

Comprehensive Motor Vehicle insurance discount
If you have a Maximum No Claim Discount of 60% or
more on your comprehensive motor vehicle insurance
policy and you have GIO CTP on the same vehicle, you
are eligible for a discount off the next annual premium
for your GIO comprehensive motor vehicle policy*on that
vehicle (subject to GIO’s usual underwriting acceptance
criteria). Use of the discount is valid for 12 months from
the date of payment of your GIO CTP insurance. The
offer applies to existing GIO comprehensive motor
vehicle policyholders as well as those who may wish to
insure their vehicle comprehensively with GIO on their
next renewal. Only one discount is permitted per 12
month term of the GIO comprehensive motor vehicle
policy. The discount is not refundable. The discount does
not apply to fleet vehicles or commercial motor vehicle
insurance policies issued by GIO.

*GIO Motor Vehicle Insurance is issued by GIO General


Ltd ABN 22 002 861 583. Please read the Motor Vehicle
Insurance Product Disclosure Statement (PDS) before
making any decision regarding this product. A copy of
the PDS is available at www.gio.com.au or any GIO
branch or agency.

What happens when you sell


your vehicle?
CTP is linked to the vehicle, not the owner, so if you sell
your vehicle, the CTP policy will be transferred to the
new owner. When the new owner notifies the RTA of the
purchase of the vehicle, the RTA automatically notifies
the CTP insurer of the change. Similarly, when you
purchase a vehicle, the CTP will already be placed with a
CTP insurer. Remember to contact GIO with the details of
your new vehicle and we can send you a GIO CTP Green
Slip when your registration falls due for renewal.

Cancellation of CTP
There are two main reasons for cancelling your CTP:

›› If your vehicle is de-registered (which may be due to


theft, total loss or moving interstate), you may be
entitled to a pro-rata refund of your CTP premium.
The RTA will issue you with a cancellation letter
after the registration is cancelled. Please have the
RTA letter or interstate registry receipt and
registration certificate with you when you call
GIO on 13 10 10 to organise a refund of your
CTP premium.
›› If you have paid for your CTP and have not used the
policy to register your vehicle, you may be entitled to
a refund. Please call 13 10 10 for information about
how to receive a refund for your CTP premium.
GIO may charge an administration fee for any
cancellation of CTP insurance.

Any fee imposed by the RTA to suspend or cancel


registration at GIO’s request, may also be charged.

GST and Input Tax Credit (ITC)

Who does this affect?
Everyone who pays CTP insurance. All customers must
pay the GST applicable to the CTP premium.

What is the correct premium for me?


Two kinds of premiums apply to all CTP policies:

1. GST registered business that is entitled to claim an


ITC on the insured vehicle,

2. Private operator who is not entitled to claim an ITC.

Your Green Slip will indicate the premium you are being
offered.

If you are entitled to claim an ITC, your Green Slip should
show Y or YES next to the question “Is anyone entitled
to claim an Input Tax Credit on this Green Slip?”.

The Green Slip will be labelled as a tax invoice for tax


purposes.

If you are not registered for GST, your Green Slip should
show N or NO and cannot be used as a tax invoice.

Why does this affect my premium?


Premiums are priced differently depending on whether or
not there is an entitlement to claim an ITC. For policy
holders who are entitled to claim an ITC, insurance
companies do not receive a tax credit when claims are
settled. They also incur additional administration costs in
implementing changes for GST. The MAA has determined
there should be no cross-subsidy between the two
categories.

What if my ITC entitlement status changes after


payment of my CTP premium?
Notify us immediately if your ITC entitlement changes to
ensure your policy is updated correctly. If you were
entitled to claim an ITC at the time a CTP premium was
paid, and this vehicle was registered, then you may not
be entitled to any refund of premium as a result of this
change.

Injured in a motor vehicle accident or
need help making a claim?
If you or someone else is injured in a motor vehicle
accident, follow these 3 simple steps –

1. Report the accident to the Police.

2. Get the registration number of the vehicle at fault.

3. See your doctor for an Accident Notification Form.

Call the MAA Claims Advisory Service on 1300 656 919,


or email cas@maa.nsw.gov.au for assistance and advice
on making a claim.
Note: The NSW Lifetime Care and Support Scheme, which is
included as part of your CTP Green Slip insurance, provides lifetime
medical care and support for everyone (including the driver)
catastrophically injured in a motor vehicle accident regardless of
fault. Injuries sustained to the driver who causes a motor accident
may be covered by GIO’s Driver Cover Plus Policy. Please refer to the
Driver Cover Plus Policy in this booklet for more information about
the cover we provide for serious injuries to the driver who causes a
motor vehicle accident.

Driver Cover Plus Policy
Compulsory Third Party (CTP) Personal Injury insurance
pays compensation for people injured or killed in a motor
vehicle accident.

Under the CTP Scheme, cover for the driver who causes
an accident is limited to up to $5,000 for medical
expenses and loss of earnings claimed within 6 months
of the motor vehicle accident using the Accident
Notification Form (ANF). In the event of catastrophic
injuries, the driver at fault is covered by the Lifetime Care
and Support (LTCS) Scheme.

It is important to know what CTP covers and how GIO’s


Driver Cover Plus Policy provides extra protection for
drivers who cause a motor vehicle accident.

GIO’s Driver Cover Plus compensates drivers, who cause


a motor vehicle accident and are injured, or the driver’s
estate or dependants if the driver at fault is killed, as a
result of a motor vehicle accident. GIO Driver Cover Plus
is provided to the driver of a motor vehicle that has CTP
with GIO. GIO Driver Cover Plus is provided in addition to
GIO CTP at no extra cost. Claims lodged under the ANF
process or LTCS scheme, do not preclude the driver who
causes an accident from lodging a claim against their
GIO Driver Cover Plus policy.

We pay the injured driver who causes the motor vehicle


accident (or the driver’s estate or dependants if the driver
is killed) the benefit for the injury as set out in the
Schedule of benefits and as follows.

›› Excluding paraplegia and quadriplegia, if more than
one of the injuries in the Schedule of benefits is
suffered, we pay the amount of the combined
benefits up to a total of $100,000.
›› If one of the injuries suffered is paraplegia or
quadriplegia we pay only the benefit for paraplegia
or quadriplegia.
›› In the event of death we pay only the benefit for
death.

When we pay Driver Cover Plus Policy benefits


We will pay benefits for injuries suffered by the driver
who causes a motor vehicle accident (or to the driver’s
estate or dependants if the driver is killed) that occurs in
Australia, if ALL of the following apply:

›› at the time of the accident the vehicle was


registered with the Roads and Traffic Authority of
NSW and GIO was the CTP insurer; and
›› at the time of the accident the motor vehicle was
roadworthy and not towing a load over the legal
limit; and
›› the driver was solely at fault for the accident and at
the time of the accident was:
›› aged 25 years or older; or
›› aged between 16 years and under 25 years and
the motor vehicle was comprehensively insured
with GIO; and
›› the injury is included in our Schedule of benefits; and
›› the motor vehicle is a Class 1 Motor Car, Class 3c
goods vehicle (with Gross Vehicle Mass of 4.5t or
less), or a Class 5 primary producer’s vehicle; and
›› the accident was the sole or substantial contributing
factor to the injury shown in our Schedule of
benefits; and
›› an appropriately qualified medical practitioner
confirms that the driver had sustained the injury as
a result of the accident; and
›› the driver (or the driver’s estate or dependants if the
driver dies) is not entitled to claim under a workers’
compensation scheme.

When we do not pay Driver Cover Plus Policy
benefits
We will not pay benefits if:
›› the injury was intentionally caused or was a result of
the accident being intentionally caused; or
›› the driver was under the influence of intoxicating
liquor and the percentage of alcohol in the driver’s
blood is in excess of the legal limit prescribed by the
law applicable in the place where the motor vehicle
accident occurs, or if the driver fails to provide a
specimen of breath or blood as required by law in
that place; or
›› the driver was under the influence of drugs (other
than a drug taken in accordance with the advice of
or administered by a medical practitioner); or
›› the driver was involved in any illegal activity, racing,
pacemaking, car rally, contest, speed/reliability or
other trials at the time of the motor vehicle
accident; or
›› the injury was directly or indirectly caused by, or
was due to, psychological or psychiatric causes,
sickness or disease; or
›› the injury was caused by revolution, war (whether
declared or not), acts of a foreign enemy, military
coup, radioactivity or the use, existence or escape of
nuclear fuel, nuclear material or waste, or the action
of nuclear fission including detonation of any
nuclear device or nuclear weapon, biological,
bacterial, viral, germ, chemical or poisonous
pollutant or contaminant or any looting or rioting
following these occurrences; or
›› the vehicle was being driven while in an unsafe
condition, but we will provide cover if it can be
shown that it was reasonable not to know of any
unsafe conditions; or
›› the vehicle was towing a trailer or caravan illegally
or in an unsafe condition, but we will provide cover
if it can be shown that it was reasonable not to
know of any unsafe conditions; or

›› the vehicle was loaded above the legal limits or in
an illegal way; or
›› the vehicle was being used to carry explosives or
flammable or combustible liquids or substances
illegally.

What happens when you sell your vehicle?


If ownership of the motor vehicle changes and our CTP
insurance policy remains current, this Driver Cover Plus
policy transfers to the new owner or owners when the
change is registered with the Roads and Traffic Authority
of NSW. The eligibility conditions of Driver Cover Plus
also apply to the new owner.

As this policy is provided at no extra cost, no premium


will be refunded for this policy if our CTP policy is
cancelled or transferred.

How to claim on your Driver Cover Plus Policy


Step 1 Notify us in writing of the details of any
accident which could lead to a claim,
including time, date, place, any witnesses
and how the accident happened.

We must receive these details from the driver


or the driver’s legal representative in writing
within 60 days of the accident.
Step 2 Anyone wanting to claim must:

›› complete and lodge our claim form


with us;
›› supply all medical and other documents
we have asked for at the driver’s
expense; and
›› Allow doctors we nominate to conduct
medical examinations we consider
necessary, to assess the claim.

We can reject the claim if:
›› you or the driver are not truthful and frank in any
statement you or the driver make in a claim or in
relation to a claim; or
›› we do not receive:
›› written advice of the details of any accident
which could lead to a claim within 60 days of the
accident; or
›› a completed claim form within 6 months of the
accident; or
›› written confirmation of the accident from police
or other appropriate authorities after making
reasonable enquiries; or
›› appropriate evidence as required by us.
