EXECUTIVE ORDER NO. 50

(EO-50 S. 2010)

MAKING THE CLIENTELE’S OBSERVANCE OF NO-SMOKING POLICY AS ONE OF THE

REQUIREMENTS AND PRE-REQUISITE FOR ANY LGU ASSISTANCE PROGRAM AND OTHER
GOVERNMENT GRANTS IN THE MUNICIPALITY OF DUMINGAG, ZAMBOANGA DEL SUR.

WHEREAS, the R.A. 9211 otherwise known as Tobacco Regulation Act of 2003 provides
that “it is the policy of the State to protect the populace from hazardous products and
promote the right to health and instill health consciousness among them”. It is the main
thrust of the act to, among others, promote a healthful environment, inform the public of the
health risks associated with cigarette smoking and tobacco use, regulate and subsequently
ban all tobacco advertisements and sponsorships, protect the youth from being initiated to
cigarette smoking and tobacco use by prohibiting the sale of tobacco products to minors;

WHEREAS, the World Health Organization, in its Framework Convention on Tobacco

Control which was developed in response to the globalization of the tobacco epidemic and of
which the Republic of the Philippines is a party, recognizes that “cigarettes and some other
products containing tobacco are highly engineered so as to create and maintain dependence”
and that efforts to reduce if not eradicate its ill-effects have to be initiated;

WHEREAS, the Dumingag LGU is religiously implementing the laws and ordinances on
anti-smoking and consistently advocating to its constituents the devastating and ill-effects of
smoking on personal health, family and surrounding communities;

WHEREAS, the undersigned adheres to the No-Smoking Policy of the state and of the
LGU thereby, orders to include the clientele’s observance of no-smoking laws and ordinances
as one of the requirements and pre-requisite for all Dumingag-LGU Assistance Program and
other government grants;

WHEREAS, to strengthen our cause, it is being defined by this order that the only
legitimate beneficiaries for any LGU Assistance Program shall be those non-smoker clientele
of the municipality. Smokers are being disqualified to avail any grant or any assistance coming
from the government;

WHEREAS, all clienteles who wish to avail any of the LGU assistance and grants should
secure certification of being a non-smoker from their respective Barangay Captains and to be
signed by the head of the Municipal Anti-Smoking and Anti-Drugs Secretariat for validation;

NOW, THEREFORE, I, NACIANCENO M. PACALIOGA, JR., Municipal Mayor of

Dumingag, Zamboanga del Sur, by virtue and power vested in me by the law, do hereby order
to make the clientele’s observance of no-smoking policy as one of the requirements and pre-
requisite for any LGU assistance program and other government grants in the municipality of
Dumingag, Zamboanga del Sur.

Let copy of this Executive Order be forwarded to the Office of the Provincial Governor
for review in compliance with Section 1 of Executive Order No. 1, series 2010 issued by
Governor Antonio H. Cerilles.

DONE in the Municipality of Dumingag, Zamboanga del Sur this 21 st day of December,
in the year of Our Lord, Two Thousand and Ten.
