Having an HCP/ITL allows landowners to legally proceed with activities that would otherwise result in the illegal taking of an endangered species, and it ensures the project provides a net benefit to Hawaiian species. The process of obtaining an HCP/ITL takes at least a year and involves submitting a pre-application, drafting the HCP with supporting information, public review and comment, and final approval by the Endangered Species Recovery Committee and Board of Land and Natural Resources. Anyone believing their activities could result in the incidental taking of a protected wildlife species needs an ITL.

and activity that would otherwise result in the illegal take of a listed species, per state and federal law. It also ensures that the project INCIDENTAL TAKE LICENSE provides net benefit to our Hawaiian endangered and threatened (HCP/ITL) species.
How long does it take?
It may take a substantial period of time to finalize an agreement, although your time commitment to a number of stages can be minimal. You should expect it to take at least a year between the time we first submit a pre‐application and the final approval of the agreement and issuance of permits.
The Endangered Species Recovery Committee (ESRC)
State law mandates that the Endangered Species Recovery Committee (ESRC) oversee the processing and monitoring of HCPs. The ESRC includes four agency biologists and two appointed members. The Endangered Species Recovery Committee meeting calendar is available online at:
