Professor S. Ratnajeevn H. Hoole and Dr. Dushyanthi Hoole

As you know, H E the President has been encouraging Tamils to return home and
contribute towards nation-building and reconciliation. Professor Hoole and his wife
have accordingly appealed to His Excellency, expressing their wish to return and have
established the bona fides of their plans to return by resigning their professorial positions
in the US and providing me with a copy of the acceptance of resignation from
Rensselaer Polytechnic Institute in the US. Following an examination of the relevant
facts pursuant thereto, I am directed by His Excellency to ask you to facilitate their
return to service with continuity, In my understanding of the matter as reported to H.E.
the President, the University Grants Commission can facilitate their return by:

1) Requiring University of Peradeniya to nullify the vacation of post notice


served on Professor Hoole. At the time he was on overseas leave authorized
by the UGC on account of threats to his life by the LITE and was not served
with any order to return to work prior to effecting the vacation of post.
Besides University of Peradeniya had released him to serve as VClJaffna
when he was vacated post.

2) Requiring University of Peradeniya to reinstate Dr. Mrs. Hoole to her post in


view of the findings of the Human Rights Commission (in hearings into her
Complaint No. HRC/L/4/339/02) that her rights had been violated through
her termination.

3) Requiring University of. Jaffna to appoint Professor Hoole to the post of


Senior Professor of Computer Science in compliance with the orders of the
University Services Appeals Board in Case No. 671. The Universities Act
(Section 87) stipulates that "A decision made by the Appeals Board ... shall
be final, and ... the Commission or the governing authority of the Higher
Educational Institution concerned, as the case may be, shall implement such
decision" .

4) Requiring University of Jaffna to appoint Dr. Dushyanthi Hoole to the post of
Senior Lecturer in Chemistry (as she has appealed to the USAB). I am given
to understand that the University advertised the post, invited her to the
interview at the last minute when she was in Colombo, then declined a new
interview date and, finally when the UGC ordered her interview, stated after
interviewing her that there is no vacancy despite the advertisement.

5) Requiring the University of Peradeniya to transfer Professor Hoole's and Dr.


Mrs. Hoole's services to the University of Jaffna upon reinstatement without
blemish or loss of service.

Professor and Dr. (Mrs.) Hoole are back in Sri Lanka now having resigned their
positions in the US and I urge definitive action to facilitate their assumption of duties
with immediate effect.
