CONSTITUTION OF DISTRICT CRICKET ASSOCIATION

PART ‘A’- MEMORANDUM

Art. 1. Name: The Association shall be called the “District Cricket


Association……….” And it shall be hereinafter referred to as the “ASSOCIATION”.

Art. 2. Headquarter: The registered office of the Association shall be in the District of
………..

Art.3. Jurisdiction: The jurisdiction of the Association shall extended to the revenue
limits of the …………….. District.

Art. 4. Aims & Objection:


The Association shall be the governing body of the game of Cricket in the District and
its objects shall be to advance and safe guard the interest of the game and particularly:
a) To promote and encourage the game of Cricket & Cricketers of every section of
society without any discrimination within its jurisdiction.
b) To arrange Primary Sports Body Championships in the various age groups.
c) To make arrangements for District Level and Inter-District Championships
when allotted to the Association.
d) To promote the teaching of the game and to encourage those recognized
Coaches and Teachers.
e) To encourage talent and in deserving cases help the players in obtaining
scholarships, sponsorship, employment and monetary benefits etc.
f) To receive grant-in-aid, funds and sponsorships for the purpose of the object of
the Association.
g) Generally do all such acts and things as may seem necessary and conducive to
carrying on of the Aims and Objects of the Association.
h) DCA will abide by the rules and regulations provided by RCA time to time.

PART ‘B’- BYE - LAWS


Art 5. Definitions:
1. “RCA” means the Rajasthan Cricket Association, which is the State
affiliating body of the District Cricket Association;
2. “Act” means The Rajasthan Sports (Registration, Recognition and Regulation
of Associations) Act 2005;
3. “Affiliation Year OR Financial Year”. Means the period of twelve months
stating from 1st April of following 31st March;
4. “Association” means the “District Cricket Association”;
5. “DCA” means a District Cricket Association affiliated to RCA;
6. “Executive Committee” means the Executive Committee of District Cricket
Association duly elected at the Annual General Meeting and may be referred to
as EC;
7. “Executive Member” means the Executive Member duly elected by the General
Body;
8. “Hony. Secretary” means the Hony. Secretary duly elected by the General
Body;
9. Hony. Treasurer” means the Hony. Treasurer duly elected by General Body;
10. “Office Bearers” means and include the elected President, The elected Hony.
Secretary, and elected Hony. Treasurer;
11. “President” Means the President of DCA duly elected by General Body;
12. “DSC” means the District Sports Council;
13. “District” means and includes the entering area revenues under the
administrative control of the Collector of the District;
14. “Regulations” Rules and by-laws laid down by the Executive Committee under
the powers given by the General Body;
15. “General Body” is the General Body of DCA shall mean and include the
representative of affiliated Primary Sports Bodies/ Affiliated Cricket Club or
any nominated individual members other than Primary Sports Body;
16. PSB, “Primary Sports Body” means a club or institution affiliated to the DCA;

Art. 6. Management : The General Body supervise and control the administration of
the District Association and game of Cricket in the District through the Executive
Committee and other sub-committees.

Art.7. Power and Duties of General Body:


a) The General Body shall have the power to elect the Executive Committee.
b) To carry out the objects of the Association and to make and maintain and
publish all necessary rules and regulations in connection therewith.
c) To prohibit any act or practice by affiliated members and clubs or Tournament
Committees affiliated to such members or by any person which in the opinion of
the General Body is detrimental to the interest of the game and to deal with any
such member club or Tournament Committee or person, in such manner as
council may think proper.
d) To consider and deal with all applications for affiliation and decide all question
as to the right of representation at the meeting of the General Body.
e) To delegate all or any of its powers to its duly appointed committee.
f) To enlist by co-option or invitation for any special purpose the services of any
persons who is not an office-bearer or a member of PSB.
g) To nominate a Patron in chief & Patrons if so desired by the majority of
General Body.
h) To establish Office premises, to appoint auditors and fix their remuneration.
i) To dis-affiliate any PSB, which has acted against the Constitution of District
Cricket Association.
Art. 8. Meeting of General Body:
(a) The Annual General Meeting of the Association shall be held once in every year
and as far as possible within 3 months after the end of the official year of the
Association. The ordinary business of the Annual General Meeting shall be:
(i) To receive the Executive Committee reports, balance sheet & auditors
report for the preceding year;
(ii) To appoint an Auditor and fix his remuneration.
(iii) Any other matter which may be brought forward by the Executive
Committee or by any member with the permission of the Chair or which
is duly notified and placed on the agenda by the managing committee.
(iv) To nominate a patron in chief and patrons if so desire by a majority of
the members present at the meeting.
(iv) To elect the members of Executive Committee at the end of their term.
(b) Special Meeting: The President/ Hony. Secretary can convene an extra ordinary
General Meeting in Association after giving a clear 21 days notice, or shorter
notice if Executive Committee finds it necessary, whenever they think necessary
or on a requisition in writing from at least One third of the voting members;
(c) No special meeting shall be competent to enter upon, discuss or transit any
business, which has not been mentioned in the notice upon which it is was
convened.
(d) All business of Annual General Body/ Special Meeting shall be decided by a
bare majority of votes properly recorded at such meeting. However, any
business regarding change of constitution and Rules will be decided by two third
of majority of the members present and who are eligible to vote. All business of
an extra-ordinary general meeting is also decided by bare majority of votes of
the members present.
(e) In case of an equality of votes, the President of the Chairman shall have a
casting vote;
(f) Notice: Notice of every meeting shall unless and shorter notice period is fixed
be sent under Ordinance post to the affiliated PSB 21 days prior to the date
fixed for such meeting. Such notice shall specify the date, time and place of
meeting and the nature of business to be transacted and in case of AGM, it shall
be accompanied by the report of the Hony. Secretary, audited statements of
accounts for the preceding year, a valid voter list with their name and addresses
and also the name and address of the election officer Always provided that the
accidental omission to give any such notice or documents to any person entitled
there to or its non receipt by him shall not invalidate the proceedings at any
meeting. Any dispute regarding the date the Notice were sent would be settled
by a reference to the Dispatch register of DCA.
(g) The election of the office bearers and executive members shall be by secret
ballot.
Art.9. Quorum: The quorum for a general & special meeting shall be one third of the
total number of eligible members having right to vote. If no quorum is available
the meeting shall be adjourned to the same day and time and place meeting shall
be held in succeeding week. No quorum shall be necessary for an adjourned
meeting.

Art.10. Voting: Every representative of an affiliated Primary Sports Bodies shall be


entitled to give one vote only at all meeting of the Association.
i. Any person carrying an authority letter/ proxy with him/her in annexure “B” of
the constitution can represent and vote on behalf of that PSB.
ii. In case of any dispute regarding proxy or any other matter of the election
procedure the decision of the Election Officer will be final.

Art.11.Election Procedure: The Election of the executive committee shall be held


once in every Four years in a democratic manner and the following procedure will be
adopted at the Annual General Meeting of the Association.
(a) Election of Executive Committee shall be held in the manner prescribed by the
Act.
(b) A list of all the members eligible to vote in the ensuing elections shall be
prepared by the Hony. Secretary in accordance with the membership register of
the Association duly approved by the Executive Committee.]
(c) An independent Election Officer having experience of conducting Election shall
be appointed by the Executive Committee before notice of the election is issued.
(d) The Hony. Secretary shall hand over all the related documents to the election
officer will in time (Documents like Voter List, Copy of constitution etc.).
(e) The Hony. Secretary shall issue 21 clear days notice of the AGM and election
along with the list of eligible PSBs entitled to vote with the name, address and
contact number and also the name and address of the Election Officer.
(f) PSB would be required to submit an Authority/ Proxy in the prescribed Proxy
Form as per Schedule B of the Constitution of the DCA to the Election Officer
before the commencement of AGM.
(g) The nominations can be filed to the Election Officer as per programme
circulated, but at least 3 days prior to the elections in the Nomination Form
prescribed in Schedule A of the Constitution of District Cricket Association.
(h) The Election Officer shall scrutinize the Nominations on the same day and will
put the list of eligible candidates at the registered office of the Association. After
withdrawals, the final list of eligible candidates should be put on the registered
office atleast 1 day before the election.
(i) The identity of a proxy holder, if challenged, would have to verified by the
Election Officer allowed to vote and his decision will be final on the basis of an
attested photograph.
(j) If more nominations are received than the number of posts, the election shall be
by secret ballot.
(k) Election of all the office bearers and Executive Committee members will take
place by a single ballot paper. Separate election will not be held for different
posts.
(l) Election officer shall make the arrangement of casting and counting of the votes.
(m) After the elections are over, the Election Officer shall announce the results and
shall issue the Certificate of Election as per t he Provisions of the Act.
(n) That the newly elected Executive Committee shall take charge of the office from
the outgoing office bearers immediately as soon as they received the Certificate
of election.

Art. 12. Executive Committee: The Executive Committee shall consist of the
President, Vice President, Four Vice Presidents, Hony. Secretary, Two Joint Secretaries,
Hony. Treasurer, One Organising Secretary, One Technical advisor, One media
Manager, One Programme director and Seven Executive Members.
a) Sub-committees: For smooth and efficient working, the EC may form Sub-
committees and delegate them powers. The President & the Hony. Secretary
shall be the ex-officio member of all Sub-Committees except the Selection
Committee.

Art 13. Subscription :


a) The annual subscription payable to DCA is Rs. 200/- (Rupees Two Hundred
only)
b) No member shall have right to vote at any meeting of the association unless that
PSB paid its annual subscription and other dues if any by 31st March of that
year.

Art.14. Powers of Executive Committee: The Executive Committee shall work on


behalf of Association and exercise the following powers.
(a) It shall be the duty of the Committee to see that the provisions of the
Constitution and the byelaws and regulations of the Association are complied in
all respect.
(b) The Committee shall sanction and control the expenditure in accordance with
the budget approved by it. The committee shall also supervise and conduct the
business of the Association.
(c) Appoint from time to time such sub-committees including selection committees
as it may deem necessary or expedient and may delegate or confer on it such of
the powers and duties of the committee as the committee may determine.
(d) The Executive Committee will do all acts and things necessary and expedient to
carry out the objectives of the association not herein expressly specified.
(e) To prohibit and the Act or practice by any member or by cricketer which in the
opinion of the committee is determined not in the interest of the game and deal
with any member disregarding such prohibition in such manner as it may in its
discretion feel just and proper.
(f) To discuss and approve the application for new affiliation of PSB.
(g) To approve and confirm the rules of affiliated PSBs and any subsequent
alternations made therein from time to time and amend the same.
(h) To make tournament rules & regulations time to time and amend by a simple
majority by show of hands.
(i) To arbitrate and to decide all disputes or questions refer to it by PSBs or any
other persons or state associations.
(j) To give financial assistance or sports equipments to the affiliated PSBs.

Art. 15. Notice of the Executive Committee:


(a) The Hony. Secretary on the direction of the President or on the motion moved
by atleast 7 of its members shall call the meeting of the Executive Committee as
and when required but atleast once in every 4 months at such time and place
decided by them.
(b) Generally there shall be clear 7 days notice should be given for the meeting of
the Executive Committee. An emergency meeting can be call on 24 hours notice
or such on short notice as may deemed nacessary.
(c) In case of an Emergent circumstances, The Hony. Secretary may get a decision
approved, by moving a “Resolution by Circulation” in writing and agreed to
by all the members of the committee present at the place of the registered office
at that time. On such a resolution it shall be considered approved as soon as it
receives the signatures of 50 percent of the member of the Executive Committee
including all Office Bearers. Such a Resolution by Circulation shall be got
ratified in the ensuing meeting of the Executive Committee.

Art.16. Powers and Duties of Office Bearers:


(a) The President: The President shall be the Chairperson of the Association and of
the District Council and shall direct all transactions with the assistance of the
Executive Committee and it shall be his duty to preside over all meetings of the
District Council and the Executive Committee and to take action as provided in
these rules. He will be the ex-officio member of all sub-committees of DCA
except the Selection Committee.
(b) Hony. Secretary:
(i) To convene meetings of the District Council, Executive Committee and Sub-
committees wherever required.
(ii) To register minutes of all meetings of the District Council, Executive Committee
and Sub committee t be correctly recorded, confirmed, kept and circulated
among the members of District Council Executive Committee and sub
committee as the case may be.
(iii) Have charge of all the correspondence and records of the Association.
(iv) Perform such other duties as may be necessary for the proper and efficient
working of the association.
(v) All cheques shall be issued under the Joint Signatures of the Hony. Secretary or
President and the Hony. Treasurer of the Association.
(c) Hony. Treasurer:
(i) The Hony. Treasurer shall furnish the statement of accounts to the Executive
Committee within two months of the financial year and get it approved.
(ii) He should maintain the accounts and make payments as instructed/ signed by the
President/ Hony. Secretary.
(iii) Collect all money and dues payable to the Association and report to the Hony.
Secretary/ Executive Committee on all financial matters.
(iv) All annual statement of accounts including Income & Expenditure Accounts
duly approved and passed by the Executive Committee with a report of the
auditor shall be put in every AGM for the approval.

Art. 17. Bank Account: The Bank account of the Association shall be operated in a
Bank decided by the Executive Committee.

Art.18. Sub-Committees: The managing committee shall have power to appoint


various sub-committees including Junior & Senior Selection committees and may
delegate them any of the powers vested in the managing committee.
(a) All the sub-committees shall carry out such duties as may be authorized by the
Executive Committee.
(b) All sub-committees should meet at least one in every year.
(c) Generally the tenure of the sub-committee is one year but can be extended by
the Executive Committee for an another year wholly or partly.
(d) The Chairman or a member of the sub-committee can be nominated irrespective
of whether he is a member of PSB or not.

Art. 19. Financial Year: The Financial year of the District Cricket Association and
other PSB shall be from 1st April of a year to the 31st March, of the following year.

Art.20. Affiliations:
(a) PSB, which may desire to be affiliated with the DCA, shall apply to the Hony.
Secretary in a subscribed form along with the following documents:
1) List of membership,
2) List of office bearers,
3) Copy of the minutes of Last annual General Meeting,
4) Two copies of Constitution.
5) Any other documents specified in the Ordinance or required by the DCA.
(b) The Association is the supreme authority to affiliate a new PSB on the
recommendation of Executive Committee.

Art. 21. Disaffiliation:


a) Of a PSB. Notwithstanding anything in this Constitution, an affiliated Organisation
will stand automatically disaffiliated in the occurrence of any violation of
Chapter VIII of the Act for two years in succession or would be disaffiliated
after giving an opportunity of hearing in accordance with the provisions of the
Ordinance and shall be recommended to the Registrar for disqualification on
any of the following grounds.
(i) Non-payment of annual subscription and other dues to the Association by 31st
March every year.
(ii) For electing or keeping in its office as an office bearer or councilor or a member
of any of its sub committee any person who is suspended by the District Cricket
Association at its General Body meeting for any reason whatsoever or for
keeping a person who has been convicted by a court of law.
(iii) Without prior approval of DCA allowing any Cricket event involving other
District/ State players or exhibition matches or any other event to be held by any
of its registered members.
(iv) For violating the obligations as spelt out in Article 21 second time after
cognizance of the first violation has been communicated in writing to the
defaulting Primary Sports bodies.
(v) For not attending in continuous three AGM without seeking leave of absence.
(vi) To refuse or non-co-operation in any official cricket tournament organize by the
DCA.
b) Of a Member of Executive Committee:
(i) Found guilty of any misconduct by the Disciplinary Committee and approved by
Executive Committee.
(ii) Charges framed against him for a offence punishable for more than 5 years.
(iii) If a member willfully refused or neglect comply with any provision of the rules
or is found guilty or such conduct as committee consider likely to affect
adversely the harmony character, stability or interest of the Association, such
member shall be liable to expulsion.
(iv) All such cases shall be referred to Disciplinary Committee consisting of
President, three executive members. The enquiry will be conducted by
Disciplinary Committee following principle of natural justice.

The committee may place member under suspension during pendency of enquiry. The
decision of committee be challenged by way of filing appeal to Executive Committee
within 30 days from the date of decision. If aggrieved by order of EC than against the
order, revision be filed before President of RCA, whose decision will be final.

Art.22. Honorary Life Members: Hony. Life members may be nominated by a simple
majority at a meeting of the Assciation. Persons who have rendered long and
distinguished service for the cause of Cricket game may be nominated as Hony. Life
members by the Association. They may attend the meeting of the Association but
would not have any right to vote.

Art. 23. Chief Patron & Patrons: Persons of repute who has rendered extra ordinary
services for the development of the game of Cricket in the District may be nominated
Chief Patron & Patrons of the Association. This would be an honorary position outside
the Executive Committee without any voting right.
Art.24. Right of Appeal: Any PSB or player or person being aggrieved by a decision
or ruling of an affiliated association may appeal to DCA within a period of 30 days of
the said decision or ruling and the appeal shall be heard at such place and time and such
person and such manner as the Executive Committee of the Association shall direct.

Art. 25. Schedules: The following Schedules would form a part of the Constitution:

The following records should be mandatory for all the Sports Association under
Schedule “D” of Section 34 of the Rajasthan Sports Recognition and Regulation of
Association Act, 2005.

Returning Officer

Procedure
Any Office bearer of an affiliated PSB will put up a written request to Returning Officer
of DCA, for issue of Nomination Form. The Returning Officer will issue the
Nomination Form and enter it in the Nomination form issue register. After receipt of
Nomination form returning Officer, will examine it as per Provisions of the
Constitution of DCA and will decide whether the Nomination Form is valid or Invalid.
Only valid voters can proposed the nomination.

Election Officer

Procedure
The office bearer of an affiliated primary body will send a written request to the Hony.
Secretary of DCA/ Election Officer of DCA to issue a Proxy From with the seal of the
Association.
SCHEDULE-C

(A) CONDITIONS OF AFFILIATION FOR PRIMARY SPORTS BODIES

1. Primary Sports Bodies shall be a body having certificate of affiliation issued


the seal of Hony. Secretary, District Cricket Association.
2. Each affiliated Primary Sports body shall consist of minimum seven
individuals.
3. The Executive Committee of the Primary Sports Body should be elected in the
Annual General Meeting of the Primary Sports Body for a maximum term of
four years in the presence of an Observer of DCA.
4. Each affiliated Primary Sports Body should submit a return each year.
5. Each affiliated Primary Sports Body has to deposit the Affiliation Fees as
prescribed from time to time. These fees should be deposited before 31st march.
6. The Office Bearers of the District Cricket Association shall possess any of the
following qualification:-

(i) They have been born in the District.


(ii) They are ordinarily resident in the District.
(iii) They possess property in the District.
(iv) They are working in the District.
(v) They have been either founder members or members for at least ten
years.
(vi) They have not been convicted in any criminal case.
(vii) They have not been declared insolvent.
