The bidder shall quote contract prices for repairing of different makes and capacity of SMPS modules at nodal repair centre, In emergency conditions, the repair of SMPS modules is to be carried out at stations where SMPS power plant is installed. Incomplete and/or conditional quote shall not be considered. The offer shall be firm in Indian Rupees. 92 9.3 The price quoted by the bidder shall remain fixed during the entire period of contract and shall not be the subject to variation of any amount. However if there is any reduction in taxes/levies the benefit should be passed on BSNL. A bid submitted with an adjustable price quotation will be treated as non-response and rejected 9.4 Discount, if any, offered by the bidders shall not be considered unless they are specifically indicated in the schedule of rates (Rate schedule format / financial Bid). Bidders desiring to offer discount shall therefore modify their offers suitably while quoting and shall quote clearly net price taking all such factors like Discount, free supply, etc. into account. 9.5 The prices quoted shall be exclusive of GST. Contractors having GST Registration can cl GST extra which will be allowed by BSNL in addition to the agreed prices. 10. PERIOD OF VALIDITY OF BI10.1Bid shall remain valid for 180 days from date of opening the bid (QUALIFYING BID) A BID VALID FOR A SHORTER PERIOD SHALL BE REJECTED BY THE ‘BSNL’ AS NON- RESPONSIVE. The ‘BSNL’ reserves the right to request the lowest three bidders as per read out list on the opening day to extend the bid validity for a period of further 120 days and the bidder has to necessarily extend the bid validity. Refusal to extend the bid validity will result in forfeiture of the bid security. SUBMISSION OF BIDS: B Signature of the BidderTender for Repair of SMPS Modules of SMPS PowerPlant of various makes in Ernokulam BA 13.1 All the documents in Qualifying Bid -as mentioned in clause 7 of this section and Financial Bid- ribed format as per BOQ format uploaded in CPP Portal, Schedule for Quoting the Rates are to be uploaded in the e tender portal including in place of EMD, Submit the BID SECURITY DECLARATION as per Section XVIII Cost of Tender document which may be deposited by way of DD. Financial bid should be submitted online only. Scanned documents wherever necessary shall be uploaded in the appropriate places of the e-tender portal. Technical Bid should be dropped in person in the tender box placed in the O/o AGM (EP), O/o PGMT, BSNL Ernakulam, Kochi -682016 before the closing date of tender, as mentioned in NIT-The tenderer should ensure the delivery of the bid at the correct address. The ‘BSNL shall not be held responsible for delivery of Bid to the wrong address. The slit of the tender box will be sealed immediately after the specified time for receipt of the tender. Any tender presented in person after the sealing of box will not be received by the PGMT,BSNL, Emakulam or by any of the subordinates or will not be allowed to be deposited in the tender box. ‘The Rates duly quoted in the pre: ‘Submission of Bids on e-tendering website- The bidder shall upload his bid for this tender in two separate folders marked as ‘Qualifying_Bid’, and ‘Financial_Bid’. The bid folders shall contain the documents as given below- ‘Qualifying Bid’ folder —The scanned documents in electronic form as per clause 7 of this section must be uploaded in this folder. ‘Financial_Bid’ folder- The Rates duly quoted in the prescribed format as per BOQ (Section XX1) uploaded in the CPP Portal. The tenders which are not submitted in above mentioned manner shall be summarily rejected.The tenderer will be bound by all terms, conditions & specifications as detailed in thetender documents.Any tender with conditions other than those specified in the tender document is liable to be summarily rejected. No modification by the contractor in any of the conditions will be permitted 13.2 Postponement of Tender opening: Whenever it is considered necessary to postpone the opening date of tenders, quick decision must be taken and uploaded in the Tender site of BSNL. If the date of opening of bids is declared as holiday, the bids will be opened on the next working date at the same time and venue. 13.3 The Government of India if subsequently declares date fixed for opening of bids as holiday, the revised schedule will be notified. However, in absence of such notification the bids will be opened on next working day, time and venue remaining unaltered. 14 LATE BID’ 14.1 Tenders will not be accepted after the specified time of closing of the tender and the same shall be rejected and returned unopened to the bidder. It is the sole responsibility of the tenderer that he should ensure timely submission of tender. 15 MODIFICATIONS AND WITHDRAWAL OF BID: 15.1 The bidder's modification, revision or withdrawal shall have to be online and digitally authenticated. The bidder may modify online or withdraw his bid after submission and before opening, provided that the intimation is deposited by the bidder in a properly sealed envelope (with wax/Packing PVC tape) in the tender box, before the scheduled time & date for closing of tender, No bid shall be modified subsequent to the deadline for submission of bids. 4 Signature of the BidderTender for Repair of SMPS Modules of SMPS PowerPlant of various makes in Ernokulam BA E. BID OPENING AND EVALUATION: shall open the bids online. The ‘BSNL’ shall open the bids in the presence of bidders or his authorised representative who are present, shall sign in attendance register. The representative shall submit authority letter from the bidder to this effect before he is allowed to participate in the bid opening (A format is given in section —X) 16.2 A maximum of two (2) representatives for any bidder shall be authorised and permitted to attend the bid opening 16.3 The Bids shall be opened in the following manner: ‘The Physical Envelope marked as “Cost of Bid document and Bid Security” shall be ‘opened first and examined by the designated Tender Opening Committee (TOC) of BSNL. The TOC shall ascertain that the documents submitted in the physical envelope meet the requirements of ility for opening the qualifying bid of a bidder for this tender then only the TOC shall open and download the Qualifying Bids ontine after the due date and time by logging into the e-tender portal. ‘The bidders whose Physical Envelopes are either not received in time or the documents do not meet the preliminary requirement of eligibility, their bids shall not be opened/downloaded from the E tender portal. i, The bid opening committee shall count the number of bids downloaded from the ¢-tendering portal and assign serial numbers to the bids. For example, if 10 tenders have been received the bids shall be numbered as 1 of 10, 2 of 10 ete. All the members of TOC shall initial on all the bids downloaded with date. ii, After opening the qualifying bid, all the documents contained therein shall be serially numbered and signed by the bid opening committee members and TOC should prepare and submit TOC report. ii The Qualifying Bids downloaded shall be evaluated by the designated TEC and the result of evaluation after approval by the competent authority shall be uploaded on the E-tender portal for information of all concerned clearly mentioning the qualified bidders and not qualified bidders (with reasons for non qualification) ‘The FINANCIAL BID shall be opened in the followine manner:i)The folder marked “Financial_Bid”, will be opened only for those bidders who have been found eligible afier evaluation of Qualifying Bids. ii) The date and time of opening of Financial Bid shall be notified on e-tendering portal for information of all the bidders. iii) After opening the “Financial Bid” the TOC shall prepare the report containing the bidder's name, bid prices, ete. iv). In case there is a discrepancy in figures and words in the quote, the same shall be announced in the bid opening, but the quoted rates in words shall prevail. 17. CLARIFICATI OF BIDS BY THE ‘BSNI To assist in examination, evaluation and comparison of bids, the ‘BSNL’ may, at its discretion ask the bidder for clarification of its bid. The request for its clarification and its response shall be in writing. However, no post bid clarification at the initiative of the bidder shall be entertained, 18 . PRELIMINARY EVALUATION: 18.1 BSNL’ shall evaluate the bids to determine whether they are complete, whether any computational errors have been made, whether required sureties have been furnished, whether the documents have been properly signed and whether the bids are generally in order. 18.2 If there is discrepancy between words and figures, the amount in words shall prevail. If the Contractor does not accept the correction of the errors, his bid shall be rejected. 183 Prior to the detailed evaluation, pursuant to clause 19, the ‘BSNL’ will determine the substantial responsiveness of each bid to the bid document. BSNL's determination of bid’s responsiveness is to be based on the contents of the bid itself without recourse to extrinsic evidence. 18.4 A bid, determined as substantially non-responsive will be rejected by the ‘BSNL’ and shall not subsequent to the bid opening be made responsive by the bidder by correction of the non-conformity 18.5 The ‘BSNL’ may waive any minor infirmity or non-conformity or irregularity in a bid, which does not constitute a material deviation, provided such waiver, does not prejudice or affect the relative ranking of the bidder. 19, EVALUATION AND COMPARISON OF SUBSTANTIALLY RESPONSIVE BID! 19.1 Those tenders meeting the required technical conditions and accepted by the technical committee only will be taken for opening financial bid.Evaluation will be made on the basis of total amount quoted ie, on the basis of the total amount quoted for all items, but excluding GST. Rate should be quoted for all items. Bids without quoting for all the items will not be evaluated. BSNL reserves the right to negotiate specifications, pri essary Preference will be given to those tenderer who are experienced more, when the rate quoted is equal. ‘The BSNL shall select optimum bidder on the basis of bid price. BSNL. will have the full right to re any or all the tenders and financial bids without assigning any reason whatsoever and are not bound to accept the lowest tender. It may be noted that the methodology given in above is applicable only for the purpose of evaluation of bids and shall have no bearing on actual quantity of work/total payment to be made for the work to be carried out.The L-1 bidder with the lowest aggregate will be considered. The ‘BSNL’ shall evaluate in detail and compare the bids previously determined to be substantially responsive pursuant to clause 18. s during evaluation if found ne(20. CUNTACTING THE BSNL 20.1Subject to clause 17 no bidder shall try to influence the ‘BSNL’ on any matter relating to its bid, from the time of bid opening till the time the contract is awarded, 20.2Any effort by the bidder to modify his bid or influence the *BSNL’ in the ‘BSNL”s bid evaluation, bid comparison or the contract award decisions shall result in the rejection of the bid. 21. AWARD OF CONTRACT: The ‘BSNL’ shall consider award of contract only to those eligible bidders whose offers have been found technically, commercially and financially acceptable. 22, ‘BSNL'S RIGHT TO VARY QUANTUM OF WORK: The ‘BSNL’, at the time of award of work under the contract, reserves the right to decrease or increase the work by up to 25% of the total quantum of work specified in the schedule of requirements without any change in the rates or other terms and conditions. 23, ‘BSNL’S RIGHT TO ACt “EPT ANY BID AND TO REJECT ANY OR ALL BIDS: The ‘BSNL! reserves the right to accept or reject any bid and to annul the bidding process and reject all bids, at any time prior to award of contract without assigning any reason what-so-sever and without thereby incurring any liability to the affected bidder or bidders on the grounds for the “BSNL’s action. 24, ISSUE OF LETTER OF INTENT: The issue of letter of intent shall constitute the intention of the ‘BSNL’ to enter in to the contract with the bidder. Letter of intent will be issued as offer to the successful bidder. 16 Signature of the BidderTender for Repair of SMPS Moduis of SMPS PowerPlans of various makes in Ernokulm A The bidder shall within 7 days of issue of letter of intent, give his acceptance along with security deposit in conformity with clause 5, Section - V, provided with the bid documents. 25. SIGNING OF AGREEMENT: 1, The Signing of agreement shall constitute the award of contract on the bidder. The agreement with the successful bidder shall be signed by the ‘BSNL’ within a week of submission of security deposit as per clause 24 above. 2. As soon as the tender is approved by the competent authority, the Bid Security deposited by the Successful bidder shall be converted in to the performance security deposit, which will be held by the ‘BSNL’ till the completion of warranty period. 26. ANNULMENT OF AWARD: Failure of the successful bidder to comply with the requirement of clause 25 shall constitute sufficient ground for the annulment of the award and forfeiture of the bid security, in which event, the “BSNL? may make the award to any other bidder at the discretion of the ‘BSNL. or call for new bids 27. TERMINATION OF CONTRACT: 27.1. The Principal General Manager, BSNL, Ernakulam reserves the right to terminate the contract by giving notice of 15 days in writing without assigning any reason, thereof. The period of 15 days will count from the date of despatch of the notice. The BSNL shall not be liable for payment of any compensation for any loss that the contractor may be put to or alleged to be put to on account of such termination. 27.2. The PRINCIPAL GENERAL MANAGER Telecom, BSNL Emakulam reserves the right to terminate the contract and to forfeit the Security Deposit of the contractor in the following reasons (i) In case the Contractor fails to carry out the work within the time stipulated in the work order (id. If the works of the contractor is found unsatisfactory /sub standard/ violation of any or all terms andconn eee NN EEL IIE INES 28, Clause by Clause Compliance: All the conditions in the bid documents are ctitical and are to be complied and non-compliance of any clause of the bid document shall result in outright rejection of the bid Vv Signature of the BidderTender for Repair of SMPS Modules of SMPS PowerPlant of various makes in Ernakulam BA SECTION V INERAL (COMMERCIAL) CONDITIONS OF THE CONTRACT 1, APPLICATION: The General conditions shall apply in contracts made by the ‘BSNL’ for the REPAIR OF SMPS MODULES OF SMPS POWER PLANTS OF VARIOUS MAKES IN ERNAKULAM BA 2. STANDARDS: - The contractor shall carry out repair of all types of faulty SMPS modules as per terms and conditions mentioned hereinafter, on annual repair contract basis for Ernakulam BA3. PRICES: 3.1 Prices charged by the Contractor for the works performed under the contract shall not be higher from the prices quoted by the contractor in his Bid. 3.2 Price once fixed will remain valid for the period of contract and shall not be the subject to variation of any amount. However if there is any reduction in taxes/levies the benefit should be passed on BSNL. A bid submitted with an adjustable price quotation will be treated as non-response and rejected. 3.3 Increase and decrease of taxes / duties will not affect the price during this period. 4, SUBCONTRACTS: The contractor shall not assign, sub contract or subject the whole or any part of the works covered by the contract, under any circumstances,5. SECURITY: Security Deposi a.
