HOUSE PASSES LEGISLATION TO HELP HOME
BUILDERS BEFORE WALKOUT
The Indiana House of Representatives approved House Bill 1046
by a vote of 78-20 earlier this week, one of the last bills debated
in the House before the walkout to Illinois. The bill provides a
100% property tax deduction to a residential builder for a single
family residence, townhouse, or condominium that has never
been occupied as a principal residence. Builders would continue
to pay the property taxes on the land, but taxes on the structure
would be exempt. This is a key piece of legislation for the
housing industry as statewide building permits are down 70%
from their peak in the mid-2000s and would allow home builders
to take the deduction on up to three homes for three assessment
dates when the structure is fully assessed. With unanimous
support from the House Ways and Means Committee and an
overwhelming number of Representatives voting for the bill on
the House floor, the bill has made it through the first-half of
session. IBA will be asking for your help in encouraging your
State Senator to support House Bill 1046 as the bill continues to
move through the process. Members can email their Legislator

LEAD PROGRAM TRANSFER STILL MOVING


Senate Bill 366 (Miller R-Indianapolis) which includes language to
require that the State Department of Health assume control of EPA’s
lead-based paint Renovation, Repair and Painting Program was
approved unanimously by the Senate this week and sent to the House
for further consideration. The lead language was amended into this
non-controversial piece of legislation which many Senators
supported. IBA is opposed to the transfer of the program at this time
and will be voicing concerns with House members.
ARIZONA STYLE IMMIGRATION BILL PASSES SENATE
The Indiana Senate passed Arizona-style immigration legislation earlier this week by a vote of
31-18 and now heads to the House for further consideration. The IBA continues to oppose the
legislation and believes the federal government should deal with the immigration issue. IBA
is also a member of the Indiana Compact. For more information or to sign on to the Compact,

SURVEYOR BILL APPROVED


Senate Bill 374 (Boots R-Crawfordsville) would allow a licensed land
surveyor and personnel under the supervision of a land surveyor to
enter any land, water, or property in Indiana, except for: land owned or
controlled by the Department of Homeland Security or a public utility;
or a building, dwelling, or structure on the land or property; to conduct a
survey. The bill passed the Senate by a vote of 44-5 and now moves to
the House for further consideration.

TRANSFER FEE LEGISLATION MOVES FORWARD


Representative Mike Speedy’s (R-Indianapolis) legislation which prohibits the use of private
transfer fees, with the exception of those transfer fees levied by Homeowners Associations and
Condo Associations, was approved by the House with a vote of 98-0 on Monday. House Bill
1541 will now move to the Senate for further consideration.

To Amend or not to Amend…..That is the question

The Steuben County Plan Commission is in the final stretch of ordinance amendment season.
We want to take a few moments to share some of the potential changes that may most impact
the building community. The Plan Commission will be discussing the amendments at their
meetings on March 2 and April 6. Please come out and offer your input or contact staff.
Detached garages.
The proposed amendment will change the height for garages from 18 feet to 15 feet. This height
is measured from the garage floor to the midpoint of the roof, not the peak. For example, a
garage could have 12 foot walls with a peak height of 18 feet or have 10 foot walls with a peak
height of 20 feet and meet the height standard.
Currently, it is only possible to build a garage in a platted subdivision if the owner also has a
home that is adjacent to or across the street from the garage site. The proposed amendment
would allow garages to be built in residential areas within 300 feet of the home site.
Site Plan Requirements.
Currently, the zoning ordinance requires that all structures within 100 feet of a proposed
building be shown on the site plan. In some areas, that can mean a lot of buildings! The
proposed amendment will reduce the distance from 100 feet to 20 feet. This will still show the
spots where buildings may be too close but reduce the burden of preparing a site plan.
The proposed amendment will allow staff to waive the requirement for a residential or
agricultural site plan to be based on a survey if several conditions are met: 1)The property
must be at least 1 acre in size, 2) The structures must be at least 5 feet beyond the required
setback, and 3) The building and impermeable coverage's are at least 3% less than the
maximum allowed.
Minor Subdivision Review Process.
Currently, all subdivisions of land, including minor subdivisions that create 1-4 lots, are
reviewed by the Plan Commission. The proposed amendment will create a plat committee that
can review minor subdivisions. This will allow for a quicker and less expensive process.
Applicants and interested persons can still request that the minor subdivision be heard by the
plan commission.
