DELHI AGRICULTURAL MARKETING BOARD

Power and functions of the Board

- Superintendence and control over the Marketing Committees.


- Dissemination of information of the Board and on behalf of the
committees.
- Inspection of works undertaken by the Marketing Committees and
Board and to undertake appropriate corrective measures.
- General & overall improvement in markets and their respective
areas.
- Providing, grading & standardization facilities of agricultural
produce.
- Ensure regulated marketing practices and better prices and fair
play in the market.
- Establishment of new wholesale regulated markets.

Source of Income

20% of Income of APMCs is received by the Board termed as “Market


Development Fund” to meet out all expenditure.

Power and functions of APMCs

- To regulate the entry of the persons and of vehicular traffic into


the market.
- To supervise the conduct of those who enter the market for
transacting business.
- To grant, renew, refuse, suspend or cancel licences.
- To provide for settling disputes arising out of any kind of
transaction connected with the marketing of notified agricultural
produce and all matters ancillary thereto.
- To prosecute persons for violating the provisions of this Act and the
Rules, Regulations and Bye-laws made there under.
- To maintain and merge the market, including the regulation of
admissions to, and conditions for use of, the market.
- To regulate and marketing of notified agricultural produce in the
market area and the market, and the weighment, delivery of the
payment for, such agricultural produce.

Source of Income

1% of sale proceeds is charged as levy of market fee termed as “Market


Fund” to meet out all expenditure.

Grant of licence – (Under Section 80 of the DAPM(R) Act, 1998)

(1) Subject to the rules made in this behalf, a marketing committee may, after
making such inquiries as it deems fit, grant or renew a licence for the use
of any place in the market yard/area for their marketing of agricultural
produce or for operating therein as a trader, commission agent, broker,
processor, weighman, measurer, surveyor, warehouseman or in any other
capacity in relation to the marketing of agricultural produce or may, after
recording reasons in writing, refuse to grant or renew any such licence.

Provided that where a marketing committee has not started functioning,


the Director, subject to any rules that may be made in this behalf, may
grant or renew a licence for the marketing of agricultural produce or for
operating in the market yard/area as a trader, commission agent, broker,
processor, weighman, measure, surveyor, warehouseman or any other
capacity.

(2) A licence granted under sub-section (1),-

(a) Shall be in such form, valid for such period, and subject to such terms,
conditions, restrictions and limitations as may be prescribed;
(b) Places at which weighment and delivery of agricultural produce shall
be made in any market or market area and on payment of such fees
as may be prescribed.

(3) If the marketing committee or the Director, as the case may be, fails to
grant or renew a licence within a period of sixty days from the date of
receipt of an application in that behalf, it shall be deemed that the licence
has been granted or renewed, as the case may be, if such grant or
renewal has not been refused by marketing committee or the Director, as
the case may be, within the said period of sixty days.

Power to cancel or suspend licence – (Under Section 81 of the DAPM(R) Act,


1998)

(1) Subject to the provisions of sub-section (3), a marketing committee may


for reasons to be recorded in writing, suspend or cancel a licence granted
or renewed under this Chapter.

(a) if the licence had been obtained through willful misrepresentation or


fraud;
(b) if the holder of the licence or any servant or any acting on his behalf
with his express or implied permission commits a breach of any of the
terms or conditions of the licence and/or holder of licence makes
violation of the provisions of the Act, rules and bye-laws made
thereunder;
(c) if the holder of the licence in combination with other holders of licence
commits any act or refrains from carrying out his normal business in
the market with the intention of willfully obstructing, suspending or
stopping the marketing of agricultural produce in the market yard
and /or area;
(d) If the holder of the licence has been adjudged an insolvent, and has
not obtained his discharge; or

(e) If the holder of the licence is convicted his discharge; or

(2) Notwithstanding anything contained in sub-section (1) but subject to


the provisions of sub-section (3), the Director may, for reasons to be
recorded in writing, by order, suspend or cancel any licence granted or
renewed under this Chapter.
(3) No licence shall be suspended or cancelled under this section, unless
the holder thereof has been given a reasonable opportunity of showing
cause against the proposed action.

Appeal – (Under Section 82 of the DAPM(R) Act, 1998)

(1) Any person aggrieved by the order –

(a) of a marketing committee, refusing to grant or renew a licence, or


cancelling or suspending any licence, may prefer an appeal within
30 days to the Vice-Chairman of the Board.
(b) of the Director refusing to grant or renew a licence or cancelling or
suspending any licence may prefer an appeal to the Secretary
Agricultural Marketing Department of the Government within thirty
days from the date on which such order is communicated to him
and in such manner as may be prescribed.

(2) The Vice-Chairman of the Board, or, the Secretary, Agricultural Marketing
Department of the Government, as the case may be, on such appeal,
make such order as he may deem just and proper.

Provided that, before dismissing an appeal, the Vice-Chairman of the Board
or the Secretary, Agricultural Marketing Department of the Government,
as the case may be, shall give the appellant a reasonable opportunity of
being heard, and record in writing the reasons for such dismissal.

Development projects undertaken by the Board/APMCs.

Presently there are 9 wholesale agricultural produce regulated markets in


Delhi under the superintendence and control of the Board. DAMB is undertaking a
comprehensive exercise for development and modernization of these markets.
Based on future projection and a study conducted the following projects have been
conceived by DAMB for improvement/development of the APMCs:-

1. Redevelopment of Azadpur Market

In order to decongest the Azadpur Fruit & Vegetable Market and to


provide modern amenities, facilities centre for grading, sorting, packing etc, a
plan for redevelopment of Azadpur has been conceptualized.

2. Computerization and E-Commerce.

To have transparency in the working of APMC and to provide efficiency


in Market Management System and to disseminate information,
computerization of APMC, Azadpur is being undertaken at an estimated cost
of about Rs. 4 crores.

3. Setting up of Integrated Facility Centre

A modern Integrated Facility Centre having following facilities is being


set up for Fruit & Veg. in Azadpur at an estimated cost of Rs. 15 Crores :-

i) Electronic sorting grading, washing, waxing and packaging line for orange,
apple, Kinoo etc.
ii) Electronic sorting, grading and packaging line for potato.
iii) Ripening chambers for banana and mangoes.
iv) Electronic vegetable sorting line for shrinking, wrapping unit.

4. Development of FRUIT Market at Tikri Khampur

To decongest the existing Fruit & Vegetable Market, Azadpur a policy


decision has been taken to shift the entire trade of apple and other fruits to
Tikri Khampur where a modern market has been proposed to be developed in
about 70.00 acres of land.

5. Development of Fruit, Vegetable and Grain Market at IFC Gazipur

(a) A new wholesale Fruit, vegetable & Flower Market on an area of 37.03
acres of land is under development at Integrated Freight Complex, Gazipur.
The project is estimated to cost about Rs. 90 crores. The trade from
Shahdara was shifted to this newly acquired land by way of providing
temporary facilities on about 8 acres of land during the year 2000.

(b) The Board proposes to develop a Flower Market instead of a Grain


Market in 10 Acres of the total land of 37.03 acres at Gazipur. The Flower
Market is of seven storeyed building with Auction hall etc. The layout Plan and
building plans have been submitted to DDA.

6. Redevelopment & modernization of Poultry Market Gazipur

The Board proposes to redevelop and modernize the existing Poultry


Market at Gazipur in an area of 14.83 acres of land. 120 shops, two auction
platforms and a modern poultry processing plant are proposed to be provided
in the market. The lay out plan and the building plans have been submitted
to DDA.

A detailed action plan in respect of these projects has been drawn. Progress
on all these projects are being constantly monitored by the Board. There has been
substantial progress in respect of all these projects. Some of the projects are
nearing completion, while others are at the stage of execution/implementation.

Transparency and Right to Information Act, 2005

The functioning of this department is open and transparent. There is nothing


classified as Top Secret/Secret which needs reviewing and no section of the Act
prevents the public from access to information. In fact, this department has no
direct dealing with public. However, any person can seek any information as
provided under Right to Information Act, 2005. The following officers have been

State Assistant Public Information Officer and First Appellate Authority under RTI
Act, 05 vide order no. F.15(254)237/2001/DAMB/Mktg/Vol-I/11073-92 dated
