Summary:
After a thorough review of the evidence collected and documented in the Investigative Summary attached
hereto, it is the opinion of the Amusement Ride Safety (ARS) Division that there is insufficient evidence
to find the actions or inactions of Cedar Fair Entertainment Company (Cedar Point) violated any of the
laws found in Chapter 993 of the Ohio Revised Code or any rules adopted by ODA pursuant to ORC
993.04. Therefore, ODA ARS is not recommending any administrative action against Cedar Point.
The purpose of ODA’s investigation was to determine if Cedar Point violated the following rules:
1. No person shall operate an amusement ride in an unsafe condition that could cause a hazard to
riders, employees, or the public (OAC 901:9-1-03(B)(3);
2. No person shall operate an amusement ride in a negligent, reckless, or careless manner (OAC
901:9-1-03(B)(4); and/or
3. No person shall operate an amusement ride in a manner that did not conform to the
manufacturer’s required operation and maintenance procedure, updated bulletins, and/or
directives (OAC 901:9-1-03(B)(6).
The purpose of ODA’s investigation was not to determine the cause of the accident.
ODA conducted a post-accident inspection of the ride, interviewed key Cedar Point staff, and reviewed
thousands of pages of maintenance records, witness reports, and laboratory reporting. Based on this
review, ODA could not establish the levels of proof necessary to bring forward a violation against Cedar
Point.
After examining the documentation provided and conducting interviews of Cedar Point staff, ODA found
no evidence that Cedar Point had knowledge of or reason to believe that the Top Thrill Dragster was in an
unsafe condition that could cause a hazard to riders, employees, or the public on August 15, 2021.
Cedar Point staff indicated that there have not been any issues or problems with the proximity flag plate
this season or in recent memory. The mechanic responsible for the inspection of the Top Thrill Dragster
the night before the accident, affirmatively stated that he inspected the proximity flag plate, and it was not
loose prior to the morning of August 15, 2021. The track was inspected in the overnight hours of August
14th and no damage was present at that time. Based on the statements of Cedar Point staff, on the morning
of August 15, 2021, both the proximity flag plate and the return-side track were in normal, working
condition. In the process of ODA’s investigation, ODA did not discover any evidence to contradict these
statements.
The metallurgical laboratory report provided by American Testing Services, LTD., stated that their
examination “indicates that one of the capscrew fasteners backed out of the bogie frame, resulting in
failure by instantaneous overload fracture.” The capscrew fasteners described in this report refer to the
bolts which secure the proximity flag plate to the body of the ride (“bogie frame”). Cedar Point staff
indicate that the proximity flag plate was secure prior to operation on August 15, 2021. The report states
that the bolt which backed out of the ride failed at “roughly ½ inch below the formed head” and failed by
“instantaneous overload fracture.”
Further, Ohio Administrative Code 901:9-1-05 requires that each owner of an amusement ride, based on
the manufacturer’s recommendations, implement a program of maintenance and pre-opening inspections.
ODA’s investigation found that Cedar Point had implemented a maintenance program consistent with the
manufacturer’s recommendations. This is demonstrated by the work maintenance records which show
that Cedar Point had been actively inspecting, making necessary repairs, and performing preventative
maintenance to the ride. Cedar Point provided documentation of daily inspections showing that Cedar
Point was meeting its requirements of pre-opening inspections.
ODA’s interviews focused on specific repairs or events listed in the Top Thrill Dragster which ODA ARS
believed could have shed light on how the accident may have occurred. Based on these interviews, ODA
determined that Cedar Point acted in accordance with the manufacturer’s recommendations by repairing
or replacing the parts necessary for the safe operation of the ride. These repairs are consistent with the
operation of any roller coaster.
While Cedar Point did not conduct the standard overhaul procedures for the Top Thrill Dragster in 2021,
the company provided documentation showing it worked with the manufacturer to develop an amended
overhaul schedule due to limited use of the ride in 2021. OAC 901:9-1-03 prohibits any person from
operating an amusement ride when “the amusement ride does not conform to the manufacturer’s required
operation and maintenance procedure, updated bulletins and/or directives.” ODA could not find that
Cedar Point failed to conform to the manufacturer’s required maintenance procedures.
Therefore, due to all of the above, ODA ARS believes that there is insufficient evidence to find the
actions or inactions of Cedar Point a violation of any of the laws found in Chapter 993 of the Ohio
Revised Code or any rules adopted by ODA pursuant to ORC 993.04. ODA is considering the matter
closed and is not pursuing any administrative action against Cedar Point.

On August 15, 2021, at approximately 5:15 PM, Deputy Director Todd Thatcher of the Ohio
Department of Agriculture (ODA) received a phone call from the emergency line describing an
accident which occurred at Cedar Point, an amusement park owned and operated by Cedar Fair
Entertainment Company, located at One Cedar Point Drive, Sandusky, Ohio 44870. Immediately
thereafter, Thatcher contacted David E. Miran, Jr., Chief of the Division of Amusement Ride
Safety (ARS Chief Miran) concerning the details of the report.
Around 5:30PM, ARS Chief Miran contacted Greg Spears (Spears), Manager of Ride
Maintenance at Cedar Point to get a direct account of the situation. Spears informed ARS Chief
Miran that a guest was waiting in the queue line of the Top Thrill Dragster and was struck by an
object as a train car was passing by that area. Spears stated that the injured party, later identified
as Rachel Hawes (Hawes), age 44, of 5303 O’Connor Pass, Swartz Creek, Michigan 48473, was
given medical attention at the scene by Cedar Point EMS and was transported by the Sandusky
Fire Department to Firelands Regional Medical Center. Hawes was later transported to St.
Vincent Hospital in Toledo, Ohio.
ARS Chief Miran instructed Spears to shut down the ride pending the investigation by ODA.
Spears confirmed that the ride had already been shut down and that no Cedar Point employee had
contact with the ride since. Spears stated that Cedar Point would have an official accident report
sent to ODA.
Around 6:00PM, ARS Chief Miran contacted ODA Amusement Ride Safety Inspector Paul
Linnemeier (ARSI Linnemeier) to inform him of the ongoing accident scene. ARS Chief Miran
instructed ARSI Linnemeier to travel to Cedar Point to begin ODA’s investigation into the
matter and to secure the ride.
ARSI Linnemeier arrived at Cedar Point at approximately 7:00PM and was escorted to the Top
Thrill Dragster by Cedar Point 2nd Shift Supervisor Zack Roesch. ARSI Linnemeier began to
conduct his investigation by examining the accident site. ARSI Linnemeier discovered that the
green train located in unload position number 2 was missing a proximity flag plate from the rear
of the train. ARSI Linnemeier took pictures from multiple angles. ATTACHMENT 1. ARSI
Linnemeier then placed a state lock on the ride’s control panel to officially stop operation.
ARSI Linnemeier then went to the Park Operation conference room for a meeting with Cedar
Point representatives. In attendance were: Ken Berryhill and Charity Cheatham, CP Safety; Ron
Gilson, CP Chief of Police (Chief Gilson); Karah Folk, CP Park Operations, Justin D. Harris, CP
Legal Counsel (Attorney Harris); and Carrie Boldman (CP General Manager;), and ARSI
Linnemeier. Cedar Point staff had two items suspected to have come off the train: 1) a metal
object; and 2) a bolt. The metal object was later determined to be a proximity flag plate. ARSI
Linnemeier took photos of the items. These pictures are included in ATTACHMENT 1. A copy
of the accident report was given to ARSI Linnemeier at the meeting. ARSI Linnemeier emailed
the accident report to ARS Chief Miran. ATTACHMENT 2. ARSI Linnemeier concluded his
preliminary investigation at approximately 9:00PM.
On August 16, 2021, ARSI Linnemeier, ARSI Jon Kaufman (ARSI Kaufman), and ARS Chief
Miran arrived at Cedar Point at approximately 6:30AM. ODA met with Cedar Point officials
around 6:45AM at Cedar Point’s Maintenance Office to discuss what happened the day of the
accident and ODA’s next steps in the investigation. Present from Cedar Point were Larry Shivak,
Director of Rides and Electrical Maintenance at Cedar Point, Spears, Attorney Harris, and
Colleen Murphy, Vice President of Park Operations at Cedar Point.
ARSI Linnemeier, ARSI Kaufman, and ARS Chief Miran went to the Park Operations Office to
observe the metal object and the bolt originally presented to ARSI Linnemeier on the evening of
August 15, 2021. Present during this meeting were Chief Gilson, Attorney Harris, Carrie
Boldman, and Karah Folk. Chief Gilson stated that the bolt was given to Cedar Point staff by an
EMT present on scene. According to Chief Gilson, these two objects were secured the previous
evening in a safe.
Based on the size and shape of the metal object, all parties present agreed that the metal object
was the proximity flag plate from Top Thrill Dragster’s green train. The proximity flag plate had
several impact marks and was warped. Wear marks were found on the outer edge of the plate.
Additionally, red paint and a strand of yellow fabric was observed on the item. The yellow fabric
appeared to be consistent with the sunshades which are present in the queue area of the Top
Thrill Dragster. ATTACHMENT 3.
ARSI Linnemeier, ARSI Kaufman, and ARS Chief Miran then inspected the bolt which was
found in the queue line by the EMT. The bolt was believed to have separated from the green
train. The bolt appeared to match the size and shape of the bolts which secure the proximity flag
plate to the train. Neither ODA nor Cedar Point could confirm whether the bolt was in fact
related to the proximity flag plate. ATTACHMENT 3. It was later determined that the bolt
presented to ODA was not related to the proximity flag plate. After a thorough search the bolt
was located and sent to American Testing Services, Ltd. for examination.
ARSI Linnemeier, ARSI Kaufman, and ARS Chief Miran then went to Cedar Point’s first aid
office to review accident documentation. Present for Cedar Point were Attorney Harris, Chief
Gilson, and Charity Cheatham. ODA reviewed first aid reports, witness statements and
supplementary reports, daily operational reports, operator training documentation, and an
accident report. Attorney Harris sent these documents to ARS Chief Miran via email on August
16, 2021. ATTACHMENTS 4, 5, 6, 7, and 2.
ARSI Linnemeier, ARSI Kaufman, and ARS Chief Miran then observed the Top Thrill Dragster
ride area. ARSI Linnemeier and ARSI Kaufman inspected the trains, track, the queue area, and
surrounding areas. Top Thrill Dragster has six trains. The trains are identified by color: blue;
black cherry; green; gold; red; and purple. Each train has five cars which are numbered from
front to back.
ODA’s ARSIs confirmed that the green train was missing a proximity flag plate on the left side
of car number 5. ODA ARSI observed that bolts which secured the proximity flag plate to the
train car had been sheared off as a portion of the bolts were still in the train car. Additionally, car
number 5 of the green train had a scratch above the sheared bolts. While inspecting the
remaining trains, ODA ARSI observed that the five other Top Thrill Dragster trains showed wear
marks on their outer edges. According to the daily operational journal dated August 15, 2021, the
blue train was operated during the daily pre-opening inspection and then taken out of the rotation
as a spare train. ODA ARSI inspected the proximity flag plate from the blue train and
documented evidence of minor wear marks on the outer edge. The left proximity flag plate on
the purple train was found to be loose. Documentation of these observations can be found in the
photographs in ATTACHMENT 3.
The queue area was inspected with attention given to the area where Hawes was injured. The
yellow sunshade behind where Hawes had been standing showed evidence of a puncture, which
is consistent with the yellow fabric found on the proximity flag plate from the green train
referenced above. Documentation of these observations can be found in the photographs in
ATTACHMENT 3.
On the return side of the lower track, at the entrance to the fixed brake area, a fixed brake bracket
showed signs of impact and deformation. Several horizonal track beams showed signs of impact
within approximately 25 feet of the damaged brake bracket. The signs of impact were on the left
side of the track when viewed by the direction of travel. Multiple fixed brake fin bolts and brake
frame bolts were loose on both sides of the track. Documentation of these observations can be
found in the photographs in ATTACHMENT 3.
ARSI Linnemeier, ARSI Kaufman, and ARS Chief Miran met with the Cedar Point Maintenance
team after the inspection to discuss the documentation Cedar Point would need to provide to
ODA. ODA verbally reiterated the stop operation order for the ride which was acknowledged by
Spears. ARSI Linnemeier and ARSI completed a preliminary inspection report and submitted it
to ARS Chief Miran. ATTACHMENT 8. On August 19, 2021, a stop operation order was
formally issued to Cedar Point by ARSI Kaufman. ATTACHMENT 9.
On August 16, 2021, ODA Enforcement Agent Gregg Costas (Agent Costas) traveled to St.
Vincent Medical Center located at 2213 Cherry Street, Toledo, Ohio. Agent Costas was informed
that Hawes was in the trauma ICU, was escorted to the unit and directed to Hawes’s father,
Robert Edmunds.
Mr. Edmunds provided the following information: Mr. Edmunds was standing in the Top Thrill
Dragster line with Hawes. Mr. Edmunds saw the ride’s train come back to the station, then saw a
“piece of metal that looked like a black square” flying in the air. Mr. Edmunds stated his
daughter was struck in the head by the object. Hawes was taken by ambulance to the Firelands
Regional Medical Center in Sandusky, then life flighted to St. Vincent.
Mr. Edmunds then introduced Agent Costas to Hawes’ husband, Slater Hawes. Mr. Hawes
advised he was on the other side of the park when the accident occurred, and was made aware of
the situation by Mr. Edmunds. Agent Costas thanked Mr. Edmunds and Mr. Hawes for their
assistance and provided each with his business card.
On August 16, 2021, Ohio Department of Agriculture Interim Chief of Enforcement Jason K.
Davis (Interim Chief Davis) traveled to Cedar Point and met with Chief Gilson. Chief Gilson
advised Interim Chief Davis that they were investigating the accident. The only information that
was available at that time was that a woman standing in line for the Top Thrill Dragster ride was
struck by an object. Chief Gilson stated that the woman had been identified and transported to a
local hospital. The woman had since been transported to St. Vincent Medical Center in Toledo,
Ohio. Chief Gilson also stated that the object that struck the female was identified as a piece of
metal that is supposed to be secured to the back of the cars Chief Gilson stated that part of a bolt
was recovered, and it appeared to have been sheared off. Interim Chief Davis and Chief Gilson
exchanged contact information and then Interim Chief Davis left, Interim Chief Davis never
received any further information from Chief Gilson.
On September 21, 2021, ODA Chief Legal Counsel Denise Martin received additional
documents from Attorney Harris via email. These documents included: maintenance
instructions, maintenance work records, non-destructive testing (NDT) inspection reports, a
service bulletin from the ride’s manufacturer, and a metallurgical laboratory report prepared by
American Testing Services, Ltd. ATTACHMENTS 10, 11, 12, 13 and 14. These documents
were forwarded to ARS Chief Miran.
ARS Chief Miran reviewed the metallurgical laboratory report prepared by American Testing
Services, Ltd. (ATTACHMENT 14). The metallurgical report provides the following test
summary:
“The examination indicates that one of [sic] the Capscrew fasteners backed out of the
Bogie frame, resulting in failure by instantaneous overload fracture. The adjacent
fastener, now subject to transferred loads, experienced fatigue crack initiation and
eventual failure under repetitive reverse bending loads.”
On October 6, 2021, ODA staff traveled to Cedar Point to conduct interviews of various Cedar
Point Staff. Present for ODA was ARS Chief Miran, ARSI Kaufman, Agent Costas, and ODA
Deputy Legal Counsel Kelly McCloud. Counsel for Cedar Point Justin Harris and Hannah
Duschl were also present during the interviews.
ODA interviewed Douglas Bryner (Bryner) first. Bryner stated that he is the third shift ride
mechanic for the Top Thrill Dragster. As a third shift employee, Bryner stated that he works
through the night, after the park is closed to prepare the ride to open the next day. Bryner
indicated that he has been in this position with Cedar Point for the last four years. Bryner
described his job duties as preventative maintenance on the Top Thrill Dragster and is
responsible for the daily inspections of the ride. This includes checking the “tops and bottoms of
all trains.” Bryner indicated that he works with his partner, Ryan Stadler, to inspect the trains
each night. Bryner is responsible for inspecting the left side of the train while Ryan inspects the
right side of the train.
According to Bryner, the top of the train includes all hardware, seat belts, and lap bars of the
train. With regards to the bottom, Bryner inspects every bolt beneath the train, inspects wheel
height, and the proximity flag plates to ensure that nothing is out of specification or loose.
When specifically asked about the inspection that occurred on the night of August 14th going into
August 15th Bryner stated that he “knows for a fact that the [proximity flag plate] was not loose.”
Bryner stated that he performs his inspections using both his eyes and hands. He visually verifies
that the torque stripes are level and attempts to move the flag plate to see if it is loose. Bryner
indicated that on the evening of August 14, 2021, the “torque stripes were still intact” and that
the flag plate “was not loose.”
ODA asked Bryner whether he noticed any wear on the edges and sides of the proximity flag
plate during his inspection. Bryner indicated “not at all” and that checking for wear is another
aspect of his inspection. ODA handed Bryner a photograph showing wear on the outside edge of
the proximity flag plate taken during ODA’s investigation on August 16th. ATTACHMENT 3.
Bryner stated that he had not seen such wear and would have noticed it if it was present during
his inspection.
ODA proceeded with questions related to items listed in the Top Thrill Dragster’s Maintenance
Work Record. An August 2, 2021, entry in the work record (ATTACHMENT 11) made by
Bryner states:
When questioned, Bryner stated that Rob Warner told him to investigate “ticking on the return
side.” Bryner did not find any evidence of contact on the brake frame. However, Bryner found
that the L-brackets which hold the return side brakes were loose. Bryner stated that he secured
the bolts he was able to, however, he ran out of time to remove the bolts he could not tighten.
According to Bryner he believes that “day staff removed them.” 1
An August 13, 2021, entry in the work record (ATTACHMENT 11) made by Bryner states,
“tighten 16 brake bolts up on brake run on return, repaired hitting break, inspected cable.” When
questioned Bryner stated that the “brake bracket was off by one millimeter which caused the
bolts to loosen.” Bryner described the area in question as immediately past the “Finish Line”
which is on the return side of the track. Bryner indicated that he used a man lift to inspect the
track. He stated that he removed the existing bolts and hardware, lined the brake bracket up, and
installed new bolts and hardware. ODA asked if Bryner had witnessed any damage to the brake
brackets while making these repairs. Bryner stated that he did not. ODA presented Bryner a
photograph taken of the track taken during ODA’s investigation on August 16th which shows
signs of impact and other damage. ATTACHMENT 3. Bryner stated that he did not see this
damage on this day.

A work record entry (ATTACHMENT 11) made by Ryan Stadler on August 14, 2021, states
“INSPECT RIDE FOR WHAT MAY HAVE HIT BOGIE ON BC.” ODA questioned Bryner on
this subject. Bryner stated “a chunk of aluminum was found in the guide wheel” on the Black
Cherry (“BC”) train. Bryner described the item as round and “like a coin.” Bryner indicated that
he and Stadler inspected the return side, main lift, and launch track and found no damage. Bryner
stated that he and Stadler were not able to discover the cause of the impact. Bryner gave the
piece of aluminum to Rob Warner. Bryner stated that he spoke with Shane Zavala about the
piece of aluminum.
ODA interviewed Shane Zavala. Zavala stated that he is in his second season in the Ride
Maintenance division of Cedar Point. Zavala stated that he does perform maintenance work on
the Top Thrill Dragster. When asked to describe this work, Zavala stated that his role as a first
shift mechanic is to perform various inspections regarding the Top Thrill Dragsters cable and
launch track. This includes “inspecting the cable for wear” and applying lubrication to both the
cable and drum. When asked if he had examined the proximity flag plate on the trains, Zavala
stated “No. I don’t inspect the tops and bottoms of the trains.”
According to the work record (ATTACHMENT 11), Zavala worked on the Top Thrill Dragster
the day of the accident, August 15th. Specifically, the work record states:
Zavala stated that several stop blocks on the launch side of the track had sheered bolts. They
inspected the track and could not find the cause. According to Zavala, all of the bolts were
replaced. When asked about the piece of aluminum Bryner and Stadler had discovered, Zavala
stated that he remembered being told about it but did not discover its cause.
ODA interviewed Zachary Roesch. Roesch indicated that he has been a Ride Maintenance
Supervisor at Cedar Point since 2018. Roesch stated that he has worked at Cedar Point for the
last 24 years. During this time, Roesch indicated that he has worked on the Top Thrill Dragster
since 2004 in various roles including, Ride Mechanic and Foreman. ODA questioned Roesch on
whether members of the Cedar Point team have asked questions or raised concerns regarding the
Top Thrill Dragster this year. According to Roesch he has only been told of “minor issues.”
These have included brake assemblies and brake return brackets. With regards to the brake return
brackets, Roesch stated, “they have a tendency to come loose.” However, Roesch went on to say
that they are routinely checked to ensure they are tight. When specifically asked whether there
had been any issues surrounding the proximity flag plate, Roesch stated “No.”
ODA asked Roesch if during his time at Cedar Point whether there had been any issues with the
proximity flag plate on the Top Thrill Dragster. Roesch stated that a previous version of the
proximity flag plate had issues, however, he believes that the manufacturer [Intamin] made a
change to the design of the plate around 2005. Roesch does not believe there have been any
issues since.
Roesch described the off-season overhaul process. Roesch indicated that there is a general
inspection of the trains and usually a complete overhaul of the train and its cars. Roesch stated
that this year a collaborative decision was made between Cedar Point and Intamin to reduce the
overhaul procedures because of limited runtime as a result of pandemic related closures. 2
ODA interviewed Robert Lee Warner. Warner stated that he has been the third shift Ride
Maintenance Foreman since 2014. Warner stated that he has worked at Cedar Point for the last
25 years. Warner indicated that he oversees the maintenance team and helps allocate resources to
the maintenance team. Warner stated that one of the rides he oversees is the Top Thrill Dragster.
ODA questioned Warner on whether members of the Cedar Point team have asked questions or
raised concerns regarding the Top Thrill Dragster this year. According to Warner, he has only
been told of “minor stuff.” When specifically asked if any of these concerns were regarding the
proximity flag plate he responded, “No.”
ODA questioned Warner on the damage that was discovered on the Black Cherry train on the
evening of August 14th (ATTACHMENT 11). Warner indicated that he inspected the launch side
of the track but did not find anything. Warner advised that he did not inspect the return side of
the track.
ODA interviewed David Scott Adams. Adams stated he is the Top Thrill Dragster Team Leader.
Adams stated that this was his first season with the ride but his fourth within Cedar Point. Adams
described his duties as “overseeing the operation of the ride.” According to Adams this includes
testing the ride on a daily basis, working with maintenance to ensure the ride is ready for
operation, and managing the team that operates the ride. Additionally, Adams stated that during
the ride’s operation he keeps an eye out for “strange smells” and “different sounds.”
ODA asked Adams to recall information from August 15th. Adams stated that he could not recall
any “strange noises” on that day. When specifically asked about the green train, Adams stated
that he did not have any issues with that train that day. Adams stated that he was in the control
booth at the time of the accident. His team member, Austin Riggle, pressed the “e-stop” button
when one of his associates signaled. In Adams’s supplemental report (ATTACHMENT 5),
Adams stated, “Gabriel Karbler at entrance informed me that someone had been hit on the head
with an object. I then called emergency services for EMS and security.”
ODA interviewed Chad Alan Stookey. Stookey stated that this was his first season in ride
maintenance for the Top Thrill Dragster. Stookey described his responsibilities as “making sure
the rides are running.” Stookey stated that with the Top Thrill Dragster he checks the “frames,
cables, wheels, and tracks.” When asked if he had examined the proximity flag plate on the
trains, Stookey stated “No. I do not inspect trains.”
Stookey stated on the day of the accident he was called to the Top Thrill Dragster about “hearing
noises from the brakes.” Stookey stated that they did not find any issues with the brake fins but
did discover some “bad bolts.” Stookey called his supervisors who instructed him to replace the
blocks and bolts. Stookey indicated that he made those replacements.

When specifically asked if he had heard any complaints regarding the proximity flag plate
Stookey responded, “No.” Stookey additionally added that regarding the mechanics ability to
remove the proximity flag plates, “heard it’s really hard for them to get off.”
ODA interviewed David Owen Elswick. Elswick stated that he is the first shift supervisor for
ride maintenance. Elswick indicated that he has been in that position for four years and has been
employed with Cedar Point for 34 years. Elswick described his duties as “overseeing the
foreman to get morning inspections done to open the park.”
When specifically asked if he had heard any complaints regarding the proximity flag plate
Elswick responded, “No.” When asked if during his time at Cedar Point he could recall any
issues with the proximity flag plate, Elswick responded “No.” Elswick added, “you have to heat
it [proximity flag plate] with a torch to break it off.”
ODA showed Elswick the photograph taken of the track taken during ODA’s investigation on
August 16th which shows signs of impact and other damage. ATTACHMENT 3. Elswick stated
that he had not seen this damage previously and believes that it was new.
ODA interviewed Tyler James Strader. Strader stated that he has been a ride mechanic for the
last four years at Cedar Point. Strader stated that he works second shift. When asked to describe
his job responsibilities, Strader replied, “inspect and maintain rides; troubleshooting.” According
to the work records (ATTACHMENT 11), Strader documented that he performed a “visual
inspection” on August 14, 2021. Strader described this as “general overall maintenance.” He
went on to state that he “watches and listens to the ride to see if it is running differently.” When
asked if there were any issues during the August 14th inspection he replied, “No issues.” When
specifically asked if he had heard any complaints regarding the proximity flag plate Strader
responded, “No.”
ODA interviewed Greg Spears. Spears stated that he has been the manager of ride maintenance
for the past four years and an employee of Cedar Point for twenty-seven years in total. ODA
questioned Spears on the off-season overhaul process. Spears stated that the standard process is
to completely overhaul all six trains. When discussing the proximity flag plate, Spears indicated
that Cedar Point removes the proximity flag plates and replace the fasteners with new hardware.
Spears believes the Cedar Point mechanics utilize Loctite Blue 242/243 when fastening the new
hardware.
Spears stated that the Top Thrill Dragster ran only a fraction of the traditional number of hours in
2020 due to pandemic related closures. Cedar Point and the Top Thrill Dragster’s manufacturer,
Intamin, agreed to amend the offseason overhaul procedures to reflect the reduction in run time.
Specifically, Intamin, via email, agreed to allow Cedar Point to “a limited overhaul” of the Top
Thrill Dragster which included a “complete inspection on one complete care for 5 of the 6 trains,
all others will receive close visual inspection. Minimum of 17% of all critical components will
be inspected.” ATTACHMENT 15. Spears stated that they complied with Intamin’s amended
procedure by overhauling Car 3 on each of the six trains which was approximately 20% of the
trains. Documentation of this overhaul procedure can be found in ATTACHMENT 11.
ODA questioned Spears on the August 2nd work record (ATTACHMENT 11) made by Bryner.
According to Spears, this was “taken care of that night.” When questioned on the damage found
on the Black Cherry train on August 14th, Spears responded that they “could not find out what
happened to the train.”
Spears stated that he had neither heard about, nor seen, any issues regarding the proximity flag
plate this season. ODA showed Spears the photograph of the track taken during ODA’s
investigation on August 16th, which shows signs of impact and other damage. ATTACHMENT
3. Spears’s opinion was that what he observed in the photo was “new damage.” Spears stated that
the “prox flag somehow caught the bracket.” Spears stated that, after the accident and prior to the
transport to American Testing Services, Ltd., he had an opportunity to look at the bolts and
indicated that they “looked normal” and he “doesn’t know how the flag plate got loose.”
ODA interviewed Gerald Ernest Scott. Scott stated that he has been a ride maintenance foreman
for the last four years at Cedar Point. Scott stated that he has been employed by Cedar Point for
the last twenty-two years. Scott stated that his job is to help “maintain the rides”. Scott stated that
the Top Thrill Dragster was one of the rides he helps to maintain. Scott indicated that he orders
parts for the ride mechanics. When asked what Scott’s typical job duties were with regards to the
Top Thrill Dragster, he replied that he “did not work on the trains this year.”
Scott stated that he had heard “no mention of flag plate problems” this year. When asked about
the brake return brackets, Scott stated that there are issues “from time to time.” Scott indicated
that they need to replace bolts on the return track.
On November 1, 2021, ODA interviewed Ryan Stadler at the law offices of Reminger Co.
located at 200 S. Civic Center Dr. 800, Columbus, Ohio 43215. Present for ODA was ARS Chief
Miran, ARSI Kaufman, Agent Costas, and ODA Chief Legal Counsel Denise Martin. Present for
Cedar Point was legal counsel Hannah Duschl.
Ryan Stadler stated that this past summer was his second summer as a ride maintenance
technician at Cedar Point. Stadler stated that this was a seasonal position and not full time. When
asked to describe his job duties regarding the Top Thrill Dragster, Stadler indicated that he
“inspects the ride every night.” Stadler added that he checks the “tops and bottoms of all trains.”
ODA asked if he inspected both sides of the trains during his inspections, Stadler indicated that
his breakdown is “90/10 right side.”
ODA asked Stadler whether he noticed any wear on the edges and sides of the proximity flag
plate during his inspection. Stadler stated that he “does not recall seeing any wear on the plates.”
ODA asked Stadler about the August 13, 2021, entry in the work record (ATTACHMENT 11)
made by Bryner which states, “tighten 16 brake bolts up on brake run on return, repaired hitting
break, inspected cable.” Stadler stated that you need a man lift to reach the return track and that
he did not go up with Bryner because he did not have a harness. Stadler stated that “[Bryner]
went down the whole track and tightened all the bolts that were loose.”
