Subject: Complaint by Ted Hintz, Jr.

Dear Mr. Oyola,

I am replying to a complaint filed by Theodore W. Hintz, Jr. dated October 22, 2010 which I received via U.S.
Postal Service the week of December 20, 2010.

In his Affidavit of Complaint, Ted Hintz alleges that the Chatham Party, an Independent political party and
Political Committee, started another Political Committee in violation of Sec 9-609 by the name of East
Hampton Residents Who Reject TC6 Referendums. This allegation is patently false and inaccurate.

First, the form that was filed, where I am the signatory Agent, is SEEC Form 6, not SEEC Form 7 nor SEEC
Form 3. Specifically, SEEC Form 6 states that “the agent’s filing of the group’s certification eliminates the
requirements to register as a political committee, establish a bank account, appoint a treasurer, and file any
campaign finance disclosure statements.” Unless my interpretation of the language is incorrect, the filing of a
Form 6 specifically eliminates the requirement for the formation of a Political Committee.

Second, it was never my intent to form the East Hampton Residents Who Reject TC6 Referendums group as
a Political Committee.

Third, the sole intent of East Hampton Residents Who Reject TC6 Referendums group was to oppose the
November 2, 2010 East Hampton Town Council referendum questions. Nothing more, nothing less.

Four, it was not the intent of the East Hampton Residents Who Reject TC6 Referendums group to spend
more than $1,000 in funds or resources and the group did not spend more than $1,000, which is the entire
purpose for filing SEEC Form 6.

Five, Mr. Hintz states that the Chatham Party started the Political Committee East Hampton Residents Who
Reject TC6 Referendums. As the Chairman of the Chatham Party I can unequivocally state that Mr. Hintz’s
allegation is a lie. The Chatham Party did not form said Political Committee, nor did it donate any funds, and
finally, the Political Committee is not, in any shape or form, an extension of the Chatham Party.

Six, of the three persons who comprise the SEEC 6 group East Hampton Residents Who Reject TC6
Referendums, 2 of the 3 individuals listed are not members of the Chatham Party.

For the reasons stated above, I do not believe that Mr. Hintz’s complaint has any legal merit and should be
summarily dismissed.
