TENDER SCHEDULE FOR THE DESIGN, FABRICATION AND INSTALLATION OF EXHIBIT


CABINETS FOR DRDO GALLERY AT PERIYAR SCIENCE AND TECHNOLOGY CENTRE,
CHENNAI -25

General terms and conditions for submission of tender for fabrication & installation of exhibit cabinets for “DRDO
Gallery” at Chennai as per the specifications and drawings for the tender provided by Tamilnadu Science and
Technology Centre, Gandhimandapam road, Chennai – 600025.

1. Tenderer shall be required to take up the job of fabrication and installation of exhibit cabinets for “DRDO
Gallery” of Periyar Science and Technology Centre, Chennai as per the specifications. Quantity and
drawings provided complete in all respects and in finished condition.
2. The tenderer shall not be a close relative of any employee of the Tamilnadu Science and Technology Centre

3. The successful tenderer (s) shall submit the following documents within 7 (seven) days from the date of
placement of the work order.

1) Duplicate copy of the work order duly signed and stamped by the tenderer.
ii) The original copy of the Agreement governing the terms and conditions of the contract on non –
judicial stamp paper as per the Proforma enclosed.
4. In case, the successful tenderer (s) does not comply with or refuses to accept the offer after finalization or
within 7 days from the date of placement of the order as per the finalized and accepted terms and
conditions, the order shall be cancelled forthwith without any further reference and the EMD shall be
forfeited.
5. The price and rates indicated shall include cost of labour for fabrication & installation of the exhibit
cabinets of Periyar Science and Technology Centre and all other incidental charges for execution of the
work complete in all respects. Service Tax and other Taxes/levies to be imposed on the value of work to
be executed shall be clearly mentioned. Service tax included in the

bill shall be deducted at source and remitted to the authority concerned by TNSTC and a certificate shall be
issued to that effect. IT will be deducted at source as per rules, Further, works contract sales tax as applicable
will be deducted at source at the time of releasing payment. The prices and rates quoted shall be firm and fixed
for the entire period of execution of the job and no escalation of rate on any ground whatsoever shall be
applicable.
6. Time of completion
Time is the essence of this work. The entire work shall be completed within 60 (SIXTY) days from the
date of placement of order.
7. Penalty clause.
The successful tenderer (s) shall strictly observe the time allowed for carrying out the works. The work
shall, throughout the stipulated period of the contract, be proceeded with due diligence (time being deemed
to be the essence of the contract). Tenderer shall pay to the Science Centre an amount equal to 1% of the
amount of the contract value for every week or a part there of that the work may remain incomplete,
subject to a maximum compensation of 10% of the contract value after which period, appropriate action
will be taken by the Science Centre as deemed fit.
The Science Centre may extend the time for completion of the tendered job at its discretion on the written
request of the successful tenderer(s) for such purpose provided that the Science Centre considers the
reasons for such extension as genuine , sufficient and acceptable.
8. Every effort should be made by the successful tenderer (s) to complete the work which the specified time
schedule. In case, the tenderer fails to complete the work within the specified time as per the finalized and
accepted terms and conditions, the Science Centre shall have the right to either impose the penalty Clause
or cancel the order or both. The decision of the Science Centre in this regard shall be final and binding on
the successful tenderer (s) The successful tenderer(s) cannot claim any compensation for such cancellation
or termination of contract.

9. Security deposit.
10% of the gross value of the work order shall be deducted from the bill towards security deposit. In case
the total value of work executed exceeds the value of the work order, Security deposit for the excess amount
will also be deducted from the bill of the tenderer.
10. Inspection
Any defects pointed out by the competent authorities of the Science Centre, during the course of the work
have to be promptly rectified at the cost, including material cost of the successful tenderer, to ensure
desired quality of work., failing which action shall be taken as deemed fit by the Science Centre and the
additional cost incurred in rectifying the defects by engaging other agency shall be recovered from the
tenderer. The decision of the Science Centre in this regard shall be final and binding on the successful
tenderer(s).

11. Terms of payment


No advance payment shall be made by this Science Centre under any circumstances.Payment shall be
released after satisfactory completion of the entire job in all respects and within 30 days from the date of
receipt of invoice / bill duly supported by satisfactory inspection / work completion certificate from the
Science Centre authorities.
Income tax, Works contract tax, services tax etc as applicable shall be deducted from the bill.
12. Defect liability period.
The defect liability period shall be for a period of 6 months from the date of completion of the work. The
successful tenderer shall be responsible for rectification of the defects of the exhibit cabinets and structures,
breakage defective workmanship etc for a period of 6 months from the date of completion of the job. The
successful tenderer shall rectify the defects/ defective parts within the specified time to the complete
satisfaction of the competent authority of the Science Centre, failing which the Science Centre shall have
the right to rectify the defects of the successful tenderers own risk and cost which will be
adjusted from the security deposit. Decision of the Science Centre in this regard shall be final and binding
on the successful tenderer.
The security deposit shall be refunded to the successful tenderer on completion of the defect liability period
of 6 months from the virtual date of completion of the work without interest and after deduction of the cost
of rectification, if any carried out by the Science Centre.

13. Bad workmanship will not be accepted and should be rectified by the successful tenderer(s) at his
own cost as per specifications and directions given by the authorized representatives of the Science
Centre. The decision of the competent authority of the Science Centre as to items of bad
workmanship and proper replacement / rectification shall be final and binding on the successful
tenders(s).
14. Specifications of the items under tender are enclosed for guidance. However ambiguity in the
specifications, if any, shall be promptly brought to the notice of the authorities of the Science Centre
for clarification during the mobilization period . The successful tenderer(s) shall make no deviation
from the approved specifications without the prior written approval of the competent authorities of
the Science Centre.
15. The successful tenderer(s) shall be liable to pay compensation as per Workmen’s Compensation Act
for any kind of injury resulting in temporary or permanent disability or loss of life of any employees
who are deployed by the successful tenderer(s) at the worksite during the time of execution of the
said work. The successful tenderer shall indemnify Tamilnadu Science and Technology Centre
against any such liability.
16. The authorities of the Science Centre reserve the right to amend, alter or modify the bill of
quantities, specifications and drawings of the work as mentioned above, if necessary.
17. The authorities of Science Centre, who do not bind themselves to accept the lowest tender , reserve
the right to accept/reject any or all tenders wholly or partially without assigning any reason
whatsoever.

18. The authorities of the Science Centre shall have free access to the worksite and the successful
tenderer(s) shall cooperate with them for inspection and / or examination and testing of the materials
and workmanship.
19. The successful tenderer(s) shall obtain necessary trade and other licence as may be required to
carry on the tendered job and shall also be responsible for compliance of all rules and regulations
which may be in force from time to time by the appropriate authority at his / their own cost.
20. The successful tenderer shall not under any circumstances whatsoever transfer wholly or partially
this contract/agreement to any other persons / firm/company or assign the contract / agreement to
any other party for any reason whatsoever, otherwise this contract/agreement will automatically
stand cancelled.
21. It shall be the responsibility of the successful tenderer(s)
a) To Take care of the materials issued by the Science Centre / Centre and tools and tackles brought
to work site to execute the work against damages, theft etc.,
b) To carryout the job at the site and take care of the exhibits (both finished and semi finished)
fabricated by them till they are taken over by the authorities Science Centre.
c) Ensure that the flooring, walls ceiling, exhibit cabinets etc already in position are not damaged
due to any reasons like bad material handling, improper supervision etc.
In case of any damages before handing over the exhibits to TNSTC, the successful
tenderer shall be fully responsible to make good the damage.

22. All disputes and differences of any kind between the successful tenderer and the Science Centre
except quality of workmanship, whatever arising out of or in connection with the order on carrying
out the work (Whether during the progress of the work or after their completion and whether before
or after the determination, abandonment or breach of the terms and conditions of the order) shall be
referred to the sole arbitration of a person nominated by the Tamilnadu Science and Technology
Centre, whose decision in this regard shall be final and binding on both the successful
tenderer(s)and the Science Centre. The provisions of the Arbitration and Conciliation Act 1996 or
any statutory modification or re-enactment thereof and of the rules made there under for the time
being in force shall apply to arbitration proceedings.

23. Qualifying Criteria

• The bidder should have successfully completed design, fabrication and installation
of similar such systems within last 5 years.
• The annual turnover of the bidder during the last three financial years 2007-2008,
2008-2009, 2009-2010 shall not be less than 2 crores per annum. This shall be
supported by copies of the latest audited Annual Reports for the last three financial
years.
• The above said requirements are minimum.
• However, the purchaser reserves the right to request for any additional information
and also reserves the right to reject the proposal of any bidder , if in the opinion of
the purchaser, the qualifying data is incomplete or the bidder is found not qualified
to satisfactorily perform the work.

TECHNICAL SPECIFICATIONS

* Unless specified, for all the frame works for exhibit cabinets, use 2” x 2” C/s fully seasoned
first quality teak wood for vertical and horizontal members, covered with 12mm plywood
and finished with decorative laminates as per the specifications mentioned.
• All the exhibit structures to be firmly grouted to the floor /walls etc unless otherwise
specified.
• The exhibits should be fabricated & installed at Periyar Science and Technology Centre,
Chennai in the finished form as per specifications. Any ambiguity in materials and
dimensions, if & when noticed, may be immediately brought to the notice of TNSTC and
clarification sought.

• All members of the frames shall be straight without any warp or bow and at right angles to
each other of the joints, unless otherwise specified.
• Frames shall have square butt joints.
• Plywood of 12 mm thickness is to be used for paneling, for all vertical and horizontal
surfaces , except for curved surfaces and top of the cabinets. Plywood 12 mm thickness is
to be used for table tops and platforms.
• For curved surfaces, frame may be made out of teakwood battens for verticals and 19 mm
plywood, 100 mm width cut as per the contour as horizontals. 6mm thick flexible plywood
may be used for curved paneling
• Adequate maintenance doors with teakwood frame and piano hinges 25 mm width are to
be used / provided on the cabinets with square locks/ Multi purpose locks to be used /
provided.

Decorative laminates:

• The front, table top and all exposed surfaces of the cabinets are to be pasted with
decorative laminates of approved shade. The surface of the pasted laminates should be
uniform, devoid of any air pockets.
• Horizontal joints on vertical surfaces are to be avoided. Vertical joints on surfaces are to be
kept minimum and equal width to be maintained. Vertical gap between two adjacent
laminates should be less that 1.5 mm..

Science Centre’s specifications and drawings and the cost as mentioned below:

THIS ARTICLES OF AGREEMENT WITNESSETH AND IT IS HEREBY AGREED, DECLARED,


RECORDED AND CONFIRMED BY BOTH THE PARTIES HERETO AS FOLLOWS:

01. Time of Completion:


Time is the essence of this Contract. The entire work shall be completed within 60 ( SIXTY) days from the

date of the site provided to the agencies for execution of the work viz., Fabrication and installation of

Exhibits at Periyar Science and Technology Centre as per specifications .

02. Penalty Clause :

The contractor shall strictly observe the time allowed for carrying out the works. The work shall,

throughout the stipulated period of the contract, be proceeded with due diligence (time being deemed to be

the essence of the contract ) and the Contractor shall pay to the Science Centre an amount equal to 1% of the

amount of the contract value for every week or a part thereof the work that may remain incomplete subject

to a maximum compensation of 10% of the contract value after which period , appropriate action will be

taken by the Science Centre as deemed fit.

The Science Centre may extend the time of delivery of the tendered job at their discretion on the written

request of the Contractor for such purpose provided that the Science Centre considers the reasons for such

extension as genuine, sufficient and acceptable.

03. Every effort should be made by the Contractor to complete the work within the specified time schedule. In

case the Contractor fails to complete the work within the specified time schedule as per the finalized and

accepted terms and

conditions, the Science Centre shall have the right to either impose Penalty clause or cancel the order. The

decision of the Science Centre in this regard shall be final and binding on the Contractor.

04. Security deposit

/ prepared or constructed for the contract and the contractor shall co-operate with them for inspection

and / or examination and testing of the materials and workmanship.

13. The Contractor shall obtain necessary trade and other license as may be required to carry out the

tendered job and shall also be responsible for compliance of all rules and regulations which may be in

force from time to time by the appropriate authority at his / their own cost.

14. The successful tenderer(s) shall not under any circumstances whatsoever transfer wholly or partially this

contract / agreement to any other person (s) / firm / company or assign the contract / agreement or

benefits of this contract / agreement to any other party for any reason whatsoever in which case this

contract /agreement will automatically stand cancelled.

15. It shall be the responsibility of the Contractor

16. All disputes and differences of any kind between the Contractor and the Science Centre except quality of

workmanship and materials whatever arising out of or in connection with the order on the carrying out

work (whether during the progress of the work or after their completion and whether before or after the

determination, abandonment or breach of the terms and conditions of the order) shall be referred to the

sole arbitration of a person nominated by the the Executive Director, TamilNadu Science Centre whose

decision in this regard will be final and binding on both the Contractor and the Science Centre.

The provisions of the Arbitration and Concillation Act 1996 or any statutory modification of re-

enactment thereof and of the rules made thereunder for the time being in force shall apply to arbitration

proceedings.

17. All other conditions given in the tender document under various sections shall stand valid and the

Contractor shall abide by them.
