MASTER MEMORANDUM

OF AGREEMENT

DEPLOYMENT OF POUCE OFFICERS TO THE PROVINCE OF ONTARIO DURING THE 2010 G8-G20 SUMMrrs BETWEEN: POLICE SERVICES IN CANADA as represented by the CHIEF OF POUCE (hereinafter referred to as the -other Police Services-) AND THE: ROYAL CANADIAN MOUNTED POlICE, as represented by the COMMANDING OFFICER, -a· DMSION (hereinafter referred to as the ·RCMPj 1.0 . 1.1 PURPOSE

The purpose of this Master Memorandum .of Agreement (·MMOA,") Is to document the arrangements between the RCMP and other Police Services regarding the deployment of police officers during the 2010 G8-G20 SlI1lmits.
This MMOA applies to the deployment of police officers who are not peace ·officers appointed to the RCMP under the Royal Canadian Mounted PolIce Act, R.S.C. 1985, c. R-10.

This MMOA Is entered Into by the Chief Constable, Chief of Police or Chief or Director as the case may be of the other Police Services under their respective provincial and mlllicipal police legislation.

3.0

BACKGROUND

3.1

Internationally Protected PersoM, Including Diplomatic Agents, the Government of Canada Is responsible for the protection of visiting heads of state or government, foreign ministers, representatives or officials of a state or any official or other agent of an Intemational organization of an Intergovernmental character, as well as members of the family who accompany him or her. It is the responsibility of the RCMP to provide these protective measures.

to subsection 10.1(1) of the Foreign MISSIons and Intematlonal OtrIanlzatJons Act, S.C. 1991, c. 41, to ensure for the proper functioning of the event.
Security measures will be put in place to ensure the proper protection of· the Internationally protected persons and other foreign dignitaries who will attend the Summits. An Integrated security unit has been created and Is comprised of the RCMP, OPP. the Canadian Forces, Toronto Police ServIce and Peel Regional Police and other policing. law enforcement and security agencies who win work collaboratively to ensure public and police safety.

The 2010 G8-G20 Summits are designated by Order-In-Council made pursuant

The G8 Summit will be held on June 25 and 26, 2010 In HuntsvUle, Ontario and the G~O Summit will be held on June 28 and 27, 2010 respectively in Toronto,
Ontario. The other Police Services and the RCMP have a mutual Interest In working together in relation to security and policing for the 2010 G8-G2O Summits. To this end. other Police Services are prepared to contribute personnel to the G8G20 ISU, by way of deployment. on a full cost recovery basis, in accordance with the arrangements described In this MMOA.

The RCMP will be responsible for providing the following G8-G2O ISU facUlties. equipment and services for deployed personnel from other Police Services. and will reimburse the Police Services for actual expenditures incurred where reasonably required for G8-G20 Summits secw1ly duties specifically assigned. to each member of the deployed personnel including:

deployed personnel salaries, benefits and entitlements; travel to and fi'om HuntsvDleJToronto. Ontario. with transportation paid by the RCMP oommenclng from the deployed personnel's closest transportation point (major airport. bus depot or train station identified by the G8-G2O ISU); meals and accommodation costs Will be covered fOr travel toIfrom the transportation point from the member's home location. In accordance with the Treasury Board of Canada Secretariat I National Joint Council Travel Directive and allowance rates In effect at the time of the

TERMS OF DEPLOYMENT

4.1

The other Police ServIces agree to deploy police officers to the 2010 G8-G2O ISU (the -deployed personnelj. In accordance with section 4.9 or as agreed to from time to time by the other Police Services. Deployed personnel will be subject to the authority RCMP OIC or delegate. and command

The RCMP will be responsible for all training rBquirad In relation to the deployed personnel's G8-G20 security duties. Each deployed personnel will have ctJf1Mt training and/or certification from their respective Police Services for all police duties and flI'lcUons required for his or her position at ~ time of deployment. Deployed personnel at all times remain employees of their respective Police pay. and benefits and other entitlements pursuant to the applicable collective bargaining agreements In place between them and their respective employers.

The parties agree that deployed persot1S may be deployed at different times during that period depending on the nature of the deployed person's activities and a timetable for such deployment will be agreed· to in advance by the parties. . PEACE OFFICER APPOINTMENT The other Police Services will provide the RCMP with the names and details of proposed deployed personnel for appointment as Supernumerary Special Constable and designation as a peace officer for the purpose of their participation In the G8-G20 ISU, In accordance with sections 7 (1) (e) and 7 (1) (d) of the Royal Canadian Mounted PolIce Act.

Polce officers appointed as Supemumerary Special Constables will have peace officer status, p~l'8uant to the Royal canadian Mounted Police Act, during their entire deployment to the G8-G20 Summits, from their departure from their home province, during the travel phase, and continuing until their retum to their home province.
The RCMP acknowledges that deployed police offlcers are subject to the public complaints system and Chiefs complaints (In particular, discreditable conduct) In their respective Police Services Act while outside their home jurisdiction. As such. the RCMP will ensure that Infonnation that may constitute a complaint of misconduct will be forwarded by the RCMP to the Chief of Police as soon as practfcable and· shall make the necessary changes to the .police· officer's

At the same time. deployed police officers may be subject to public complaints to the Commission for Public Complaints Against the RCMP WIder the Royal Canadian Mounted PolIce Act, section 45.35 (1) due to the deployed poles oflIcer's appointment as Supemumerary Special Constables.

RECALL AND REASSIGNMENT

If for any reason, either the other Police Services or the RCMP consider that any deployed persomel can no longer serve the purpose of the deployment, such deployed personnel will be re-assigned inmedlately to duties with the other Polce Services and replaced with altemate deployed personnel as soon as practicable. Salary will be calculated at the pay rata specified In the collective agreement In effect at the commencement of the deployment; (I) Pay raises or Increment Increases that become effective during the deployment wiD be reimbursed; (II) If a new collective agreement Is ratified after the deployment period and contain retroactive pay raises or Increment Increases, these will not be reimbursed;

payroll expenses Including but not limited to employment Insurance. Canadian pension plan, Quebec pension plan and provincial health tax will be reimbursed based on actual cost or in accordance with a benefit rate determined as a percentage of salary and overtime where appllc::able upon submission· of details in support of the percentage and approval by the RCMP;

Deployed personnel shall safeguard all equipment and assets placed In their custody during their deployment, and shall report immediately to their supervisor the loss of, or damage to equipment and assets. The other Police Service will be financially liable for 1he replacement cost of equipment and assets not returned and reported lost, or'otherwlse damaged due to negligence. Such flnancialliabilitles will be directly inwiced.or off-set against amounts charged to the RCMP for deployment salaries, benefits and other approved expenditures.

SECURITY AND CONFIDENnALITY The RCMP and the other Police Services agree that the infonnation in this MMOA Is confidential and is sensitive InfonnaUon relating to a Jaw enforcement activity. Subject to the Privacy Act. Frgedom of Information and Protection of PrIvacy Act and Municipal Freedom of Information and ProtectIon of PrIvacy Act, or as otherwise required by law, government AJgUlation, the direction of Cabinet or a minister's offk;e or Court order, the RCMP and the other PoBce Services acknowledge and agree that before any of the provisions of this MMOA are disclosed, other than on a -need to'knoW', all parties to thIs MMOA must agree In wriUng to such disclosure. The parties agree that for the purposes of section 13 (1) of the Access to Information Act, s8ctlon 19 (1) (a) of the PrIvacy Act and the equivalent sections in Information and privacy legislation In provinces and territories outside Ontario, an information disclosed and received between the RCMP and the other Police Services In support or furtherance of the agreements made In this MMOA are disclosed and received In confidence. USE OF RCMP VEHICLES Personnel deployed pursuant to this MMOA, will not operate federal (RCMP) owned or leased motor vehicles for G8-G20 Summit purposes. DISPUTES Where necessary. new issues arising, matters of general concem, or disputes arising in relation to deployed personnel, will be referred to and resolved by a jOint management committee made up of the RCMP Commanding OffIcer, "0. Division, and the Chief Constable, Chief of Police, or Chief as the case may be of the affected other Police Service, or their delegate.
