Plaintiffs All American Semiconductor, Inc., Jaco Electronics, Inc., and DRAM Claims Liquidation Trust (collectively, Plaintiffs) and Defendants Micron Technology, Inc., Micron Semiconductor Products, Inc., Nanya Technology Corp., and Nanya Technology Corp. USA (collectively Defendants) hereby submit this Joint Case Management Statement in advance of the Courts October 21, 2010 Case Management Conference. Pursuant to the Courts September 21, 2010 Order Setting Case Management Conference, counsel for Plaintiffs and Defendants met and conferred on October 14, 2010. The parties submit the following report to the Court: I. CURRENTLY ACTIVE CASES: Three opt-out DRAM cases remain active on the Courts docket. The cases and remaining defendants are: 1. All-American Semiconductor, Inc. v. Hynix Semiconductor, et. al. Case No. 07CV-1200. The remaining defendants in this case are Defendants Micron Technology, Inc. and Micron Semiconductor Products, Inc. (collectively Micron); and Nanya Technology Corp. and Nanya Technology Corp. USA, (collectively Nanya). 2. JACO Electronics, Inc. v. Hynix Semiconductor Inc., et al. Case No. 07-CV-1212. The remaining defendant in this case is Micron. 3. DRAM Claims Liquidation Trust v. Hynix Semiconductor, Inc., et al. Case No. 07-CV-1381. The remaining defendant in this case is Micron. 2

II. SETTLEMENT PROCEEDINGS: At the Courts direction, the Plaintiffs and Micron participated in a mediation session with Judge Layn R. Phillips on June 2, 2010 and thereafter continued discussions with Judge Phillips telephonically. The mediation efforts have not yet been successful. III. PARTIES PROPOSALS FOR MOVING FORWARD: Plaintiffs Position As a result of the mediation, it has become clear that the central impediment to resolution of the cases is the Courts determination whether the Antitrust Criminal Penalty Enhancement and Reform Act (ACPERA) covers the amnesty agreement Micron entered into with the Antitrust Division of the Department of Justice so as to limit Microns joint and several and treble damages exposure to Plaintiffs. The Plaintiffs believe that resolution of the ACPERA issue is ripe for the Courts consideration and a necessary step towards final disposition of the cases. The application of ACPERA to pre-enactment amnesty agreements is a legal issue that can be addressed by the Court at this time. Since Plaintiffs have minimal direct purchases from Micron, the ACPERA issue is, as a practical matter, determinative of Plaintiffs joint and several and treble damages claims. The Plaintiffs submit that it is in the best interest of the Court and the parties to resolve the ACPERA issue before considering how to proceed with any other motions or additional expert discovery. The parties have agreed on a protocol for resolution of the ACPERA issue by the Court. The protocol suggests a motion and brief to be filed by Micron 60 days following an order approving the protocol, response briefs within 60 days and a reply brief. The parties agreed that neither side will request an evidentiary hearing. The Plaintiffs respectfully request that the Court set a schedule for briefing and oral argument on the ACPERA issue at the Case Management Conference. The parties agreed briefing schedule provides ample time to determine whether this matter can be resolved with the assistance of Judge Phillips.

Microns Position The parties are continuing their efforts to settle these cases with the assistance of Judge Phillips, and there has been significant progress. Micron believes the parties are close to an agreement that will result in a resolution of plaintiffs claims. Should the settlement efforts fail, the parties have previously agreed on a protocol for resolution of the ACPERA issue by the Court, if necessary. That protocol provides, among other things, for a possible motion and briefing schedule. The parties will know within a few weeks whether that will be necessary. In light of the foregoing, Micron is prepared to update the Court on the status of these matters at the scheduled Case Management Conference.
