REPORT OF THE COMMITTEE ON REVIEW OF MUNICIPAL ORDINANCES AND RELATED ISSUANCES REPORT NO. 2011-01

The meeting of the Committee on Review of Municipal Ordinances and Related Issuances convened on January 10, 2011 at 11:00 in the morning, 2/F Capitol Building, Capitol Complex, Tagbilaran City, to treat on matters referred to the Committee for review and recommendation. Present were: Hon. Dionisio D. Balite, Chairman; Hon. Ramonito A. Torrefranca, Vice Chairman; Hon. Josephine Socorro C. Jumamoy, Member and the Committee Secretariat. There being a quorum, the Committee proceeded in taking up items referred to it for action and after thorough review on each item, it arrived at the following: Item 1-18 are all Appropriation Ordinance Item 19-22 are all Municipal Ordinance RECOMMENDATION: For the passage of the corresponding resolutions declaring the above measures as valid and operative, having shown apparent and substantial compliance to the provisions of R.A. 7160, other pertinent laws, rules and regulations subject however to the conditions stipulated by the Provincial Budget Office. Item 23-48 are all Municipal Ordinance Item 49&50 are City Ordinance RECOMMENDATION: For the passage of the corresponding resolutions declaring the above measures as valid pursuant to the provisions of R.A. 7160, other pertinent laws, rules and regulations per recommendation of the Provincial Legal Office. However, proof of publication must be shown to those ordinances that provide for penalties before the enforcement of the said ordinances in compliance to Sec. 59 (c) of R.A. 7160. Item 51. Municipal Ordinance No. 12-176 of President Carlos P. Garcia, Bohol Approving the Municipal Development Council Resolution No. 05-2010, of this Municipality; RECOMMENDATION: To return the said measure to the LGU concerned with the information that the realignment of projects requires passage of corresponding supplemental budget to comply with Section 321 of R.A. 7160 per recommendation of the Provincial Budget Office.

Item 52. Municipal Ordinance No. C-003, series of 2009 of Getafe, Bohol An ordinance enacting the Revenue Code of 2009 of the Municipality of Getafe, Bohol; RECOMMENDATION: To return the said measure to the LGU concerned with the information that the said ordinance is partly invalid as it contravenes Sec. 447, (1), (iii) of the Local Government Code per recommendation of the Provincial Budget Office. Item 53. Municipal Resolution No. 105, series of 2010 of Batuan, Bohol A resolution requesting the Sangguniang Panlalawigan Review Committee to reconsider SP Resolution No. 2010-71, S-2010 pertaining to Collective Negotiation Agreement (CNA) benefits which was given to both the management and rank and file of LGU-Batuan CY 2009 which was disallowed in you office RECOMMENDATION: To return the said measure to the LGU concerned with the information that Per LBC No. 61 of DBM, the grant of CNA benefits is limited to rank and file employees. This is further reiterated in DBM Budget Circular No. 19-00 dated December 15, 2000. Joint Resolution No. 4, series of 2009 of the Congress and Senate, Section 11-(aa) which is the basis for the Sangguniang Bayan of Batuan, Bohol for their request for reconsideration only authorizes the President of the Philippines to grant Collective Negotiation Agreement (CNA) incentive to management and rank and file employees of agencies with approved and successfully implemented CNAs in recognition of their efforts in accomplishing performance targets at lesser cost, in attaining more efficient and viable operations through cost-cutting measures and systems improvements. This being so, unless and until, there is an Executive Order issued by the President providing for its implementation, LBC No. 61 of DBM and DBM Budget Circular No. 19-00 still stands per recommendation of the Provincial Legal Office. There being no other matters taken up, the Chair adjourned the meeting at 12:00 noon.
