In favour or against the same rights for homosexuals and heterosexuals ?

I agree with the fact that homosexuals must be respected as any other human beings but what was considered until 1993 as a illness by the WHO (World Health Organisation), should not be considered as the standard and should not be encouraged. Of course, I do not deny anybody the right to enter into a contract with a person of the same sex in order to enjoy a certain stability and maybe financial benefits (in fiscal and inheritance matters) but I deny homosexuals the possibility of getting the same rights in marriage and adoption matters. Why ?

First, Ill expose some juridical arguments. In the first article of the Declaration of Human Rights, of 1789, one can read: All men are born free and equal in rights . But it is made clear in the next sentence, that the social distinctions can only be based on common utility. The couple man-woman permitting the perpetuation of the Nation, it seems legitimate to grant him a special status. The homosexuals want equality before the law, claiming their right to get married. But the marriage is not a law, its an institution, which is considered by the State as being useful at their stability and continuity. Furthermore, the equality of rights is valid for persons of a same category, but homosexuals are different from heterosexuals, so their request is unjustified. Whats more, the French Civil Code defines the marriage as a union between a man and a woman and, on the 26. February 2002, the European Court of Human Rights has recognized Frances right to refuse the adoption of children to homosexuals.

Now, lets come to the problems which could emerge from the permission given to the homosexuals to adopt children. - In the best case, one member of the couple is the biological parent of the child. What can we think about the legitimacy (in education) of the other parent , who is only the companion of the first one? What can we think about the sense of responsibility towards a child who is not ours ? The link, that usually exists, between a child and his biological parents may not exist or may not be so strong, because the child is not a part of yourself. - In the case of a real adoption, when no member of the couple is a biological parent of the child, the partners would be equal on the emotional level towards a child who isnt theirs, and whom they give a home.

But how will this child develop his social skills with two fathers or two mothers ?

I know that several studies about the subject have showed that having homosexual or heterosexual parents doesnt make a difference. But I would like to point out some irregularities in those studies: first, the children dont talk about themselves, only the parents are answering the questions. secondly, the parents interviewed belong to homosexual associations and are in favour of the homosexual marriage and adoption of children by homosexual couples. Thirdly, the tested families are always compared with single-parent families or heterosexual families with problems, never with normal families. Fourthly, the cross-section of families is rather low (only some tens of persons in reality). We mustnt disregard the child as a person. A child, like any person, has rights, he isnt an object of rights. He isnt a good that you choose to buy or not. At the time of the gender parity, it seems astonishing to ask the law to recognize that the family, basic unit of the society, place where someone learns to live with others, could be based on the negation of the other sex. Consequently, we can ask ourselves the following question : How could a child brought up by two men learn to know and accept the woman and vice versa in case of a lesbian couple? Sure, he will learn to know the representatives of the other sex through our mixed society, but the real, deep, daily relationship will be missing. We would deprive him of a part of his emotional development, what would conduct to confused, anxious adults, who wouldnt understand persons of the opposite sex or even of his own sex (it depends on the different possibilities). Some tensions could even appear between a girl and her two fathers or a boy and his two mothers , because of the natural differences between boys and girls. Furthermore, a child with homosexual parents is often victim of reject and mocking by other children. Finally, and above all, on the sexual level, a child living in heterosexual family, learns to know and to respect some constraints, like the prohibition of sexual relations between parents and children or between brothers and sisters. What would happen to these prohibitions in an homosexual family? With all the arguments previously exposed, we can easily conclude that we cant give all the same rights to the homosexuals than to the heterosexuals. This is a case in which we should resist to the evolution of the mentalities, because the future of humanity is at stake.
