ORDINANCE NO. 2010-001 AN ORDINANCE CREATING A CITY ENVIRONMENTAL COUNCIL TO FORMULATE AND RECOMMEND ENVIRONMENT POLICIES AND REGULATIONS AND TO PROSECUTE ENVIRONMENTAL CRIMES Be it ordained by the Sangguniang Panlungsod of the City of Davao, that: ARTICLE I. Policy of the City on Environment Protection and Preservation SECTION 1. - It shall be the policy of the City Government to enact resolutions and ordinances to cater to the unique socio-economic climate and geographical location of the city. SECTION 2. - The City shall also promote the maximization of the potentials of the natural and environment resources of the city, and ensuring a balance between progress and environment protection. ARTICLE II. Functions and Responsibilities of the City Environmental Council SECTION 1. The City Environmental Council shall formulate and recommend environment policies and regulations to protect and preserve the natural resources as well as maintain or create a healthy environment for the people of Davao City. SECTION 2. These environment policies and regulations shall be enacted taking into consideration already passed ordinances and resolutions, and other pertinent national laws in conformity with the goal of ensuring the maximization of environment potentials of the city and its protection or preservation. SECTION 3. The City Environment Council shall prosecute environmental crimes coordinating with the proper government agencies for its implementation and efficacy. SECTION 4. The City Environment Council shall investigate environmental violations and other probable abuses for prosecution or pursue any other constructive action to correct such. SECTION 5. The City Environment Council shall coordinate with non-governmental organizations, civic groups, environment groups, and other entities concerned to consolidate action towards environmental awareness and formulation of rules and regulations for environment protection and encourage deliberations and dialogue. SECTION 6. The City Environment Council shall conduct seminars, forums, or other like endeavors in the different barangays of the city to increase environmental awareness of the populace.

SECTION 7. The City Environment Council shall submit to the City Mayor a performance report of the accomplishments and progress of their mandated tasks under this Ordinance. SECTION 8. The City Environment Council has the power to promulgate its own rules and regulations in the conduct of its functions and responsibilities. ARTICLE III. Composition of the City Environmental Council SECTION 1. The City Environmental Council shall be composed of nine (9) members. The chairman of the Committee on Natural Resources and Environment of the city council shall be the ex-officio chairman. SECTION 2. - The other members shall be from: two (2) from the environment groups, one (1) from youth based organizations, one (1) from civic groups, one (1) representative from the Department of Health, one (1) representative from the Department of Education, one (1) representative from the Department of Natural Resources, and one (1) representative from the Association of Barangay Chairmen. ARTICLE IV. Final Provisions SECTION 1. - FUNDING. The funding for the implementation of this ordinance shall come from the appropriation of both the City Tourism Office and City Information Office. SECTION 2. - SEPARABILITY. If for any reason, any provision , section, or part of this ordinance is declared not valid by a Court of competent jurisdiction, suspended, or revoked by the Sangguniang Panlungsod, such judgment shall not affect or impair the remaining provisions, sections, or parts thereof, which shall remain or continue to be in full force and effect. SECTION 3. - EFFECTIVITY. This Ordinance shall take effect upon approval. ENACTED: April 19, 2010 APPROVED UNANIMOUSLY. WE HEREBY CERTIFY to the correctness of the foregoing ordinance.
