Dear Mr. Stevens, This is an interim response to your March 7, 2011 request for information pursuant to the Freedom oflnformation Act (FOIA), 5 U.S.C. 552 . You requested that a copy of the following documents or documents containing the following information be provided to you: Any and all correspondence between Representative Harold Rogers (R-KY), or any member of his staff, or any staff member of the United States House of Representatives Committee on Appropriations ("Appropriations Committee") acting on behalf of Rep. Rogers, and any employee of the Department of Education from January 1, 2000, through the present. CREW further seeks any and all responses by any employee of the Department of Education to Representative Rogers, or any member of his staff, or any staff member of the Appropriations Committee acting on the behalf of Rep. Rogers, during the same time period. Please search for responsive records regardless of format, medium, or physical characteristics. Where possible, please produce records electronically, in PDF or TIF format on a CD-ROM. We seek records of any kind, including electronic records, audiotape, videotapes, and photographs. Our request includes any letters, emails, facsimiles , telephone messages, voice mail message and transcripts, notes, or minutes of any meeting, telephone conversations, or discussions. Our request also includes any attachments to these records. Your request was forwarded to the appropriate offices within the Department to search for documents that may be responsive to your request. The staff in the Office of Legislation & Congressional Affairs (OLCA) provided the FOIA Service Center the following responsive documents: OLCA- Rogers - 23 pages

Enclosed is a CD containing 23 pages of documents responsive to your request. However, certain information has been withheld according to the FOIA exemptions specified below: Records or portions of records relating to personal information is exempt pursuant to 5 U.S.C. 552 (b)(6) of the FOIA and Departmental regulation 34 CFR 5.71(a). Disclosure of this information would constitute a clearly unwarranted invasion of personal privacy.

At this time, the Department is continuing to process your request and your FOIA request case file remains open. It will not close until the Department provides you with a response regarding outstanding responsive documents. Our final release letter will contain information related to your appeal rights of agency decisions.
