(ITC) claim brought by Eastman Kodak Company against Apple and Research In Motion (RIM). It is my hope the final results of this c1aim will be consistent with sound trade policy and the protection of intellectual property. After reviewing the information presented to me, it is my understanding that the Administrative Law Judge (ALJ) in Kodak's ITC case against Apple and RIM issued a preliminary decision that contradicts a decision made less than ,a year ago by another ALJ concerning the exact same Kodak patent. Moreover, the recent ALJ's interpretationJs contrary to a finding by the U.S. Patent and Trademark Office (USPTO). As a memberofThe Subcommittee on Intellectual Property, Competition, and the Internet of the House Judiciary Committee, I have a keen interest in strong intellectual property enforcement and fundamenta.l principles of market fairness. , I note thatthe vast majority of the digital camera market, including direct competitors to those involved in this case, has patentat issue. Currently, there is inconsistency between two competing ALJ decisions regarding the validity of Kodak's patentcl@ims.
