LES COWERNEMENTS SOUSSIGNES CONSIDERANT qu est souhaitable d il amender la Convention pour l unification de certaines rhgles relatives au transport Jrien international signbe b Varsovie le 12 octobre 1929, SONT CONVENUS de ce qui suit:

CHAPITRE PREMIER AMENDEMENTS A LA CONVENTION

Artide premier La Convention que les dispositions du present chap&e modifient est la Convention de Varsovie de 1929.

tel que d6fmi par le Fonds mon&aire internationaL La conversion de ces sommes en monnaies nationales s effectuera en cas d instance judiciaire suivant la valeur de ces monnaies en Droit de Tirage s-p&al A la date du jugement. La valeur, en Droit de Tirage sp&al, d une monnaie nationale d une Haute Partie Contractante qui est membre du Fonds monbtaire international, est calcul6e selon la m6thode d &aluation appliqube par le Fonds mon&aire international g la date du jugement pour ses propres op6rations et transactions. La valeur, en Dro.% de Tirage sp&al, d une monnaie nationale d une Haute Partie Contractante qui n pas membre du Fonds mon&aire international, est est calcul6e de la fagon dbterminbe par cette Haute Partie Contractante. Toutefois, les Etats qui ne sent pas membres du Fonds mon&aire international et dont la 16gislation ne permet pas d appliquer les dispositions des alin6as 1, 2 et 3 de l article 22, peuvent au moment de la ratification ou de l adhision, ou B tout moment par la suite, d&Aarer que la limite de responsabilitb du transporteur est G&e, dans les procCdures judiciaires sur leur territoie, A la sommede 125.000 unit&s monCtairespar passager ce qui concernel en alin6a 1 de l article 22; 250 unit& mondtaires par kilogramme en ce qui concerne l alin6a 2 de Particle 22; 5.000 unit& mon6taires par passageren ce qui conceme l alin6a 3 de l article 22. Cette unit& mon&tie correspond A soixantecinq milligrammes et demi d au titre de neuf cents milli&mes de fin. or Ces sommes peuvent &tre converties dam la monnaie nationale concem6e en chiffres ronds. La conversionde cette somme en monnaie nationale s effectuera conformtment A la lbgislation de l Etat en cause.

Article II L article 22 de la Convention est supprhn6 et remplad par les dispositions suivantes: Article 22 1. Dam le transport de personnes,la responsabilitk du transporteur envers chaque voyageur est limithe & la somme de 8.300 Droits de Tirage sp6ciaux. Dam le cas oil, d aprks la loi du fribunal saisi, l indemnit6 peut Bre fx6e sous forme de rente, le capital de la rente ne peut ddpassercette limite. Toutefois, par une convention sp6cialeavec le transporteur, le voyageur pourra fvter une limite de responsabilit6 plus BlevBe. 2. Dam le transport de bagagesenregistrds et de marchandises,la responsabilit6 du transporteur est limitee & la somme de 17 Droits de Tirage sp6ciaux par kilogramme, sauf d6claration sp6cialed int6r8t B la livraison faite par l exp6diteur au moment de la rem& du cc&s au transporteur et moyefmant le paiement d une taxe wppl6mentatie bventuelle. Dans ce cas, le transporteur sera tenu de payer jusqu g concurrence de la somme d6clar&e,B moins qu ne prouve qu est il elle sup&ieure & l int&Zt reel de l expbditeur A la livraison. 3. En ce qui conceme les objets dont le voyageur conservela garde, la responsabilitb du transporteur est limit&e 1 332 Droits de Tiage sp6ciauxpar voyageur. 4. Article JX cHAPrrREIII DISPOSITXONS PROTOCOLAIRES 1. Toute Partie au present Protocole pourra le denoncer par une notification fake au Gouvemement de la Republique populaire de Pologne. 2. La denonciation produira seseffets six mois apres la date de r&ption par le Gouvemement de la Republique populaire de Pologne de la notification de dt5nonciation. 3. Entre les Parties au p&sent Protocole, la ddnonciation de la Convention par Tune d elles en vertu de Particle 39 ne doit pas etre interpr&ee comme une denonciation de la Convention amendee par le present Protocole.

Article N Entre les Parties au present Protocole, la Convention et le Protocole wont consider& et interptites comme un seul et meme instrument et wont denommes Convention de Varsovie amen&e pat le Pmtocole additinnel no 1 de Montrbal de 19 75.

Article V Jusqu sa date den&e en vigueur conformement aux dispositions de a Particle VII, le present Protocole restera ouvert a la signature de tous les Etats. Article VI 1. Le present Protocole kra soumis B la ratification des Etats signataires. 2. La ratification du present Protocole par un Etat qui n pas pat-tie est a la Convention emporte adhesion B la Convention amendke par le p&sent Protocole. 3. Les instruments de.ratification wont dtpods auprbs du Gouvemement de la Republique populaire de Pologne.

Article VII 1. Lorsque le present Protocole aura r&ml les ratifications de trente Etats signataires, il entrera en vigueur entre ces Etats le quatre-vingtdixibme jour apres le depot du trentieme instrument de ratification. A l &ard de chaque Etat qui le ratifiera par la suite, il entrera en vigueur le quatre-vingtdixieme jour apres le d&-&t de son instrument de ratification. 2. Des son entree en vigueur, le present Protocole sera enregistre auprb de I Organisation des Nations Unies par le Gouvernement de la RCpublique populaire de Pologne.

Artide XIII Artick VIII 1. Apres son entree en vigueur, le present Protocole sera ouvert a Padhesionde tout Etat non signataire. 2. L adhesion au present Protocole par un Etat qui n pas partie a est la Convention emporte adhesion a la Convention amendde par le p&rent Protocole. F-2

to Amend the Convention for the Unification of Certain Rules Relating to International Carriage by Air Signed at Warsaw on 12 October 1929

THE GOVERNMENTS UNDERSIGNED CONSIDERING that it is desirable to amend the Convention for the Unification of Certain Rules Relating to International Carriage by Air signed at Warsaw on 12 October 1929 HAVE AGREED as follows:

CHAPTER I AMENDMENTS TO THE CONVENTION

Article I The Convention which the provisions of the present Chapter modify is the Warsaw Convention, 1929.

Article II Article 22 of the Convention shall be deleted and replaced by the following:-

by the International Monetary Fund. Conversion of the sums into national currencies shall, in case of judicial proceedings, be made according to the value of such currencies in terms of the Special Drawing Right at the date of the judgment. The value of a national currency, in terms of the Special Drawing Right, of a High Contracting Party which is a Member of the International Monetary Fund, shall be calculated in accordance with the method of valuation applied by the International Monetary Fund, in effect at the date of the judgment, for its operations and transactions. The value of a national currency, in terms of the Special Drawing Right, of a High Contracting Party which is not a Member of the International Monetary Fund, shall be calculated in a manner determined by that High Contracting Party. Nevertheless, those States which are not Members of the International Monetary Fund and whose law does not permit the application of the provisions of paragraphs 1, 2 and 3 of Article 22 may, at the time of ratification or accessionor at any time thereafter, declare that the limit of liability of the carrier in judicial proceedings in their territories is fxed at a sum of 125 000 monetary units per passenger with respect to paragraph 1 of Article 22; 250 monetary units per kilogramme with respect to paragraph 2 of Article 22; and 5 000 monetary units per passenger with respect to paragraph 3 of Article 22. This monetary unit corresponds to sixty-five and a half milligrammes of gold of millesimal fineness nine hundred. These sums may be converted into the national currency concerned in round figures. The conversion of these sums into national currency shall be made according to the law of the State concerned.

Article 22 1. In the carriage of passengersthe liability of the carrier for each passengeris limited to the sum of 8 300 Special Drawing Rights. Where, in accordance with the law of the court seisedof the case,damagesmay be awarded in the form of periodic payments, the equivalent capital value of the said payments shall not exceed this limit. Nevertheless,by special contract, the carrier and the passengermay agree to a higher limit of liability. 2. In the carriage of registered baggageand of cargo, the liability of the carrier is limited to a sum of 17 Special Drawing Rights per kilogramme, unless the consignor has made, at the time when the package was handed over to the carrier, a special declaration of interest in delivery at destination and has paid a supplementary sum if the case so requires. In that case the carrier will be liable to pay a sum not exceeding tbe declared sum, unless he proves that that sum is greater than the consignor actual interest in delivery at destination. s 3. As regards objects of which the passengertakes charge himself the liability of the carrier is limited to 332 Special Drawing Rights per passenger. 4. The sums mentioned in terms of the Special Drawing Right in this Article shall be deemed to refer to the Special Drawing Right as defined

SCOPE OF APPLICATION OF THE CONVENTION AS AMENDED

Article III

The Warsaw Convention as amended by this Protocol shall apply to international carriage as defmed in Article 1 of the Convention, provided that the place of departure and destination referred to in that Article are situated either in the territories of two Parties to this El

Protocol, or within the territory of a single Party to this Protocol with an agreedstopping place in the territory of another State.

Artide IX 1. Any Party to this Protocol may denounce the Protocol by notification addressed to the Government of the Polish People s Republic.

CHAPTER III FINAL CLAUSES

2. Denunciation shall take effect six months after the receipt by the Government of the Polish People Republic of the notification of s denunciation. 3. As between the Parties to this Protocol, denunciation by any of them of the Convention in accordancewith Article 39 thereof shall not be construed in any way as a denunciation of the Convention as amended by this Protocol.

Article N As between the Parties to this Protocol, the Convention and the Protocol shall be read and interpreted together as one single instrument and shall be known as the Warsaw Convention as amended by Additional FYotoeol No. 1 of Montreal, 1975.

Article X Article V Until the date on which this Protocol comes into force in accordance with the provisions of Article VII, it shall remain open for signature by any State. Article XI Article VI 1. This Protocol shall be subject to ratification by the signatory States. 2. Ratification of this Protocol by any State which is not a Party to the Warsaw Convention shall have the effect of accession to the Convention as amended by this Protocol. 3. The instruments of ratification shall be deposited with the Government of the Polish People Republic. s The Government of the Polish People Republic shall promptly inform s all States Parties to the Warsaw Convention or of that Convention as amended, all signatory or acceding States to the present Protocol, as well as the International Civil Aviation Organization, of the date of each signature, the date of deposit of each instrument of ratification or accession, the date of coming into force of this Protocol, and other relevant information. No reservation may be made to this ProtocoL

Article XII As between the Parties to this Protocol which are also Parties to the Convention, Supplementary to the Warsaw Convention, for the Unification of Certain Rules Relating to International Carriage by Air Performed by a Person Other than the Contracting Carrier, signed at Guadalajara on 18September 1961 (hereinafter referred to as the Guadalajara Convention) any reference to the Warsaw Convention contained in the Guadalajara Convention shall include reference to the Warsaw Convention as amended by Additional Protocol No. 1 of MontreaZ, 1975, in cases where the carriage under the agreement referred to in Article 1, paragraph b) of the Guadalajara Convention is governed by this Protocol.

Article VII 1. As soon as thirty signatory States have deposited their ins&uments of ratification of this Protocol, it shall come into force between them on the ninetieth day after the deposit of the thirtieth instrument of ratification. It shall come into force for each State ratifying thereafter on the ninetieth day after the deposit of its instrument of ratification. 2. As soon as this Protocol comes into force it shall be registered with the United Nations by the Government of the Polish People Republic. s

Article VIII Article XIII 1. This Protocol, after it has cOme into force, shall be open for accessionby any non-signatory State. 2. Accession to this Protocol by any State which is not a Party to the Convention shall have the effect of accession to the Convention as amended by this Protocol. 3. Accession shall be effected by the deposit of an instrument of accession with the Government of the Polish People Republic and s shall take effect on the ninetieth day after the deposit.

This Protocol shall remain open for signature until 1 January 1976 at the Headquarters of the International Civil Aviation Organization and thereafter until it comes into force in.accordance with Article VII at the Ministry for Foreign Affairs of the Polish People Republic. The s International Civil Aviation Organization shall promptly inform the Government of the Polish People Republic of any signature and the s date thereof during the time that the Protocol shall be open for signature at the Headquarters of the International Civil Aviation Organization. DONE at Montreal on the twenty-fifth day of the month of September of the year One Thousand Nine Hundred and Seventy-fiie in four authentic texts in the English, French, Russian and Spanish languages. In the case of any inconsistency, the text in the French language, in which language the Warsaw Convention of 12 October 1929 was drawn up, shall prevail.

CONSIDEBANDO que es deseablemodiflcar el Convenio para la unifiicl6n de ciertas reglas relatlvas al transporte a&o intemacional, fvmado en Varsovis el 12 de octubre de 1929, HAN CONVENIDO lo siguiente:

MODIFICACIONES AL CONVENIO Articulo I El Convenlo que las disposicionesde1 presenteCapftulo modifican es el Convenio de Varsovia de 1929.

Articldo II
Se suprime el articulo 22 de1Convenio y se.sustituye por el siguiente:

Giro deftido por el Fondo Monet&o Intemacional. La conversibnde la suma en las monedas nacionales,en el case de actuacionesjudiciales, se har6 de acuerdo con el valor de dlchas monedas en Derechos Especiales de Glro en la fecha de la sentencla. El valor, en Derechos Especiales de Giro, de la moneda national de una Alta Parte Contratante que sea miembro de1 Fondo Monetario lntemacional, se calculara de confom-ddadcon el metodo de valoraci6n aplicado por el Fondo Monetario International para sus operacionesy transacciones que este en vigor en la fecha de la sentencia. El valor, en Derechos Especiales de Giro, de la moneda national de una Alta Parte Contratante que no seamiembro de1Fondo Monetario International, se calcular~de la maneradetermlnada por dicha Alta Parte Contratante. Sin embargo, los Estados que no scan miembros de1 Fondo Monetario lnternacional y cuya leglslactin no permlta aplicar las dlsposicionesde los ptios 1, 2 y 3 de1 articulo 22, pod& declarsr, en el moment0 de la ratiflcaci6n o de la adhesibno posteriormente, que el limlte de responsabilldad de1 transportista, en 10s procedlmlentos judiciales seguidos en su territorio, se tija en la suma de 125.000 unidades monetarias por pasajero,con respect0 al p6rrafo 1 de1articulo 22; 250 unidades monetarlas por kilogramo, con respect0 al par&o 2 de1 articulo 22, y 5.000 unidadesmonetarias por pasajero,con respect0 al p&rrafo 3 de1articulo 22. Esta unidad monetaria consiste en sesentay cinco miligramos y medio de oro con ley de novecientas mil6simas. Dicha suma podra convertirseen la moneda national en cifras redondas. La conversion de esta suma en moneda national se efectuara de acuerdo con la ley de1Estado interesado.

Articulo 22
1. En el transporte de personas, la responsabilidadde1 transportista con respect0 a cada pasajero se limitad a la suma de 8.300 Derechos Especialesde C&o. En el case de que, con arreglo a la ley de1Tribunal que conozca de1 asunto, la indemnizacion pueda ser fijada en forma de renta, el capital de la renta no podd sobrepasar este limite. Sin embargo, por convenio especial con el transportista, el pasajeropodra fijar un lfmite de responsabilidadm&selevado. 2. En el transporte de equipaje facturado y de mercancias, la responsabihdadde1 transportista se limitarl a la suma de 17 Derechos Especialesde Giro por kilogramo, salvo declaracibn especial de valor hecha por el expedidor en el moment0 de la entrega de1 bulto al transport&a y mediante el psgo de una tasa suplementarla,si hay lugar a ello. En este case, el transportista estar~ obligado a pagar hasta el importe de la suma declarada, a menos que pruebe que Bstees superior al valor real en el moment0 de la entrega. 3. En lo que concieme a 10s objetos cuya custodia conserve el pasajero, la responsabilidadde1 transportista se limitari a 332 Derechos Especialesde Giro por pasajero. 4. Las sumas expresadasen DerechosEspecialesde Glro mencionadas en este articulo se conslderar~que se refieren al Derecho Especial de

ArthloIv Para his Partes en este Protocolo, el Convenio y el Protocol0 se conslderarrln e interpretaran coma un solo instrumento que se designara con el nombre de Convenio de Varsovia modificado por el Pro tocolo Adicional Ntim 1 de Montreal de I9 75.

Alticulo v Hasta la fecha en que entre en vigor, de acuerdo con lo previsto en el articulo VII, el presente Protocolo permaneced abierto a la finna de todos 10sEstados.

El presenteProtocolo no podrl ser objet0 de reservas.

Articldo XI Articldo VI 1. El presente Protocol0 se someted a la ratificaci6n de 10sEstados signatarios. 2. La ratiflcaci6n de1 presente Protocolo por todo Estado que no sea Parte en el Convenio tendra el efecto de una adhesi6n al Convenio mod&ado por el presente Protocolo. 3. Los instmmentos de ratificaci6n de1 presente Protocolo ser&n depositados ante el Gobiemo de la Republica Popular Polaca. El Gobiemo de la Republica Popular Polaca comunlcar& a la mayor brevedad, a todos 10s Estados Partes en el Convenio de Varsovia y a todos 10s Estados signatsrios o adherentes al presente Protocolo, asi coma a la Organizacibn de Avlaci6n Civil Intemacional, la fecha de cada una de las fumes, la fecha de1 dep6slto de cada instrumentos de ratiiicaci6n o adhesi6n, la fecha de entrada en vigor de1 presente Protocolo y demls informaci6n pertinente.

Artkulo XII Para las Partes en el presente Protocol0 que Seantambien Partes en el Convenio Complementario de1Convenio de Varsovla para la unificacI6n de ciertas reglasrelatlvas al transporte dreo international efectuado por una persona que no sea el transportista contractual, fmado en Guadalajara el 18 de septiembre de 1961 (en adelante denominado Convenio de Guadalajara), toda menci6n de1Convenio de Varsovla contenida en el Convenio de Guadalajara, se aplicara tambikn al Convenio de Varsovia modgicado por el Protocolo Adicional Nhn I de Montreal de 1975, en 10s cases en que el transporte efectuado segunel contrato mencionado en el pdrrafo b) de1 articulo 1 de1 Convenio de Guadalajara se rija por el presente Protocolo.

Articldo VII 1. Tan pronto coma trelnta Estados slgnatarios hayan depositado sus instrumentos de ratlficaci6n de1 presente Protocolo, dste entrarl en vigor entre ellos el nonagesimo dia a contar de1 dep6sito de1 trigesimo lnstrumento de ratificaci6n. Para cada uno de 10sEstados que ratifique despues de esa fecha, entrsra en vigor el nonagesimo dfa a contar de1 dep6sito de su instrument0 de ratiticacibn. 2. Tan pronto coma entre en vigor, el presente Protocolo serd registrado en las Naciones Unidas par el Gobiemo de la Republica Popular Polaca.

Articdo XIII El presente ProtocoIo quedard abierto a la firma de todos 10sEstados en la sede de la Organizacibn de Aviacibn Civil International hasta el lo de enero de 1976 y posteriormente, hasta su entrada en vigor de acuerdo con el articulo VII, en el Ministerio de Asuntos Extranjeros de la Republica Popular Polaca. La Organizacikr de Aviaci6n Civil International informara a la mayor brevedad al Gobierno de la Republica Popular Polaca de cualquier firma que reciba y de su fecha en el period0 en que el Protocolo se encuentre abierto a la firma en Montreal.

Articulo VIII 1. Desputs de su entrada en vigor, el presente Protocolo quedarg abierto a la adhesi6n de todo Estado no signatario. 2. La adhesi6n al presente Protocol0 por un Estado que no seaParte en el Convenio lmpllcar~ la adhesi6n al Convenio modiflcado por el presenteProtocolo.
