Visa Bulletin For June 2011


Number 33 Volume IX A. STATUTORY NUMBERS
1. This bulletin summarizes the availability of immigrant numbers during June. Consular officers are required to report to the Department of State documentarily qualified applicants for numerically limited visas; U.S. Citizenship and Immigration Services in the Department of Homeland Security reports applicants for adjustment of status. Allocations were made, to the extent possible, in chronological order of reported priority dates, for demand received by May 11th. If not all demand could be satisfied, the category or foreign state in which demand was excessive was deemed oversubscribed. The cut-off date for an oversubscribed category is the priority date of the first applicant who could not be reached within the numerical limits. Only applicants who have a priority date earlier than the cut-off date may be allotted a number. If it becomes necessary during the monthly allocation process to retrogress a cut-off date, supplemental requests for numbers will be honored only if the priority date falls within the new cut-off date announced in this bulletin. 2. Section 201 of the Immigration and Nationality Act (INA) sets an annual minimum family-sponsored preference limit of 226,000. The worldwide level for annual employment-based preference immigrants is at least 140,000. Section 202 prescribes that the percountry limit for preference immigrants is set at 7% of the total annual family-sponsored and employmentbased preference limits, i.e., 25,620. The dependent area limit is set at 2%, or 7,320. 3. INA Section 203(e) provides that family-sponsored and employment-based preference visas be issued to

eligible immigrants in the order in which a petition in behalf of each has been filed. Section 203(d) provides that spouses and children of preference immigrants are entitled to the same status, and the same order of consideration, if accompanying or following to join the principal. The visa prorating provisions of Section 202(e) apply to allocations for a foreign state or dependent area when visa demand exceeds the percountry limit. These provisions apply at present to the following oversubscribed chargeability areas: CHINA-mainland born, INDIA, MEXICO, and PHILIPPINES. 4. Section 203(a) of the INA prescribes preference classes for allotment of Family-sponsored immigrant visas as follows:

When an allocation cut-off number is shown, visas are available only for applicants with DV regional lottery rank numbers BELOW the specified allocation cut-off number:

First (F1): Unmarried Sons and Daughters of U.S. Citizens: 23,400 plus any numbers not required for fourth preference. Second: Spouses and Children, and Unmarried Sons and Daughters of Permanent Residents: 114,200, plus the number (if any) by which the worldwide family preference level exceeds 226,000, plus any unused first preference numbers: A. (F2A) Spouses and Children of Permanent Residents: 77% of the overall second preference limitation, of which 75% are exempt from the per-country limit; B. (F2B) Unmarried Sons and Daughters (21 years of age or older) of Permanent Residents: 23% of the overall second preference limitation.

Third (F3): Married Sons and Daughters of U.S. Citizens: 23,400, plus any numbers not required by first and second preferences. fourth (F4): Brothers and Sisters of Adult U.S. Citizens: 65,000, plus any numbers not required by first three preferences. On the chart below, the listing of a date for any class indicates that the class is oversubscribed (see paragraph 1); C means current, i.e., numbers are available for all qualified applicants; and U means unavailable, i.e., no numbers are available. (NOTE: Numbers are available only for applicants whose priority date is earlier than the cut-off date listed below.)

Diversity Immigrant (DV) Category

First: Priority Workers: 28.6% of the worldwide employmentbased preference level, plus any numbers not required for fourth and fifth preferences. Second: Members of the Professions Holding Advanced Degrees or Persons of Exceptional Ability: 28.6% of the worldwide employmentbased preference level, plus any numbers not required by first preference.

Other Workers: 28.6% of the worldwide level, plus any numbers not required by first and second preferences, not more than 10,000 of which to *Other Workers. Fourth: Certain Special Immigrants: 7.1% of the worldwide level. Fifth: Employment Creation: 7.1% of the worldwide level, not less than 3,000 of which reserved for investors in a targeted rural or high-unemployment area, and 3,000 set aside for

investors in regional centers by Sec. 610 of P.L. 102-395. On the chart below, the listing of a date for any class indicates that the class is oversubscribed (see paragraph 1); C means current, i.e., numbers are available for all qualified applicants; and U means unavailable, i.e., no numbers are available. (NOTE: Numbers are available only for applicants whose priority date is earlier than the cut-off date listed below.)

Section 203(c) of the INA provides up to 55,000 immigrant visas each fiscal year to permit additional immigration opportunities for persons from countries with low admissions during the previous five years. The NACARA stipulates that beginning with DV-99, and for as long as necessary, up to 5,000 of the 55,000 annually-allocated diversity visas will be made available for use under the NACARA program. This

resulted in reduction of the DV-2011 annual limit to 50,000. DV visas are divided among six geographic regions. No one country can receive more than seven percent of the available diversity visas in any one year.

For June, immigrant numbers in the DV category are available to qualified DV-2011 applicants chargeable to all Third: Skilled Workers, and regions/eligible countries as follows. Professionals,

The primary goal was for the immigrant to obtain employment authorization card, social security number and a drivers license to enable the immigrant secure employment and start a new life. The INS as After many years, some of these applicants were called for interview. Some did not attend because of fear of not being able to substantiate the story cooked up for them by the socalled immigration experts operating out of Barber Shops who helped in preparing the applications. Some attended and were referred to appear before an immigration Judge. Some decided to relocate with a view to beat the system. At the end of the day, most asylum applications were denied because Judges saw a pattern of application stemming from the same event. These judges issued final order of removal against some immigrants which remained in their records. Many of these applicants later married U.S. citizens and without informing their attorneys, applied for adjustment of status with a view that the asylum issue will not come up. To the surprise of these applicants, the asylum issue they thought was buried years ago now stands between them and permanent resident status. They are stuck in the U.S. Some of them end up being arrested at the green card interview. At this time in the immigration process, there is no substitute for full disclosure. There are many more possible impediments to adjustment of status, but the space allotted to this article will not permit me to address all of them. Im afraid that the same thing will happen this year but I cant lock him up in the house all summer. Do you have any suggestions? A. As the weather gets warmer we will encounter many insects. Here are some to keep away from! Many bugs give us reason for pause, including poisonous spiders, chiggers, bees and lice. But few get under our skin quite literally like the tick. TICKS Be careful of ticks they can cling to you as you brush past grass and plants. Ticks dont always carry diseases, and most bites are not serious. But they can carry diseases such as the Lyme disease and Rocky Mountain spotted fever. To prevent tick bites, keep your arms, legs, and head covered when outdoors. Use tick repellant with DEET but not on children under 2 years old. Check for ticks after spending time in grassy or wooded

areas. You dont usually need to test your child or the tick and your child doesnt need antibiotics after a tick bite. Instead, you should just watch the child for symptoms, especially a rash developing at the site of the tick bite and/or a fever. Saving the tick in a container might be helpful though. Other things to keep in mind: tick infections, except Rocky Mountain spotted fever, are usually not transmitted from dog ticks, which are larger than the deer ticks that carry many of these infections. Dogs and other pets can carry deer ticks though. ticks are most likely to transmit infection after feeding for two or more days, so you can greatly reduce your childs risk of infection by doing daily tick checks, especially when your child is outdoors a lot, such as when hiking or camping, in high risk areas. there is usually a seasonal pattern to tick infections, such as Lyme disease and Rocky Mountain spotted fever which are most common during the late spring and summer months in the United States. The symptoms of tick infections depend on what bacteria the tick carry. The most commonly recognized symptom is usually a rash, which can look like: the classic bullseye rash, erythema

Most bites occur in rural and suburban areas and occur between the months of April and October. These spiders tend to bite defensively when their webs are disturbed. Bites to babies and children may be more serious than bites to adults. What are the signs and symptoms of a black widow spider bite? In most cases of a black widow spider bite, symptoms consist only of: * Minimal to sharp pain followed by swelling and redness at the site of the bite.

* One or two small fang marks like tiny red spots. In some cases, severe symptoms appear within 30 to 60 minutes. These include: *Muscle cramps and spasms that start near the bite and then spread and increase in severity for 6 to 12 hours. * Chills, fever, nausea, or vomiting. * S w e a t i n g . *Severe abdominal, back, or chest pain. * H e a d a c h e . *Stupor, restlessness, or shock. *Severely high blood pressure. FLEAS Fleas are small, wingless, agile insects that live off the blood of their host and they dont just bite pets. They dine on people, too. The best solution is to get rid of fleas on pets and in your home. Keep pets out of your bed and be sure to vacuum rugs daily. Spray insecticides on infested areas. Consider using a oncea month insecticide on your pet. Flea bites usually cause only mild symptoms in humans that can be relieved by home treatment measures, such as nonprescription cortisone cream. Signs and symptoms of flea bites may include: Zigzag lines, especially on the feet and legs and in the waist areas. Intense itching. A single hive or wheal. Dull red spots that last even after other symptoms disappear. Blisters or open sores in highly sensitive people. Adult fleas may live in floor crevices, debris, and carpeting for years and can survive for months without feeding. In rare cases, they can carry disease, such as plague. it loses the stinger and dies. But a wasp, hornet, or yellow jacket can inflict multiple stings because they do not lose their stingers. These stings can cause serious reactions in children who are allergic to them. What to do? Apply ice, take oral antihistamine for itching, and take ibuprofen or acetaminophen for pain relief. If there is a severe anaphylactic reaction, lie down and carefully remove the stinger. Use an EpiPen (epinephrine) if you have one. Get immediate medical care. Examples of problems that are more serious include: A severe allergic reaction or anaphylaxis: Severe allergic reactions are not common but can be life-threatening and require emergency care. Today, Department of Homeland Security (DHS) Secretary Janet Napolitano announced the extension and redesignation of Temporary Protective Status (TPS) for Haitians currently in the United States. The extension would allow approximately 48,000 Haitian nationalswhose homeland was devastated by an earthquake in 2010 and is still plagued by disease and instabilityto extend their TPS for an additional 18 months. Additionally, the re-designation would allow Haitian nationals who have continuously resided in the United States through January 12, 2011 (that is, who arrived up to a year after the earthquake) to obtain TPS. The 18month extension and re-designation would begin in July, allowing Haitian nationals to live and work in the U.S. until January 2013.

Are you standing in the Right Place?


valley can be the same lessons that will push you up to the mountaintop. So, while you are in the valley dont cry or complain look for the lessons. Sometimes God also puts us in places and situations to be of blessing to someone else. But most times we are totally clueless of this possibility because we are busy crying and complaining about our own situation. Some years ago, I was standing outside of a mall waiting for my husband. We had agreed that while he took the car to get washed, I would do my shopping. Going shopping with women is not a favored activity for most men. Thinking that I did not want to prolong his torture by having him wait too long after he was finished, I finished my shopping in record time. I came out of the mall at our previously established meeting place and scouted the parking area. There was no sign of our car. So I telephoned him. He told me that the line at the car wash was long. I would have to wait another 30 minutes. Thirty-minutes just seemed like a very long time to stand and wait for someone. And what if it actually lasted more than 30 minutes? Impatient by the whole situation I we complained to God about uncomfortable situations from which we longed for quick release? Have you ever considered that maybe God has us there to help somebody out? The truth is that its not always about you, and it cant always be about you. Your temporary discomfort might signify long-term comfort for someone else. If you choose to become more sensitive to the needs of others you just might realize that you are, after all, standing in the right place. This week I want to invite you take a closer look at that situation that seems like a looseloose one for you. Are there people around that maybe God needs you to touch? You never know, you just might be at standing at the right place to make a difference in someones life.

Some feel that they have been placed in unfair circumstances. They should not be there in the first place. Their current position in life is someone elses fault. Yet more live with regret. If only they had done things differently of taken different decisions. If you are someone who is not happy with their current situation have you ever considered that you might be standing in the right place? In no way am I advocating that you deserve negative factors that accompany this position or that this position is your lot in life. While there is life there must be the hope for better things to come. But, I am asking you to consider that perhaps you find yourself in this situation because there is something that you can learn from it. The lessons you learn while standing in the

debated between going back into the mall or walking home. At the time the mall was not too far way from our home. It would take me about 30 minutes to walk home, anyway. Walking home seemed like a more benign action too; going back inside the mall might lead to the temptation of spending more money. I telephoned my husband with my change of plans. I was going to walk home. He, however, discouraged me from walking home. He assured me that he would soon be finished, some cars had come out of the line. To keep the peace I decided to wait. Standing outside the mall, I that saw when one lady stepped away from her vehicle and started walking towards the mall something fell from her. It seemed like a food wrapper. Nothing of importance, I was sure. Perhaps it fell unknowingly to her or perhaps she dropped it consciously. I wasnt going to say anything, it was not my business anyway. But something kept nagging me to say something about the wrapper to her. I really didnt want to, because first of all I was really more concerned with my own dilemma. Second, it might just be trash. Third, she might not take too kindly to me pointing out some trash to her. Yet, the thought came back that I should say something. For a few seconds I equivocated, but just when the lady was about to pass me I spoke up, Excuse me, but I think you dropped something over there. Without looking back she checked her bag and exclaimed, Lord, have mercy! She held her head and sprinted back to the wrapper on the floor. She checked the contents and held them to her breast. She then came over to me and touched my arm. Looking into my eyes, she expressed sincere gratitude, Thank you so much. This is my rent money. My landlord works here I was coming to drop the rent off. Thank you, Thank you. I felt immediate guilt. Here was I complaining about a 30-minute wait and someone was about to lose their money to pay the rent. To this day I do not know the womans story or situation but I do know that losing rent money could cause a lot of problems on any familys finances. How many times have

On the 11th day of May 2011, The Dream Act returned to Congress to mark the 10th year anniversary of the introduction of the bill in 2001. Hopefully, our political leaders will have enough courage this time to pass the bill into law for the betterment and the future prosperity of the United States of America.

According to Senator Dick Durbin, the Assistant Senate Majority Leader Our immigration laws prevent thousands of young people from fully contributing to our nations future. These young people have lived in this country for most of their lives. It is the only home they know. They are Americans in every sense except their technical legal status, they are honor roll students, star athletes, talented artists and valedictorians. These children are tomorrows doctors, nurses, teachers, policemen, firefighters, soldiers, and senators, and we should give them the opportunity to reach their full potential. Senator Majority Leader Harry Reid also opined that The DREAM Act will give children brought to this nation by their parents through no fault of their own children who in many cases have known no other country the opportunity to earn legal status. Only those who stay in school and out of trouble, and who go on to college or to defend our country in the armed forces would be eligible. Allowing these students to become productive citizens is not only good for them it makes economic sense, would reduce our deficit by $2.2 billion in a decade and would strengthen our military and national security, While Senator Menendez said We should not punish children for their parents past decisions. Personal service of a Notice to Appear (Form I-862) on a minor who is 14 years of age or older at the time of service is effective, and the regulations do not require that notice also be served on an adult with responsibility for the minor. GRANT, Board Member: In a decision dated January 24, 2006, an Immigration Judge issued an in absentia order of removal against the respondent. On August 31, 2010, the respondent filed a motion to reopen the proceedings, requesting rescission of the removal order for lack of proper notice. The Immigration Judge denied the respondents motion in a decision dated September 21, 2010. The respondent has appealed from that decision. The appeal will be dismissed. I. FACTUAL AND PROCEDURAL HISTORY The respondent is a 23-year-old native and citizen of Guatemala who left that country with his step-father and entered the United States on June 23, 2005, without being admitted or paroled. He was born on April 1, 1988, and was 17 years old at the time of entry. The respondent concedes on appeal that he was served in person 236.3(a) and 1236.3(a) (2010), which describe procedures for detention and release of juvenile aliens. He relies on a decision by the United States Court of Appeals for the Ninth Circuit finding that the differing definitions of a minor and a served with notice. Id. at 1163. Thus, the respondent asserts that to reconcile these regulations, they should be interpreted to require that when an alien under the age of 18 is served with a Notice to Appear, a copy must also be given to an adult.1 The regulations promulgated by the Attorney General have the force and effect of law. Section 103(a) of the Act, 8 U.S.C. 1103(a) (2006); Matter of Anselmo, 20 I&N Dec. 25, 30 (BIA 1989); 8 C.F.R. 1003.1(d)(1)(i), 1003.10(b) (2010). We construe the language of the regulations following the same principles of interpretation that we apply to statutory provisions. See Matter of VillarrealZuniga, 23 I&N Dec. 886, 889 (BIA 2006). Regulations, like statutes, must be interpreted to give effect to the entire regulatory scheme. Matter of C-W-L-, 24 I&N Dec. 346, 348 (BIA 2007). However, the regulation that specifically addresses the issue at hand is controlling. See Matter of Ponce De Leon, 21 I&N Dec. 154, 158 (BIA 1996, 1997; A.G. 1997). However, he argues that he did not receive proper notice of the hearing and that his in absentia proceedings should therefore be reopened and the removal order rescinded. Specifically, he asserts that even though he was served in person, the service was not proper because the notice of the hearing should also have been given to his step-father or a legal guardian since he was only 17 years old at the time. II. ANALYSIS A removal order entered against an alien in absentia may be rescinded at any time if the alien files a motion to reopen and demonstrates that he or she did not receive notice of the hearing. 8 C.F.R. 1003.23(b)(4) (ii) (2010). Section 239(a)(1) of the Immigration and Nationality Act, 8 U.S.C. 1229(a)(1) (2006), provides that the Notice to Appear is properly served if it is given in person to the alien (or if personal service is not practicable, through service by mail to the alien or to the aliens counsel of record, if any). See also 8 C.F.R. 103.5a(c)(1) (2010) (providing for personal service of notice). However, the regulations state that if the alien is a minor under 14 years of age, service shall be made upon the person with whom the . . . minor resides; whenever possible, service shall also be made on the near relative, guardian, committee, or friend. 8 C.F.R. 103.5a(c)(2) (ii); see also 8 C.F.R. 236.2(a) (2010). The respondent argues that this definition of a minor conflicts with the definition of a juvenile as a person under the age of 18 years in 8 C.F.R. juvenile in this context were illogical and could raise serious due process concerns. FloresChavez v. Ashcroft, 362 F.3d 1150, 1157-62 (9th Cir. 2004). In that case, the Ninth Circuit ruled that if an alien under the age of 18 is released into the custody of an adult, the Notice to Appear should be served on the adult as well as the alien, because it would be inconsistent for the regulations to require that minors older than fourteen be released to a competent adult who takes responsibility for the minor but to not require that the adult be

Good News for Haitians: TPS Extended Until January 22, 2013
According to a Memo published by the Office of Communication of the U.S. Citizenship & Immigration Services on May 19, 2011, the Secretary of Homeland Security Janet Napolitano has announced the re-designation of Haiti for Temporary Protected Status (TPS) and extended the countrys current TPS designation for 18 months through Jan. 22, 2013. Secretary Napolitano first announced that she was designating Haiti for TPS on Jan. 15, 2010, after major earthquakes devastated the country. The designation was effective on Jan. 21, 2010. Following consultations with other Federal Agencies, Secretary Napolitano has determined that current conditions in Haiti support extending the designation period for current TPS beneficiaries and re-designating Haiti for TPS. The re-designation re-establishes the date by which applicants must prove that they have continuously resided in the United States. Applicants must have continuously resided in the United States since Jan. 12, 2011. It appears that many more Haitians who were not eligible for TPS when it was first established last year will now be eligible since the required entry date has been changed from January 12, 2010 advisor.
