FREQUENTLY ASKED QUESTIONS - THE TRADE UNIONS ACT, 1926 Who are the Registrars of Trade Unions appointed

by the Government of A.P.? Ans. Additional Commissioner of Labour is the Registrar of Trade Unions. Joint Commissioners of Labour are Additional Registrars. 1) In what form, shall an application for registration of trade unions be made to the Registrar ? Ans. The application shall be made in Form A prescribed under Regulation 3 of The A.P. Trade Union Regulations, 1927. 2) What are the total documents that are to be submitted to the Registrar for registration of a Trade Union ? Ans. a) Application in Form-A. b) Rules of; c) A remitted original challan of Rs.50/- (Rupees fifty only) under the following Head of Account: 0230 Labour and Employment; 102 Receipts under Labour Laws; 01 Fees under Trade Unions Act, 1926; 3) D.D.Os Code : 25001503051 d) Minutes B Book (Minutes of the General Body Meeting); e) Form-F Membership Register; f) Names, occupations, and addresses of the total members of the union; g) Total strength of the Organisation; Note:- 1) Each and every document should signed by the President and General Secretary; 2) Each and every document should be submitted in three sets. 4) Does the Trade Union Act provide for recognition of trade unions ? Ans. No. It provides for the registration of trade unions. The recognition of unions is under the Code of Discipline which is a voluntary code ratified by all Central Employers and Workers Organisations at the 16th Session of the Indian Labour Conference held at Nainital in May, 1958. 5) Does the office bearer of a trade union have any immunity from

misconduct ? Ans. Office bearer of a trade union has no immunity from misconduct. 6) Does the Registrar of Trade Unions have power to decide the dispute arising out of election of office bearers ? Ans. No. The civil court has jurisdiction to decide intra-union rivalry of office bearers of a trade union. 7) Which is the appropriate government in relation to trade unions whose objects are not confined to one state ? Ans. The Central Government is the appropriate government. 8) Does the trade union include any federation of two or more trade unions ? Ans. Yes. The federation of trade unions can also be registered as a trade union. 9) Can Welfare Associations be registered under the Trade Unions Act ? Ans. No. It has to be registered under the Societies Act. How many members of a trade union can apply for registration of the trade union ? Ans. Any seven or more members of a trade union can apply for registration. 10) 11) What is the requisite number for registration of a trade union ? Ans. Ten percent or one hundred of the workmen, whichever is less, engaged or employed in the establishment or industry with which it is connected should be the members of a Trade Union on the date of making of application for registration. 12) What particulars should an application for registration contain ? Ans. A) The names, occupations and addresses of members making the application; b) the name of the Trade Union and the address of its head office; and c) the titles, names, ages, addresses and occupations of the (officebearers) of the Trade Union. 13) What are the main provisions to be contained in the rules of a trade

union ? Ans. What is the maximum period for which the office bearers can be elected ? Ans. Three years. 14) 15) To whom, does an appeal lie on any refusal of a Registrar to register a trade union or cancellation of registration ? Ans. A) where the head office of the Trade Union is situated, to High Court b) Where the head office is situated in an area, falling within the jurisdiction of a Labour Court or an Industrial Tribunal, to that Court or Tribunal as the case may be. 16) Which are the Acts that do not apply to trade unions ? A registered Trade union may constitute a separate fund, from contributions separately levied for or made to that fund from which payments may be made, for the promotion of the civic and political interests of its members. What are the grounds for disqualification of office-bearers of Trade Unions ? Ans. A person shall be disqualified for being chosen as, and for being, a member of the executive or any other office-bearer of a Registered Trade union if 16) i) he has not attained the age of eighteen years; ii) he has been convicted by a Court in India of any offence involving moral turpitude and sentenced to imprisonment, unless a period of

five years has elapsed since his release. 17) What is the proportion of office-bearers to be connected with the industry ? Ans. All office-bearers of a registered Trade Union, except not more than one-third of the total number of the office-bearers or five, whichever is less, shall be persons actually engaged or employed in the establishment or industry with which the Trade Union is connected. 18) Can a Trade Union change its name ? Ans. Yes. Any registered Trade Union may, with the consent of not less than two-thirds of the total number of its members and subject to the provisions of Section 25, change its name. 19) What are the registers that are to be maintained by the registered unions ? Ans. Every registered trade union shall maintain the following books and registers to facilitate the audit of its accounts:a) Register of membership and subscriptions in form F. b) Register of receipts and disbursements of the General Fund Accounts; c) Minutes book to record the proceedings of all meetings; d) Register of stock, tools and plant showing the furniture fittings and valuable documents relating to the immovable property of the union; e) Machine numbered subscription receipt book; f) Register of receipts and disbursements of the political fund if there is a political fund; and g) A file of vouchers. 20) In what form, annual return of a trade union should be filed ? Ans. Form E under regulation 18 of A.P. Trade Union Regulations, 1927 u/s.28 of the Trade Unions Act.
