Unchecked presence of mortgage fraud in Ingress foreclosure case, Hillsborough South Case No. 2010-CV-571:

Dear Clerk of Courts Buttrick, Scanlon and Acting NH Discipline Counsel Trevethick: There seems to be some measure of confusion regarding my Ethics Complaint. Please allow me to elucidate so there be no misunderstandings here: 1. I am aware that I am not a party to this case, but such fact is of no moment. Judge Diane Nicolosi is being served because as a legal journalist I have firsthand knowledge that she allowed an attorney to testify about material aspects of a mortgage case when allowed the practice of deception: Massachusetts AG Martha Coakley is now investigating MERS for the same reasons that Miami Bar Counsel issued a ruling that failure to notify the Court and opposing counsel of document irregularities constitutes a violation under Rule 3.3 Candor Toward the Tribunal. My Complaint sounds in that very Canon given that Linda Greens name appears in the case at issue: In Essex County, Mass., the office that handles property deeds has received almost 1,300 documents since October with the signature of "Linda Green," but in 22 different handwriting styles and with many different titles. Linda Green worked for a company called DocX that processed mortgage paperwork and was shut down in the spring of 2010. County officials say they believe Green hasn't worked in the industry since. Why her signature remains in use is not clear. "My office is a crime scene," says John O'Brien, the registrar of deeds in Essex County, which is north of Boston and includes the city of Salem....."

A Bar staff opinion held it makes no difference whether the case was open or closed or what stage an open case is at in terms of the lawyers duty. The opinion said that under Rule 4-3.3 (Candor Toward the Tribunal), the improperly prepared affidavits constitute false evidence, and the lawyer has a duty to disclose that to the courts.
Other rules must also be considered, the opinion said, including Rule 4-1.2(d) which prohibits assisting a client in criminal or fraudulent conduct, Rule 4-3.4(b) which prohibits a lawyer from fabricating evidence or assisting a witness who offers false testimony, Rule 4-8.4(a) which prohibits violating the Rules of Professional Conduct or assisting another to do so, Rule 4-8.4(c) which bars an attorney from conduct that constitutes dishonesty, fraud, deceit, or misrepresentation, and Rule 4-8.4(d) which prohibits a lawyer from conduct that is prejudicial to the administration of justice. So I trust that much is clear, then.

2. With regard to all of the others, I would re-allege and restate all that precedes and note that the NH Supreme Court Discipline Office has Jurisdiction over any attorney practicing in New Hampshire. I (and a few thousand other people watching this case develop) saw and heard Attorney Shawn Masterson make material representations that the original note and mortgage are all valid, although he did not to my knowledge make any representations as to a certified chain of title/custody. He can t testify to any of that anyway because he doesn t have any knowledge of the front end side of things, so without that chain of custody he doesn t know an original set of documents any more then he knows the number of angels who dance on the head of a pin. That s the law, as noted in my Complaint. It would be up to your office to determine if Attorney Wahlquistin (sic) practices law in New Hampshire but we know that Attorney Sumski does. Therefore I am returning the required notarized signature with your copy of the Complaint for immediate processing with an actual analysis of the issues presented, and not some canned response that avoids everything. America is torn to shreds over this so we don t need any more negative reinforcement that perpetuates the problem. Should you have any further questions please do not hesitate to contact me, as case law is bourgeoning right now and more often than not these cases and ethics opinions support my contentions so I can help keep you up to date. You certainly don t want New Hampshire to lag behind the rest of the Country so we should work well together on this.
