.S Request to consider the graduate SubEngineers for appointment by transfer as Addl. Assistant Engineers Regarding. Ref:- 1) APSEB S.Rs part III, Annexure III followed by Reg (14). 2) BP (P&G Per) Ms No.288 Dt: 11.01.1996.

This association would like to bring some irregularities to your kind notice regarding service regulation at the time of effecting
appointment by transfer to the in service graduate Sub-Engineers,

in the form of amendment vide BP (P&G Per) Ms No.288 Dt: 11.01.1996. We are herewith requesting your good self to consider the case of in-service graduate Sub-Engineers for appointment by transfer as
Addl. Assistant Engineers according to APSEB service regulations Annexure III of part III followed by regulation (14).

According to this original service regulation, the in-service graduate sub-engineers are eligible for appointment by transfer as Addl.
Assistant Engineers.

An Amendment vide ref (2) cited was came into picture in the year of 1996, which deprived the graduate in-service sub engineers from getting appointment by transfer as Addl. Assistant Engineers with out any rational cause and reasons there on.

Hence, the said amendment is unlawful and the original APSEB service regulations are to be adopted at the time of appointment by
transfer of sub engineers as Addl. Assistant Engineers.

Amendment made in BP No.288 of 1996 was as follows In Annexure III to the said Regulations under the main heading A.P.S.E. Board Engineering service. Against categories Addl. Asst. Engineer/ Electrical, civil, Mechanical in column (1), the existing provisions in columns (1), the existing provisions in column (2) and (3) shall be substituted namely (2) Appointment by Transfer (3) The qualifications shall be the same as mentioned in Annexure I under Method of Recruitment.

The substitution of column (3) of Annexure III which explains about the qualification for a candidate to get appointment by transfer as
Addl. Assistant Engineers by the column of Annexure I stand gross

misinterpretation of service regulation. As the Annexure I of part III of service regulation is clearly meant for explanation of method of recruitment, but not meant for explanation of qualification where as the Annexure III of service regulation part III is clearly meant for explanation of qualification required for a candidate to get appointment by transfer/recruitment. Hence, the Annexure- III is only reference which is to be taken into account for deciding the qualification of the candidate.

Now as our members who are working as sub engineers and having graduation are fully eligible for appointment by transfer as Addl. Assistant Engineers according to this provision in original
Annexure III of part III of service regulations before amendment. Hence in this regard it is requested to consider all the graduate sub engineers for appointment by transfer as Addl. Assistant Engineers
