L Sub-Engineer Services-Decimation in the integrated seniority issuing in respect of Direct Sub-Engineers one sidedly favouring to Sub-Engineers coming from Appointment by TransferShelter for Principle of natural Justice-request-reg. Ref:1) B.P.Ms.No.421,Dt:27/4/1978 read with B.P(P&GPer)Ms.No.106,Dt.19/8/1995. 2) B.P.(P&G-Per)Ms.No.354, Dt:12/12/1994. ***** We, the Direct recruitment Sub-Engineers working since the year of 2001 to till to date in A.P.E.P.D.C.Ltd in various operation Circles of APEPDCL humbly constrain to submit the following few lines for favourable consideration of kind examination and observation of principle of natural justice in our appeal pertains to discrimination of adopting the time of seniority in respect of direct recruitment Sub-Engineers while comparing the incorporation of date of seniority in respect of Sub-Engineers coming up from appointment by transfer. We feel so constrain to bring to your impartial notice, that it is a general practice adopting to adding 2 years of service weightage in respect of Sub-Engineers coming up from appointment by transfer and consequently the date of seniority was fixing up since the passing of acquiring Diploma Certificate in addition to adding 2 years of service for the length of render of service in their existing cadre prior to their appointment by transfer to Sub-Engineer cadre which is A double time of the service weightage adding in respect of Sub-Engineers recruited from appointment by transfer while the direct recruitment Sub-Engineers date of 2nd page.

2nd page. seniority is going to be over looked by the Sub-Engineers recruited from the appointment by transfer even though they were 4 to 5 years juniors to the direct recruitment Sub-Engineers which is at out set result violating the equal opportunity in employment and promotions which was guaranteed by the Constitution of India Under Article 16 of Indian Constitution. The injustice has been going on in following circumstances:1) With reference to 1st cited wherein it was stated the rule of affair that

for getting promotion from Sub-Engineer to Addl.Asst.Engineer, it requires to complete 5 Years of continuous Service in the cadre of Direct Recruitment Sub-Engineer where as in respect of SubEngineers belong to Appointment by Transfer will have the above length of 5 years of service consequent of double benefit of adding service Weightage to the seniority i.e since the date of passing of Diploma and 2 years service weightage for the render of their service to their previous cadre and there fore the integrated quantum of seniority in respect of Sub-Engineers of appointment by transfer is doing over look on the actual seniority list of direct recruitment SubEngineers because the date of seniority in respect of Direct recruitment Sub-Engineer will be fixed according to the date of recruitment only and there is no service wightage benefits adding to the total length of seniority of direct recruitment Sub-Engineers on par with Sub-Engineers of appointment by transfer.
2) With reference to 2nd cited, wherein it was stated that the graduate

Sub-Engineers who have completed 4 years of service in their existing cadre are eligible for the recruitment of Asst.Engineers and such recruitment from among Graduate Sub-Engineers shall be limited to 10% of the vacancies at the time of each recruitment and shall have to wait up to the time of recruitment only. But in respect of Sub-Engineers coming up from appointment by transfer due to their double benefit of service weightage in the cadre of Sub-Engineer are becoming eligible for the recruitment of Asst.Engineer subject to 10% availability of vacancies and here in too they are doing over look the 3rd page.

3rd page. Graduate Sub-Engineers because non adding of service weightage to Graduate Sub-Engineers on par with Graduate Sub-Engineers coming up from appointment by transfers which is clear evident that in each and every occasion the actual quantum of length of seniority of Graduate Sub-Engineers is being over look by its very junior Sub-Engineers with 4 to 5 years of their double time adding service weightage to their length of seniority. In view of the afore said injustice and discrimination of consideration of seniority, it is requested to arrange to cause the necessary directions to the higher Authorities of A.P.E.P.D.C.Ltd for providing promotions as Addl.Asst.Engineers with retrospective effect with out allowing the Junior Sub-Engineers as Seniors than the actual senior direct recruitment Sub-Engineers so as to avoid the further legal hurdles of equal opportunity of employment and promotion and counting of seniority for promotional purpose for which act of your kindness shall give a great shelter to the principle of natural justice and previous Note Points in the above regard may please be quashed immediately at your intellectual intervention for the welfare of your dependent Direct recruitment SubEngineers concerned and Graduate Sub-Engineers coming up from Direct Recruitment based Sub-Engineer please.
