2 I, Joseph R. Wetzel, do hereby declare and say:

3 1. I am an attorney at the law firm of Weil, Gotshal & Manges LLP, counsel of

4 record for Defendants Samsung Electronics Co., Ltd., Samsung Electronics America, Inc.,

5 Samsung Semiconductor, Inc., and Samsung Austin Semiconductor, L.P. (collectively

6 “Samsung”), and I am one of the counsel for Samsung in the above captioned cases. I am

7 admitted to practice law in the State of California and in this Court. I make this declaration in
