Lionel Yee says that the Buffer Reserve and interest thereon were transferred to General Reserve, hence, General Reserve funds are also for pension payments. In the Annual Reports, I cannot find any interest (on General Reserve and Buffer Reserve balances) credited to these reserves. I have always said that there were sufficient funds to pay existing pensioners in the General and Buffer Fund Reserves Accounts. The capacity to pay has also been confirmed actuarially by Mercer (as per 2010 Annual Report note 29 page 61). If FNPF reduces our pensions from 25% to 9%, they will be denying us access to these funds is it fraud? Continued payment to contracted pensioners is required by Law. See Addendum B - Cap 219 subsidiary legislation Part 3 - Exercise of Option. 1. (Clause 14). The Fund "General Manager notify the person of the entitlement and of the amount of it." It does not refer to a percentage but a specific amount! 2. (Clause 15). "Send the person a form providing for the person to choose the type of annuity." 3. (Clause 16). "General Manager must make payment of the annuity selected by the person 4. (Clause 18 (1) (a). Duration of annuity -"in the case of withdrawal on attaining 55 - the life time of the pensioner." The Fund will break the law if it proposes reduction to pensions for contracted pensioners. The Fund has a valid contract with existing pensioners. See addendum A, B, C D and E attached - documents sent to me to exercise my option for a pension. The Pension Option form states a specific amount and a life pension.

The government should not introduce retrospective legislation. It is contrary to the Charter for building a better Fiji - specifically to "the rule of law". It will also send a very bad signal to potential investors and foreign governments. Retrospective legislation generally considered unjust and is used sparingly used in war, national emergencies. It will be interesting to see what happens with the Burness case - will the court act independently? All the best.

I am still waiting for the court to hear my ex parte application and don't know why the hold-up. So if your friends can start raising their voices in the media/blogs etc that the court should hear my ex parte application that would be good. You can send this to all and sundry and also tell them that I am concerned that the court has not yet heard my ex-parte application for an interim injunction against the proposed Decree to change FNPF Act on July 1, only a few days from now. Some questions about this need to be sent to the PM, the courts and whoever the powers are. Thanks Shaista
