Activities of Yacht Registry Division As of January 01, 2008 the Law on Yachts entered into force.

The Law regulates nationality, identification and inscription of yachts in the Yacht Register as well as entering, staying and leaving of yachts, and rights and responsibilities when hiring yachts. The Law was published in the Official Gazette of the Republic of Montenegro, No.46/07 on July 24, 2007. Pursuant to the aforementioned Law, Maritime Safety Department established the Yachts Registry Division which deals with yachts registration, inscription of yachts in the Yachts Register and issuing and renewal of statutory certificates. Yachts Register exists in electronic form as well and is updated simultaneously with the main Register. Legislation Yacht a navigable vessel intended for pleasure, sports and recreation, with length of 7 meters or more, intended for longer stays at sea, and not engaged in international trade; Register the book and the electronic evidence of yachts, their identity, features, owners and mortgages; Certificate of Registration - a proof evidencing that the yacht is inscribed into the Register and is capable of operation; The yacht acquires Montenegrin nationality once it is inscribed into the Montenegrin Register. The yacht which has acquired Montenegrin nationality shall be under the sovereignty of Montenegro when sailing out of territorial sea, internal sea waters, rivers and lakes of Montenegro. The flag of Montenegro is a sign of a nationality assigned to a yacht. The yacht which has acquired Montenegrin nationality has the right and the duty to sail under the Montenegrin flag. The Flag of Montenegro hoisted on the yacht shall have the ratio of width to length of 1:1, 5. On motor-powered yacht the flag shall be hoisted on the stern post. On a yacht with sails flag shall be hoisted on after mast whereas in case of a one-mast yacht the flag shall be hoisted on it. Flag shall be hoisted so that its upper edge reaches the top of the stern post or mast, respectively. If the flag is hoisted on the stern post, or mast, no other mark or flag may be hoisted on it. Yachts inscribed in the Register shall have their names and marks in accordance with the Law. No two yachts of the same name may be inscribed in the Register. The mark of a yacht shall consist of the internationally recognized insignia of the Republic and the Register number which is the ordinal number under which the yacht is listed in the Register. The name must be written clearly and shall not affect the visibility of the mark. The mark of a yacht must be written on both sides of a yachts bow or, if it is more appropriate, on a visible place on both sides of the superstructure. The yachts name and mark shall be displayed in figures and letters of not less than 200 millimeters. The Register decides on a yachts name and mark in accordance with the Law.

A yacht inscribed into the Register carrying more than 12 passengers and weighing more than 100 GT shall have an IMO number which will remain the same even in the event of ownership or registry change. A yacht inscribed into the Register, equipped with the radio-telephone and/or the GMDSS device, shall have a call sign and/or MMSI number in accordance with the regulations on international radio traffic. A yacht may be inscribed into the Register on condition that it is not inscribed in a different register, under the conditions provided by this Law and other regulations. A yacht owned by domestic companies, legal entities and entrepreneurs or natural entities shall be inscribed into the Register, whereas a yacht owned by a foreign legal or natural entity can be inscribed into the Register. A yacht under a bareboat charter may be inscribed in the Register under the name of the charterer for the duration of the bareboat charter. For inscription into the Register of a yacht under a bareboat charter the following original documents shall be submitted, along with those referred to in Article 13: 1. bareboat charter 2. the Owners consent for the inscription of a yacht into the Register. Inscription into the Register The following documents are required for entry of a yacht into the Register: 1. Application for inscription of a yacht in the Yacht Register with the proposed name of the yacht (form of the Register); 2. Certified copy of the Owners identification document for a natural person (identity card or passport) or a registration document for a legal entity (Confirmation of registration of Legal entity in the Central Registry of the Commercial Court of Montenegro, Decision on Deletion from the Previous Registry; Evidence of ownership, declaration of ownership and purpose of a yacht, and the power of attorney in case when the inscription in the Register is not performed personally by the Owner or co-owner or charterer (form of the Register); Certificate of regulated mandatory insurance for the amount of at least 800.000 (insurance company; the original or a certified copy); Application for Radio License (form of the Register) Radio stations technical documents (photo copy); Document of Deletion from the previous register or, in the case of first registration, Builders Certificate; Certified copy of sale and purchase agreement or in case of the first registration, builders papers with buyers name stated; International Tonnage Certificate or Builders Certificate with technical properties including tonnage data.

In case of a yacht previously registered in a different register, the administration body shall assess the need for its survey, as a precondition for its inscription into

the Register, on the basis of its previous registration and the yachts previous area of navigation. In case of first registration survey of a yacht is a precondition for its inscription into the Register unless it was built in accordance with the EU Directive 94/25/EC, Federal Regulations Code 33 of the United States of America, Sections 181 and 183 or MGN Code 280 (M) and MSN Code 1792 (M) of the United Kingdom Maritime and Coastguard Agency. Should the assessment establish that the survey is necessary, further to paragraphs 2 and 3 of this Article, the Registry Authority shall, at the expense of the Owner, appoint a surveyor to perform the survey and submit a report. Certificates issued for yachts intended for personal use, the length of which is 24 m or less, fit to carry the maximum number of 12 persons, shall have a validity period of three years whereas for all other yachts validity period of certificates shall be one year. Temporary registration Yacht may be temporary registered for the maximum period of three months on the basis of copies of the required documents, in which period the applicant is obliged to submit the originals of the respective documents required for inscription into the Register. For the registration of a yacht, according to paragraph 1 of this Article, it is necessary to provide copies of the documents referred to in Article 13 of this Law, paragraph 1, points 1 through 5. The administration body shall issue the Temporary Certificate of Registration within three days upon receipt of the documents referred to in the paragraph 2 of this Article. Application Form for the Temporary Certificate of Registration is prescribed by the Ministry. Categories on the basis of the area of navigation According to area of navigation, and by issuing the Certificate or Temporary Certificate of Registration, a yacht is assigned one of the following category of navigation: A navigation without limitations, B navigation up to 200 nautical miles from the port of refuge, C1 navigation up to 60 nautical miles from the port of refuge and 25 nautical miles from the shore, C2 navigation up to 20 nautical miles from the port of refuge and 6 nautical miles from the shore, C3 navigation, during daylight and under good weather conditions, up to 20 nautical miles from the port of refuge and 6 nautical miles from the shore. Periodical survey

A yacht of 7 to 24 meters, fit to carry a maximum number of 12 passengers shall be surveyed at least once in a three-years period. Yachts of 24 meters or more shall be surveyed at least once a year. Obligations in case of damage The Master or skipper of a yacht inscribed into the Register shall immediately inform the administration body of any damage on the yacht which could affect the validity of the Certificate. The administration body shall take all necessary measures in order to maintain the validity of the Certificate. Deletion of a yacht from the Register Administration body shall decide on deletion of a yacht from the Register in one of the following cases: 1. 2. 3. 4. 5. Note:

In case the equipment onboard a yacht does not comply with the requirements of the requested area of navigation, the Owner shall carry out the appropriate adjustments of the equipment as a precondition for obtaining a Certificate of Registration. PROCEDURE FOR A YACHT REGISTRATION

Having in mind that technical survey is the condition for the initial inscription of yachts into the Register, the Owner or an authorized person shall submit a Request for Technical Survey of a Yacht where the proposed maximum number of persons the yacht is allowed to carry and the requested area of navigation is stated. The Request Form shall also contain information on the type of radio installation and other equipment aboard vessel, as well as the number of bunks. The Request shall be submitted during initial, periodical and intermediate survey. After the submission of the Request, the process of establishing technical acceptability follows consisting of a visual survey performed by an authorized surveyor. Should the survey establish that the vessels technical properties do not comply with the conditions for the inscription of the yacht in the Montenegrin Yacht Register, the Document of Technical Acceptability shall be issued. This Document does not release the owner from the obligation of performing all other necessary technical surveys with the purpose of issuing navigational documents. If the survey is not performed on the territory of Bar, mileage for the surveyor performing the survey shall be paid. In a case when the vessel satisfies the criteria for yachts in accordance with the Law on Yachts (Official Gazette of the Republic of Montenegro No 46/07) and the Rules for Statutory Certification of Yachts issued by the Maritime Safety Department, the Owner shall pay an appropriate fee for the technical survey. If the yacht is new and built in accordance with the EU Directive 94/25/EC, Federal Regulations Code 33 of the United States of America, Sections 181 and 183, and Codes MGN 280 (M) and MSN 1792 (M) of the Maritime and Coastguard Agency of the United Kingdom, no fee is to be paid. An authorized surveyor performs the full survey of a yacht, fills out the check list for yachts survey and establishes the category of navigation in relation to construction and equipment of the yacht. The surveyor submits the Report on a Yachts Technical Survey to the Yachts Registry Division. If a yacht is subject to the statutory certification in accordance with the IMO conventions, technical survey of the yacht shall be performed by a recognized organization (Bureau Veritas, Russian Register of Shipping, etc.) with which the Maritime Safety Department has an agreement for the delegation of authority. Recognized organization shall, after the performed technical survey, submit the Survey Report to the Maritime Safety Department. When the Register receives a positive Survey Report, the owner or an authorized person shall submit:

o Application for inscription of a yacht in the Yacht Register with the

proposed name of the yacht (Form No. 1, Official Gazette of the Republic of Montenegro 43/10) o Declaration of Ownership and Purpose of a Yacht (Form No.2, Official Gazette of the Republic of Montenegro 43/10) o Application for Radio License (Form No. 3, Official Gazette of the Republic of Montenegro 43/10) o Request for allocation of MMSI number o Documents regulated by Article 13 of the Law on Yachts (Official Gazette of the Republic of Montenegro 43/10) Yacht Register evaluates the submitted application and if all conditions are met, approves and issues the Confirmation of Documents Received for the inscription of the yacht in the Yacht Register. For a registration of a yacht of over 24 meters in length it is necessary to contact the Register directly. INSCRIPTION IN THE YACHT REGISTER AND ISSUING OF CERTIFICATES Upon the reception of the Application with all necessary documents, the Owner submits confirmation of payment for the following fees: o o o o o Inscription of a yacht in the Register, Allocation of MMSI number Tax for the use of navigable vessels Sales tax the used navigable vessels Approval for Onboard Radio Station

The Maritime Safety Department decides on the allocation of a yachts mark and name, call sign and MMSI number and the Yacht Register issues the Certificate of Yacht Registration (Form No.5, Official Gazette of the Republic of Montenegro 43/10). On behalf of the Owner, the Department submits the Application for Approval of Radio Frequency with all technical data for the onboard equipment, a Decision for the allocation of MMSI number and all other necessary documents to the Agency for Electronic Communications and Postal Services. The Agency issues the Onboard Radio Station License. Temporary certificate (Form No.4, Official Gazette of the Republic of Montenegro 43/10) can be issued on the basis of copies of required documents in accordance with Article 14 of the Law on Yachts. Upon issuing of the Certificate, the Owner signs a confirmation of picking up the Certificate, after which the Yacht is inscribed in the Yacht Register, as well as in the electronic register which is kept in the Maritime Safety Department (Yacht Registry). At the request of the Owner or an authorized person the Yacht Register gives approval for alterations/repairs and replacements of parts of the yacht and based on the request issues a duplicate of the Certificate of Yacht Registration. ADDITIONAL DOCUMENTS SUBMITTED WITH THE REQUEST FOR TECHNICAL SURVEY OF A YACHT For yachts intended for personal use, as a precondition for performing the initial survey by the MSD the following should be submitted: FOR EXISTING YACHTS OF HULL LENGTH OF 24 METERS OR LESS

A copy of the inscription list, navigation license or other relevant document issued by the country whose flag the yacht was entitled to fly before inscribing the yacht in the Register of Yachts of Montenegro as evidence that the vessel operated in domestic or international maritime traffic. A copy of a yachts Type Approval Certificate in accordance with Directive 94/25/EC or Directive 94/25/EC, as amended by Directive 2003/44/EC

Yachts should be fitted with the appropriate equipment prior to the survey depending on the requested category of navigation. Yachts should be prepared for survey having in mind that yachts older than three years are required to be surveyed in dry dock. In order to shorten the process, we recommend you prepare as many yachts at the same location if possible. The duration of survey depends on the conditions stated above as well as on the general condition and age of yachts.
