2011 Labor Standards Enforcement Program

I. GENERAL STATEMENT

Labor policies shall be guided by the principle of providing decent and productive employment. As the prime region of the Department of Labor and employment, DOLE-NCR shall actively implement the Departments various programs, projects, and services to promote gainful employment opportunities, develop human resources, protect workers and promote their welfare, and maintain industrial peace. Protecting the workers and promoting their welfare involves improving workers competency, productivity and work values, work condition and occupational safety and health, remuneration and welfare. To this end, the regulatory approach, through inspection, and the developmental approach, through the conduct of self-assessment and training and advisory visits shall be the prime components of the workers protection program. To ensure that the components of the workers protection program are made known, the Field Offices shall strengthen its information, education and advocacy campaign as well as its linkage and networking. To this end, it shall establish a coordinating link with local government units (LGUs) and other government agencies, the employers group; the labor groups; and other non-government organizations (NGOs). In view of the full implementation of the Departments Rationalization Program and other priority projects and programs, the Regional Office has adopted a target for establishment to be subjected for inspection commensurate to the number of inspectors in the Regional Office. The inspection will be conducted using the zonal approach, where all the labor inspectors shall focus in designated area of inspection. Further, the Field Offices shall ensure the conduct of quality inspection, both general labor standards and technical safety, in their respective areas of jurisdiction. Other LSE Program activities such as Disposition of Labor Standards Cases, Spot Check on Self-Assessment, Follow-up Visits on TAV, and the implementation of the National Program against Child Labor shall likewise be delivered. II. Personnel Complement III. WORK STANDARDS In the conduct of regular/routine inspection, the minimum work standards of two (2) establishments per labor inspector per day shall be adopted. Two (2) days per week shall be allotted for inspection. One (1) day for the preparation of inspection reports and another two (2) days for the conduct of TAV and SA Orientations, and other programs and projects except the conduct of summary investigation/hearing of inspected establishments. Inspection commences in February 2011 and ends November 2011. The conduct of spot checks under Self-Assessment after evaluation shall be done by the Focal Person within five (5) days from receipt of the checklist. In the conduct of validation/follow-up visit of TAV commitments, the minimum work standards shall be two (2) establishments per day. IV. a. SPECIFIC TARGETS Inspection: a.1 General Labor Standards February 2011 April 30, 2011 (21 inspectors x 2 Establishments/day x 2 days/week x 4 weeks/month x 3 months = 1,008 establishments) 5,040 establishments

May 2011 November 30, 2011 (15 inspectors x 2 Establishments/day x 4 days/week x4 weeks/month x 7 months = 3,360 establishments)

Note: 11 Hearing Officers under Project Speed 3 and 4 S/A Focal Persons will conduct inspection 4 days a week starting May 2011.

(7 inspectors x 2 Establishments/day x 2 days/week x4 weeks/month x 7 months = 672 establishments) Note: These are seven (7) Focal Persons of TAV. Target number of inspectionable establishments = 5,040

Technical Assistance and Advisory Services (TAV) A total of forty eight (48) Orientations/Trainings will be conducted by the Field Offices with at least thirty (30) employer/participants per TAV orientation/training or a total of one thousand four hundred forty (1,440) establishments. Each field office will conduct eight (8) Orientations/Trainings. One hundred percent (100%) of the participating establishments in the 2011 TAV Orientations/Trainings conducted with violations/deficiencies on wage related benefits based on their action plans and commitments will be subjected to follow-up visits.

Self-Assessment (SA) A total of 990 establishments will be covered under the Self-Assessment approach the target establishment per Field Office of which is broken down as follows:

Spot check will be conducted to 198 establishments or 20% of the 990 responding firms.

Capability Building / Training Refresher Course / Updates on Labor Standards Laws and Regulations / Team Building Exercise for LSE Program implementers of DOLE-NCR (with emphasis on difficult issues/problems encountered and most common errors) aimed towards facilitating the full implementation of the Labor Standards Enforcement Framework shall be conducted in July 2011. Capability Building of TAV & SA implementers and partners.

Information, Education and Advocacy All year round advocacy on the LSE Program through tri-media facilities. All year round participation in activities of employers groups, labor groups, LGUs and other government agencies to advocate LSE Program Six (6) advocacies on Occupational Safety and Health (OSH) will be conducted by the Field Offices. Each Field Office will conduct at least one (1) advocacy with at least thirty (30) participating hazardous establishments.

Linkage and Networking Establish coordinating link with employers groups, labor groups, LGU and other government agencies for a more effective implementation of the LSE Program. Forge alliance with employers groups, labor groups, LGUs and other government agencies for joint undertakings/development of a plan/program on the implementation of the LSE Program.

Disposition of Cases The target disposition rate is 75%. The TSSD LR/LS shall monitor the monthly inventory of cases for quick monitoring and evaluation of disposition rate and inspectors performance.
