Terms and Conditions These Terms and Conditions explain your obligations concerning your use of the D.I.Y.

Easy Legals website. They apply to every purchase you make of anything through our system. It is important that you read and understand them. You cannot purchase anything from our website if you do not acknowledge that you have read and understood these terms and conditions. 1. Definitions In these Terms and Conditions the following words have the respective meanings: D.I.Y. Easy Legals means its agents, officers, shareholders, successors and advisers and we, our and us have a corresponding meaning. You means the person using our service, including a person using our service as agent of another person in which case you means the agent or the agents principal, or both the agent and the agents principal. Our service includes our website, the cloud interface, user system, and anything you download from our website or our cloud, and the services which we provide to you which are ancillary to those services. Product means any D.I.Y. Easy Legals software, document or other service which you order using our service. Access means access to a service by use of a browser and/ or with the aid of a Login. Compatible Computer means a computer that conforms to the system requirements of the Software as specified in the documentation. Computer means any device that is able to process data with the assistance of a programmable calculation specification. It includes any personal electronic device that accepts information in digital or similar form and manipulates it for a specific result based on a sequence of instructions. Consumer means any natural person who is provided with any product or services of D.I.Y. Easy Legals for personal or business use. Contract means any contract for sale and purchase of product or services between D.I.Y. Easy Legals and the customer. Customer means a consumer and/ or an Enterprise supplied with the product or services of D.I.Y. Easy Legals. Enterprise means any natural person, legal entity or partnership or other legal form having capacity that is not engaged in personal or familial usage in ordering or receiving

product or services of D.I.Y. Easy Legals while performing its commercial or independent professional or other work. Fee means the price or the license fee to be paid by the customer for products and services of D.I.Y. Easy Legals. Lawyer means an Australian legal practitioner, solicitor or barrister or a foreign legal practitioner duly authorised by the Supreme Court of any Australian State or Territory to practice law within Australia. License means the right of the customer to use the products and services subject to the standard business terms and conditions and in accordance with the relevant end user license and/ or service level agreement applicable as at the date of the conclusion of the relevant agreement. The License shall stipulate the nature and scope of the right to use the product or services. For those products for which an Update Service is provided, the License shall also constitute the right of the customer to receive ongoing Update/ Upgrades during the term of the License period, if any, for the software provided. Login means entering of identifier information into a Managed Service by customer in order to access that Managed Service. Master document or template means the master documents on which the documents you order are based, being the full library of possible text that could be included in your document depending on the information you provide when using our service. Merchant means a customer to whom products and services are provided expressly for the purpose of an onward or resale. Personal Computer or PC shall mean a hardware product which is designed and marketed with the primary purpose of operating a wide variety of productivity, entertainment, and other software applications provided by unrelated third party software vendors, which operates depending upon the use of a full function and full feature set computer operating system of the type(s) then in widespread use with hardware to operate general purpose laptop, desktop, server and large format tablet microprocessor based computers.

Professional adviser means a lawyer, accountant, registered tax agent or qualified financial advisor who can determine whether a document or product is appropriate or suits your needs for its legal, taxation and commercial implications. Service means a software application managed by D.I.Y. Easy Legals and deployed with a customer over the internet with or without the aid of a Login. Software Key means an encrypted code that identified the provided software and is necessary for installation and access to Updates/ Upgrade. The Software Key is an integral component of the software. By sending the respective Software Key, D.I.Y. Easy Legals grants the customer the right to use the software. Software means (a) all of the contents of the files (delivered electronically or on physical media), or disk(s) or other media with which this agreement is provided, which may include (i) D.I.Y. Easy Legals or third party computer information or software, (ii) related explanatory written materials or files (Documentation); and (iii) fonts; and (b) upgrades, modified versions, updates, additions, and copies of the foregoing, provided to you by D.I.Y. Easy Legals at any time (collectively, Updates). Support means a service which D.I.Y. Easy Legals offers to customers inquiring for help desk support for products or services. Terms means the terms and conditions set out in these terms and conditions, as amended, altered, updated or otherwise restated by D.I.Y. Easy Legals from time to time. Update and Upgrade means the updating of the software. Classification of the updating as an Update or Upgrade is at the sole discretion of D.I.Y. Easy Legals. Update Service means the ongoing updating of software through Updates and/ or Upgrades and the provision of such Update and Upgrades to the customer by D.I.Y. Easy Legals. Some Software may require the Update Service for functional use. D.I.Y. Easy Legals may at its sole and absolute discretion render services under its Update Service as an Update or an Upgrade. Use means to access, install, download, copy, or otherwise benefit from using the functionality of the Software. The singular includes the plural and vice versa. 4

A reference to currency on this website is a reference to Australian dollars. You agree that each of these definitions has the same meaning wherever they appear on our website.

2. Access and Fees D.I.Y. Easy Legals provides an online document creation service. Fees and charges are calculated on a pay as you use basis. Payment is required prior to the documents being published or downloaded. The payment method is described below and at the website checkout. If you use our service in any way, you will do so on the basis of the disclaimers on the relevant pages and in these Terms and Conditions as they apply at the time. Please read them carefully. D.I.Y. Easy Legals agrees to provide you with access to order products from our service on the condition that you accept these terms and conditions and pay our charges in the required way. Your access is not exclusive or transferable. The licence begins on the day you use our service, and ends in accordance with these terms and conditions. At the end of this page, you will be given the choice of accepting or rejecting the terms and conditions. If you accept them, you may use our service, including ordering products. If you reject them, you will not be able to use our service in that way. When you place your order for any product, you agree to read the relevant terms and conditions carefully. By clicking the Terms and Conditions Accept button you acknowledge: a. you have had the opportunity to review these terms and conditions of use before accessing or downloading any product;

b. you consent to be bound by the terms and conditions of use.

Together with any additional terms, conditions, notices and disclaimers contained on the D.I.Y. Easy Legals website, and through your continued use of the D.I.Y. Easy Legals 5

website, you acknowledge and agree that these terms and conditions of use constitute the rules and conditions of access to, use of and supply of information and products from the D.I.Y. Easy Legals website. All terms and conditions that govern your use of D.I.Y. Easy Legals (including disclaimers) may be amended by D.I.Y. Easy Legals from time to time.

3. D.I.Y. Easy Legals is not a Law Firm We provide general information only, it is not legal advice. This site provides general information about simple law together with forms, manuals and sample documents designed to help users safely cope with their own legal needs. It is not tailored to each individuals specific needs so be sure the information and the forms are suitable for your application. It is not the same as legal advice as provided by a legal practitioner. We have no knowledge of your personal circumstances. Although we go to great lengths to make sure our information is accurate, up-to-date and useful, we recommend you consult a lawyer if you want professional assurance that our information, and the way you are using it or interpreting it, is appropriate to your particular situation. h. the master documents are general purpose documents prepared by either legal practitioners or forms produced by relevant Local or State authorities. D.I.Y. Easy Legals is not in a position to endorse information, or authenticate commentary within those documents; D.I.Y. Easy Legals disclaims responsibility for them;

i. for our trade mark products, material provided by Australasian Online Legal Services Pty Ltd (ACN 148 899 950) is endorsed by D.I.Y. Easy Legals;


D.I.Y. Easy Legals disclaims responsibility for the information, commentary and content provided in local or State authority forms, and other documents provided as general samples;

k. your use of this website or any services it provides does not create a solicitor-client relationship between you and D.I.Y. Easy Legals;


you accept full responsibility for reading our website and our information guides, and then determining whether any particular D.I.Y. Easy Legals template is suitable for your particular purpose;

m. the document or service you choose to order is made at your own discretion, all decisions you make are your full responsibility.

4. D.I.Y. Easy Legals Customer Warranty D.I.Y. Easy Legals acknowledges that: a. it has taken all reasonable steps to engage legal practitioners to prepare the template documents and to ensure that they are accurate and appropriate for the general purpose of each document. Notwithstanding those efforts, D.I.Y. Easy Legals cannot guarantee those documents will fully suit your needs;

b. all your personal and billing information that is identifiable to you will be kept confidential, and will be protected by security identification systems and protocols. We will not disclose your information to anyone else without your consent or unless we are required to do so by law; and

c. the products you order through our service will, if relevant, be delivered electronically to you when you download them or when you choose to have us send them to you by email to your nominated email address;

d. you will have a licence to use the products that you order using our service but where copyright subsists in a particular product, that copyright will remain with the owner.

5. Disclaimer as to sites Continuing Functionality D.I.Y. Easy Legals does not make any representation or warranty that your access to this website will be secure, available or uninterrupted. D.I.Y. Easy Legals disclaims and will be liable for loss resulting from any interruption, delay or impairment in the functioning, operation or availability of the D.I.Y. Easy Legals website. Nor will D.I.Y. Easy Legals be liable for exposure to or for the transmission of any computer virus, internet access difficulties in connection with the D.I.Y. Easy Legals website, or the malfunction in equipment or software.

6. Client Obligations In relation to your use of our service and the products you order, you agree that: a. your access to the D.I.Y. Easy Legals cloud is limited to the creation of the documents for which you have paid and that once those documents have been ordered, your access to our cloud ends;

b. your access will be terminated if you breach any material obligations contained in these terms and conditions; and

c. if you breach any material obligation contained in these terms and conditions, then we may deny you any further access to our service.

d. you will not use any part of the documents in connection with creating another document;

e. you will not use any part of the products for any purpose except the specific purpose for which they were ordered;

f. you will not copy any part of the documents for any purpose except in relation to the transaction for which they were ordered;

g. you will not modify the products in any way after they are sent to you;

h. you will not interfere with, alter or attempt to copy or reproduce any part of our service or the products you order while using them;

i. you will not incorporate any part of our service in any other program, system or document creation package; and

7. Customer Acknowledges Certain Risks You assume the risk if you do not have your documents checked by a qualified legal practitioner. If you choose not to have your documents checked, you may have completed them inaccurately or inappropriately. You agree that D.I.Y. Easy Legals is not responsible for any mistake that you make in understanding the questions or how to answer them; or completing, using or filing a document; or obtaining or not obtaining a solicitors certificate for a document. You agree that you indemnify us in relation to any cost, loss, liability, or damage that you, your client, or a third party may suffer: a. because the document you order is not suitable for its intended purpose or does not suit the relevant circumstances; b. because you fail to obtain formal advice from a professional adviser concerning whether the document you choose is suitable for its intended purpose or is suitable for particular circumstances; Under no circumstances will D.I.Y. Easy Legals be liable to you for any indirect, incidental, special and/or consequential losses or damages or loss of profits of any nature arising (including but not limited to any act or omission by D.I.Y. Easy Legals) which result from unauthorised access to your internet transmissions or data.

8. Copyright and Intellectual Property All templates, manuals and other material provided by or downloaded from D.I.Y. Easy Legals are the exclusive property of Australasian Online Legal Services Pty Ltd (ACN 148 899 950) and are protected by copyright and other intellectual property laws. No part of it should be reproduced, adapted or communicated without the written consent of the copyright owner. Except where such use constitutes fair dealing under the Copyright Act 1968 (Cth) or where such use is mandated by the Copyright Act the information found on the D.I.Y. Easy Legals website may not otherwise be used, copied, reproduced, published, stored in a retrieval system, altered or transmitted in any form or by any means in whole or part without the prior written approval of D.I.Y. Easy Legals.


The download of these products is intended for your personal or business use but cannot be copied or resold. Any other use of the material downloaded from D.I.Y. Easy Legals is strictly prohibited. Users may not modify, transmit, publish, participate in the transfer or sale of, reproduce, create derivative works from, distribute, perform, display, or in any way exploit, any of the content of these products, in whole or in part. In relation to your use of our service and the documents you order, you agree that you must not copy any part of the documents for any purpose except in relation to the transaction for which they were ordered. You get no property right whatever in relation to our service, and no ownership in the copyright of the documents that you order. You are licensed to use them in relation to the transaction for which they were ordered and that transaction alone.

9. Privacy of Personal Information Your privacy is protected by the Commonwealth Privacy Act 1988. D.I.Y. Easy Legals protects the personal information D.I.Y. Easy Legals holds from misuse, loss, unauthorised access, modification or disclosure by various means including firewalls, pass word access, secure servers and encryption of credit card transactions. You have the right to seek access to the personal information held about you and to advise us of any inaccuracy. There are some exceptions to this right set out in the Privacy Act. D.I.Y. Easy Legals collects personal information from a variety of sources. We obtain most personal information through the D.I.Y. Easy Legals registration process. In general, the personal information D.I.Y. Easy Legals collects includes (but is not limited to) name, address, contact details and only where relevant for documents or payment purposes, financial information, including credit card information, banking details and income information. The D.I.Y. Easy Legals website uses cookies which contain information by which D.I.Y. Easy Legals can identify your computer on our server. You may configure your browser so that you are notified before a cookie is downloaded or so that your browser does not 11

accept cookies. D.I.Y. Easy Legals may use information contained in cookies to make assumptions about the user of the computer and to provide users of that computer with focused advertising that D.I.Y. Easy Legals believes may be of interest, based on that information. You can disable your cookies through your Internet browser. D.I.Y. Easy Legals endeavours to collect personal information about an individual only from that individual. In some circumstances D.I.Y. Easy Legals may obtain personal information about a third party. If you provide personal information about another person to D.I.Y. Easy Legals, D.I.Y. Easy Legals requires that you inform that person you have done so and provide them with a copy of this policy. D.I.Y. Easy Legals may use information it collects from you for other secondary purposes that are related to the primary purpose. D.I.Y. Easy Legals generally uses personal information to: a. help D.I.Y. Easy Legals manage and enhance its services; b. communicate with you about your purchases; c. review advice for consistency and quality purposes.

10. Method of Payment Our standard arrangement is for you to pay us online by credit card through the Commonwealth Banks online payment system. Our system will transfer you to that site when you click the relevant button. The Commonwealth Bank system should return you to the relevant page on our website after your transaction.

11. Return and Cancellation Policy

a. Reasons why a sale might be reversed

At times, we may reverse a sale in order to comply with: credit card industry rules, PayPal terms of service, Australian prudential regulators, and requests from verified judiciary or law enforcement agents.


b. D.I.Y. Easy Legals return policy

D.I.Y. Easy Legals has every incentive to keep customers happy by providing quality products and technical support. Generally, D.I.Y. Easy Legals does not give refunds. When a customer reaches us by phone or email, our first response is to offer technical support for the product. The questionnaire process by which customers fill out their online documents is comprehensive. Customers may view their documents online prior to down-load. Customers are provided with a 7 day window to either: accept, modify or reject the document they have created. The customer is fully responsible for their own review process and for deciding whether to proceed with the purchase. Once a document has been paid for and down-loaded, the transaction is complete.

In exceptional circumstances, customers requesting a return within 7 days of purchase may be approved by our customer service team if the customer provides suitable evidence that their case merits a return. In some cases a product may be unsatisfactory to the customer for reasons completely beyond our control in which case a cancellation or a refund may be processed. D.I.Y. Easy Legals will, at its discretion, allow for the return or replacement of any defective product within 7 days from the date of purchase. Customers who identify flaws within our products will be eligible for future credits not exceeding three times their initial purchase. Please note; refunds can only be credited back to the account used to make the original purchase. If the original account has been closed, the purchase will not be eligible for refund.


e. D.I.Y. Easy Legals cancellation policy for recurring billing products

The customer may cancel their recurring billing subscription products at any time through written confirmation or by deregistering online following our unsubscribing procedures and entering their security details.

f. Secondary Vendors

Approved secondary vendors requesting a return within 7 days will be directed to administrative support. Secondary vendors may request a return of any purchase up to 7 days after the date of purchase provided they supply suitable evidence that their case merits a return. 12. Miscellaneous Matters

D.I.Y. Easy Legals retains the right to prohibit anyone from using its websites or downloading D.I.Y. Easy Legals Material at its discretion. D.I.Y. Easy Legals may amend sections and add, replace, or remove forms or documents without notice. This agreement cannot be assigned. The invalidity or unenforceability of any provision of these Terms or the Sites Disclaimer will not affect the validity or enforceability of any other provision of these Terms or the Sites Disclaimer and such invalid provision will be deemed to be severable. The Terms and the Sites Disclaimer constitute the whole agreement between you and Australasian Online Legal Services. No failure or delay, on the part of D.I.Y. Easy Legals, in exercising any right or power under these Terms will operate as a waiver of such right or power.
