EEOC PRESENTATION EEOC Presentation From the history of the United States up until now, equality has been a milestone for

some while a success for others. Thankfully the Equal Employment Opportunity Commission (EEOC) is an organization that strives to protect employees that are unequally treated by employees or employers. The EEOC protects all people no matter neither what work environment they work in nor what situation it is. Because of the unfailing assistance of the EEOC, employees such as a group of black female therapists from Jackson Park Hospital will never have to accept being discriminated against in the place in which they work. Jackson Park Hospital in Chicago, IL had a lawsuit filed against them that ruled Race Discrimination and Retaliation against black female employees. In this lawsuit, the hospital exposed a class of black female employees to different terms and conditions of employment and segregation in job assignments because of their race and gender. In addition, a couple of the women were demoted in retaliation for speaking up about the unlawful employment mistreatment. According to John Rowe, director of EEOCs Chicago District, administration at Jackson Park Hospital required a particular group of female employees to perform assignments that their male counterparts who were not black did not have to perform. In a recent article published in the Chicago Tribune in relation to this lawsuit, EEOC attorney June Wallace Calhoun states that one of the respiratory therapist who felt she had been retaliated against, came to the EEOC, which investigated and ruled that the complaint merited a lawsuit. In further investigation, Calhoun came to understand that in this hospital, the respiratory therapists were either Asian men or black women. The women were required to perform electrocardiograms, that required touching the bare chest of a patient, while the men did not have to because they felt uncomfortable touching the bare chest of female patients. Calhoun was told that there were language barriers but learned that all the employees were English speakers.

EEOC PRESENTATION The lawsuit requires that a judge mandates the Jackson Park Hospital to cease the alleged discrimination, provide back pay, interest and damages to the respiratory therapist who was allegedly demoted and to compensate the hospitals black female employees.

In this case of discrimination, the U. S. Equal Employment Opportunity Commission is responsible for enforcing laws that make it illegal to discriminate against a job applicant or an employee because of race, sex, color, religion, age, disability or genetic information. The EEOC also protects those who file a lawsuit, participate in a lawsuit or complain about discrimination from retaliation. This law applies to all types of work environments and work situations such as: hiring, firing, promotions, harassment, training etc. The EEOC has the right to investigate charges of discrimination against employees who are covered by the law. The EEOC also works to prevent discrimination before it happens through outreach, education, and technical assistance. In relation to the lawsuit against Jackson Park Hospital in Chicago, IL for Race Discrimination and Retaliation, the EEOC has a great impact on this lawsuit. The role that EEOC and EEOC Administration performed in this lawsuit is basically ensuring equality. According the functions of the EEOC, their main purpose is to provide quality for all. The EEOC made sure that they investigated the discrimination before they ruled the actions as discriminatory. After the lawsuit was filed, EEOC made sure that they attempted to reach a prelitigation settlement through their conciliation process. Since their first attempt made no progress, the case was assigned to local judges and attorneys to solve the case.

EEOC PRESENTATION In a world where many issues cause some type of effect of change negatively or positively, there has to be an awareness that yes, issues in the workplace and in our society,

promotes social change. Going back to the lawsuit against Jackson Park Hospital, the actions of discrimination against the black female employees encourages a positive change. In the history of slavery, blacks had no voice and no freedom. They were owned by slave owners that saw them as less than capable of reading, writing and gaining knowledge of themselves and their value. After fighting for freedom, blacks gained control over their existence and began to thrive among their societies. Because of the trouble that their black ancestors had to face to inherit freedom, blacks are able to today to stand up against any sign of discrimination just because of their color. Any incident that includes discrimination causes change in the workplace, the proposed society and community where the unfair actions took place. It is what changes our world from what was, to what is now. In accordance to the EEOC and many laws to protect confidential information of clients, everything that is filed within lawsuit has to be kept private until investigation is over and it is lawful to release certain information about the incident and the employees involved. The article on the EEOC website, gave basic information about the reason why the lawsuit had been filed; Discrimination and Retaliation of Color and Gender. The EEOC stated that the director of the EEOC Chicago District, John Rowe, had gained knowledge that the female employees involved in the lawsuit had to perform certain duties that their male counterparts did not have to but did not explain what those duties were. The Chicago Tribune gives practically everything in detail about the employees discriminatory actions. The female therapist had to perform electrocardiograms on patients when the males did not. Later in the news EEOC administration was able to conclude that the argument that the male Asian male employees made were that they felt uncomfortable touching female employees because they were bare chested. Although there

was more detailed information in the news article that explained the actions of discrimination, both the EEOC and The Chicago Tribune delivered the same perspectives behind the lawsuit. In an incident such as discrimination in the workplace there are so many things that leadership has to handle in order to maintain stability within their employees and work environment. In the situation that the women employed at Jackson Park Hospital encountered, the management department must incorporate classes and training on discrimination, stereotypes and racism in order to keep balance within the workplace. It is a priority that every employee in a company or business is created equal and included entirely. Mandatory work ethic and diversity training must be in effect to remind all employees that the reason why the world so diverse is because the differences of people that we live with, go to school with and work with make it possible. It is imperative that everyone whether, black, white, tall, short, male or female receive the same treatment that the entire world deserves.
