Dear Barl,
Since my last visit to your office on 09/12/1996, I have acquired historical documentation and tribal records
regarding the ¥2 degree Indian blood quantum of my great grandmother, Julienne Dubois Pilon Jetty.
Julicnne’s death certificate states that the community she resided in for forty years was within the boundaries
of the Devils Lake Sioux Reservation. She died on September 22, 1941, five years prior to the adoption of the
“Constitution and Bylaws of the Devils Lake Sioux Tribe, North Dakota, Approved on February 14, 1946,
Therefore, her name does not appear on the official Census Roll of the Tribe as of January 1, 1944 as referred
to in Article I-Membership of this document. However, her name does appear on the Census Roll of the
Devils Lake Sioux, June 30, 1904. The Turtle Mountain Indian Reservation tribal records indicate that she is at
least % degree Indian blood as documented in the attached “Descendents of Julienne Dubois”.
A particular statement found in “The Indian Reorganization Act” reads: “and shall further include all other
persons of one-half or more Indian blood.” According to this document, Julienne Dubois Pilon Jetty would
have been recognized as ¥ degree Indian blood from June 1, 1934 until her demise on September 22, 1941
while she resided “within the present boundaries of any reservation”. Please note the following statement:
“Amendments to the Wheeler-Howard Act, une 18, 1934 (The Indian Reorganization Act) Sec, 19.
The term "Indian" as used in this Act shall include all persons of Indian descent who are members of
any recognized Indian tribe now under Federal jurisdiction, and all persons who are descendants of
such members who were, on June 1, 1934, residing within the present boundaries of any Indian
reservation, and shall further include all other persons of one-half or more Indian blood. For the
purposes of this Act, Eskimos and other aboriginal peoples of Alaska shall be considered Indians. The
term "tribe" wherever used in this Act shall be construed to refer to any Indian tribe, organized band,
pueblo, or the Indians residing on one reservation. The words "adult Indians" wherever used in this Act
shall be construed to refer to Indians who have attained the age of twenty-one years.”
In conclusion, she was recognized as ¥4 degree Indian blood during her lifetime while residing within the
boundaries of the Devils Lake Sioux Reservation according to “The Indian Reorganization Act”. Her Indian
blood quantum was not recorded in the 19444 Devils Lake Sioux Tribal enroliment records because she died in
1941, before the adoption of the Constitution and Bylaws in 1944, Her demise does not take away the Indian
blood quantum inherited by her descendents as shown on the “‘Six Generation Chart & Family History Notes.
‘Therefore, please correct my Indian blood quantum to read ¥4 degree Tndian blood quantum as verified by both
tribal historical records and Certified DNA genetic testing. Thank you for your consideration of this matter.
