8SeptemberProsecutorMorenoOcamporequestedthatINTERPOLissueRedNoticestoarrestMuammarGaddafi,SaifAl IslamGaddafiandAbdullahAlSenussifortheallegedcrimesagainsthumanityofmurderandpersecution. INTERPOL SecretaryGeneral Ronald Noble confirmed the effectiveness of the Red Notices, stating Prosecutor Moreno Ocamposrequest forINTERPOLRedNoticeswillsignificantlyrestricttheabilityofall threementocrossinternationalbordersandisa powerfultooltohelpintheirlocationandarrest.Hefurther confirmedthatasfarasINTERPOLsGeneralSecretariatheadquartersis concerned,MuammarGaddafiisafugitivewhosecountryofnationalityandtheICCwantarrestedandheldaccountablefortheserious criminal charges that have been brought against him.INTERPOL will cooperate with and assist the ICC and Libyan authorities representedbytheInterimTransitionalNationalCouncilofLibyatoapprehendMuammarGaddafi. Prosecutor MorenoOcampo explained his decision to request the notice, stating Arresting Gaddafi is a matter of time. By requestinganINTERPOLRedNoticetheICCensuresthatthearrestwarrantforGaddafiisinthehandsoflawenforcementaroundthe world. The Red Notices have been circulated to all 188 INTERPOL members and INTERPOL is offering the full support of its CommandandCoordinationCentreandaskingitsmembercountriestotakeallmeasuresconsistentwiththeirnationallaws tohelptheICClocateandapprehendGaddafi. States Parties also continued to confirm their commitment to cooperation with the ICC; with UK Foreign Secretary William Hague stating if[MuammarGaddafi]hadgonetoacountrywhichisasignatoryoftheICCofcourse,wewouldexpectthemtohand himovertotheICC.TheheadofPresidentMahamadouIssoufouscabinetalsoconfirmedthatNigerwouldrespectitsRome StatuteobligationsinrelationtotheLibyanarrestwarrants,statingWearesignatoriesoftheRomeStatute,sotheyknowwhatthey areexposedtoiftheycome.Nigerisacountryofrightsbutwewillalsorespectourinternationalcommitments.

I.PreliminaryExaminations
PreliminaryexaminationsrefertotheanalyticalprocessbywhichtheOTPassesseswhetherthereisareasonablebasistoproceedwithan investigationinagivensituation. In accordance with Article 15 of the Statute, the OTP proactively gathers and evaluates information from multiple sources, including communicationsfromindividualsandpartiesconcerned(phase1initialreview).Followingasequentialprocess,andirrespectiveofthe mechanism by which the jurisdiction of the Court is triggered, the Office then applies the same legal criteria laid out in Article 53 of the Statute, namely temporal/territorial/personal jurisdiction (phase 2a), subjectmatter jurisdiction (phase 2b), admissibility, including complementarityandgravity(phase3)andtheinterestsofjustice(phase4). Currently, the OTP is conducting preliminary examinations into nine situations: Palestine (phase 2a), Afghanistan, Honduras, Korea and Nigeria (phase 2b), Colombia, Georgia and Guinea (Phase 3); the Prosecutor has further determined that the opening of an investigation wouldnotbeagainsttheinterestsofjusticeinCtedIvoire(phase4)andisawaitingauthorizationfromPreTrialChamberIIItoinvestigate thesituationinCtedIvoire.

11 communications that may fall under Article 15 were received by the Office in the month of August. 4 of these communicationsweremanifestlyoutsidethejurisdictionoftheCourt;6communicationswarrantedfurtheranalysisorwere linkedtoasituationalreadyunderanalysis.1waslinkedtoanongoinginvestigation/prosecution.ThetotalnumberofArticle 15communicationsreceivedtodateis9,247,ofwhich4,327weremanifestlyoutsidethejurisdictionoftheCourt.
13 September The Center for Constitutional Rights (CCR) representing the Survivors Network of those Abused by Priests contacted the OTP and presented its followup communication (the first one had been submitted in May 2011) on alleged crimes against humanity committed by Vatican officials, including rape, sexual violence, and torture. The communication claimsthatVaticanofficialshavetoleratedandenabledthesystematicandwidespreadconcealingofrapeandchildsexcrimes throughouttheworld.Togetherwiththecomplaint,theCCRsubmittedmorethan20,000pagesofsupportingmaterials.

12 September The Prosecutor filed observations on the need for a Judicial Site Visit in the case of TheProsecutorvGermainKatangaand MathieuNgudjoloChui, submitting that a Judicial Site Visit to the Bogoro area of the DRC was unnecessary at this stage as the evidence tenderedbytheProsecutionregardingthegeographyoftheareawassubstantial,clearanduncontested.TheProsecutionfurthersubmitted thatthedefencesadvancedthusfarbytheAccuseddonotappeartocontesttheevidenceregardingthegeographyand,inparticular,thatportionof thetestimonyofwitnessesthataddressestheirdescriptionsoftheareawheretheBogoroattackoccurred.TheProsecutionalsosuggestedthatsecurity concernswouldbesubstantialandoutweighedanyneedforasitevisitatthistime.
