With regard to the purchase of 65 F-35(A) fighter jets for future use in the Canadian Forces: (a) when and on how
many occasions did the Department of National Defence (DND) submit a justification for "the legal authority to use
an exception ta competitive bidding", as is required in section 3.15[a] of the Treasury Board Guideline; and (b) for
each submission, referenced in the govemment's response ta part (a) ofthis question, that utilized the exception ta
competitive bidding found under section 3.15[a][iv] of the Treasury Board Guidelines, whatjustification is provided
that would allow the government and DND to consider the F-35(A) as the only aircraft capable of meeting aIl of the
department's high-level mandatory requirements for this procurement project despite the department's knowledge
that the F-35(A) cannot meet the mandatory requirement pertaining ta air-to-air refuelling?

The information below is provided by the Department of National Defence, in consultation with Public Works
and Government Services Canada.
(a) When and on how many occasions did the Department of National Defence (DND) submit a
justification for "the legal authority to use an exception to competitive bidding", as is required
in section 3. 15[a} of the Treasury Board Guideline?
The Government Contracts Regulations (GCRs) require the competitive soliciting of bids before any
contract is entered into; however, contracts may be entered into without soliciting bids when:
(i) the need is one of pressing emergency in which delay would be injurious to the public interest;
(ii) the estimated expenditure does not exceed $25,000;
(iii) the nature of the work is such that it would not be in the public interest to solicit bids; or,
(iv) only one person is capable of performing the contract.
ln accordance with the GCRs, and as outlined in Section'3.15 of Chapter 3 of the Public Works and
Government Services Supply Manual, on 1 June 2010 DND provided the rationale for a potential exception

to competitive procurement in that there is only one entity capable of providing a fighter capability that
meets ail of the Next Generation Fighter Capability mandatory requirements, specifically Lockheed Martin
and its F-35A Joint Strike Fighter. PWGSC validated that assertion with a market review and also
concluded that only one entity (Lockheed Martin) can provide a fighter capability meeting ail of the
Canadian Forces' mandatory requirements and that this exception is in accordance with the Government
Contract Regulations exception (iv) above. This information was incorporated into the documentation
provided to the Government of Canada regarding potential procurement options for the Next Generation
Fighter Capability project.
(b) For each submission, referenced in the government's response to part (a) of this question, that
utilized the exception to competitive bidding found under section 3. 15[aJ[iv] of the Treasury
Board Guidelines, what justification is provided that would a/low the government and DND to
consider the F-35(A) as the only aircraft capable of meeting ail of the department's high-Ievel
mandatory requirements for this procurement project despite the department's knowledge that
the F-35(A) cannat meet the mandatory requirement pertaining to air-to-air refue/ling?
The F-35A is the only aircraft that meets ail of the Canadian Forces' mandatory requirements for the Next
Generation Fighter Capability, including the capability to receive fuel in-flight to extend range and
endurance, as stated in the high-Ievel mandatory capabilities for Canada's Next-Generation Fighter.

(a) Quand et combien de fois le ministre de la Dfense nationale (MDN) a-t-il prsent une

Conseil du Trsor?
Le Rglement concernant les marchs de l'tat exige qu'un appel d'offres concurrentiel soit lanc avant de
conclure un march. Or, il est possible de conclure un march sans lancer d'appel d'offres dans les cas
suivants:
(i) les cas d'extrme urgence o un retard serait prjudiciable l'intrt public;
(ii) les cas o le montant estimatif de la dpense ne dpasse pas 25 000 $;

(iii) les cas o la nature du march est telle qu'un appel d'offres ne servirait pas l'intrt public;
(iv) les cas o le march ne peut tre excut que par une seule personne.
Conformment au Rglement concernant les marchs de l'tat et la section 3.15 du chapitre 3 du Guide
des approvisionnements de Travaux publics et Services gouvernementaux Canada, le ministre de la
Dfense nationale a justifi, le 1

juin 2010, une exception potentielle l'achat concurrentiel, car il n'y a
qu'une seule entit capable de fournir un chasseur qui satisfait toutes les exigences obligatoires du
chasseur de la prochaine gnration, soit Lockheed Martin et son avion d'attaque interarmes F-35A
TPSGC a ralis un examen du march qui a valid cette assertion et a amen TPSGC conclure que
seul Lockheed Martin peut fournir un chasseur qui satisfait aux exigences obligatoires des Forces
canadiennes, conformment l'exception au rglement susmentionne (iv). Ces renseignements
paraissent dans les documents portant sur les options d'achat potentielles fournis au gouvernement du
Canada dans le cadre du projet du chasseur de la prochaine gnration.

d'accrotre son rayon d'action et son autonomie, tel qu'indiqu dans les capacits obligatoires de haut
niveau pour le chausseur de la prochaine gnration du Canada.

(a) The Department of National Defence (DND) presented the justification once, on
June 1, 2010, to formally confirm in writing the requirement for a fifth generation fighter
capability and to confirm that the Department knew of only one entity available to Canada,
capable of meeting the requirement for a fifth generation fighter aircraft and that will assure
Canada remains interoperable with its major allies, including the United States of America.
PWGSC submitted this justification for legal consideration pursuant to an exception under
the Government Contracts Regulations (GCR's).
(b) With regard ta the purchase of 65 F-35 (A) fighter aircrafts, the federal government
acquisition process was followed. It was alsa confirmed that the procurement process
utilized is in accordance with government procurement policies:

As requested by PWGSC, a Legal Review of the requirements was performed and confirmed
that Canada could reasonably rely on one exception under the Government Contract
Regulations, namely: only one person is capable of performing the contract.
On June 1, 2010, the Assistant Deputy Minister(Materiel) of DND formally confirmed in
writing the requirement for a fifth generation fighter capability and to confirm that the
Department knew of only one entity available to Canada, capable of meeting the requirement
for a fifth generation fighter aircraft and that will assure Canada remains interoperable with its
major allies, including the United States of America. PWGSC submitted this justification for
legal consideration pursuant to an exception under the Govemment Contracts Regulations
(GCR's).
PWGSC has validated the above assertion with a market review. PWGSC concurred that
only one entity can provide a fifth generation fighter aircraft meeting DND's requirement
and that this exception is in accordance with the Government Contracts Regulations. --------------------------

juin 2010, par laquelle il a t confirm formellement par crit les exigences pour des avions de
combat de capacit de la cinquime gnration et que le Ministre ne connaissait qu'une seule
source disponible pour le Canada, ayant la capacit de rencontrer les exigences pour un avion
de combat de capacit de la cinquime gnration qui assurera que le Canada demeure
interoprable avec ses allis principaux, dont les tats-Unis d'Amrique. TPSGC a soumis cette
justification pour un avis juridique concernant les exceptions en vertu du Rglement sur les
