the sensor is located no more than eighteen (18) inches above the treated wastewater. The explosion hazard monitoring equipment at Monitoring Point 002 shall be further equipped so that, upon a reading of 10% LEL or greater, all discharge to the sanitary sewer system shall be immediately and automatically terminated. Discharge may resume only after permission is granted by the Metro District. Cessation of discharge reporting requirements are contained in Section F of this permit.

The permittees shall provide sufficient and ready access to allow measurements and readings to be taken from Monitoring Points 001, 002, and 003, and to allow the collection of grab and composite samples from Monitoring Point 001.

The permittees shall allow representatives of the Metro District to independently utilize these facilities to collect samples or take measurements or readings. The permittees shall ensure that the monitoring facilities remain in satisfactory condition. The permittees shall also provide representatives of the Metro District with any assistance and technical information required to operate the facilities. Failure to maintain these facilities may result in the costs of Metro District monitoring events being passed along to the permittee, if the condition of the facilities prevents successful monitoring.

D. 1.

EFFLUENT LIMITATIONS Specific Effluent Limitations

The permittees are required to conform to all local limitations as described in the Metro Districts Rules and Regulations referenced in Section D.2 and contained in Appendix A of this permit and the site-specific effluent limitations listed below. Monitoring Point 001

Any single analysis and/or measurement beyond this limitation shall be considered a violation of the conditions of this permit.

Compliance with this limitation shall be determined by either the arithmetic average of (1) all grab samples collected during discharge from process operations over a 24-hour period, or (2) all composite samples collected during discharge from process operations over a 24-hour period. If both sample types (grab and composite) are collected over the same 24-hour period, compliance shall be determined by the highest averaged value, To allow for fluctuations in discharge flow rate, pollutant limitations were developed for 20, 25 and 30 gallons per minute (gpm). The daily limits at 20 gpm apply to all discharges with a daily average flow less than or equal to 20 gpm; 25 gpm limits apply to all discharges with a daily average flow greater than 20 and less than or equal to 25 gpm; and 30 gpm limits apply to all discharges with a daily average flow greater than 25 and less than or

Additive Limit is defined as the sum of the concentrations of 11dichloroethane, 1 ,1 -dichloroethylene, 1,1,1 -trichloroethane, 1,1,2trichloroethane, 1 ,1 ,2,2-tetrachloroethane, 1 ,2-dichloroethane, 1,2dich loroethene (trans), acrylonitrile, benzene, carbon tetrachioride, chloroform, methylene chloride, tetrachloroethylene, trichloroethylene, and vinyl chloride.

BETX is defined as the sum of the concentrations of benzene, ethylbenzene, toluene, o-xylene, m-xylene, and p-xylene. Any two (2) BETX analyses, within a period of six (6) months, exceeding 750 ug/L or any single analysis reaching or exceeding 7.5 mg/L shall result in one of the two options described in Paragraph (I) below.

(f)

Not withstanding this numeric limitation, effective January 1, 2007, discharge from cooling towers, boilers, closed-loop heat transfer systems and any other cooling/heating system treated with molybdenum-containing water treatment chemicals is prohibited entirely. Where necessary, the Metro District may require that these wastes be physically prevented from discharging into the sanitary sewer system.

(g)

As per the Colorado Basic Standards and Methodologies for Surface Water 3.1.0 (5 CCR 1002-8) the radioactivity of surface water shall be maintained at the lowest practical level, not to exceed certain numeric standards. Compliance with these requirements shall be achieved by limiting the permitted discharge to the applicable radiochemical concentrations, which represent determinations of the lowest practical level or the calculated risk based limitations depending on discharge flow rate associated with specific numeric standards. (h)

Any single analysis and/or measurement beyond this limitation shall be considered a violation of the conditions of this permit, except that it will not be considered a violation of the permit when the permit limit lies within the uncertainty range as measured by the reported counting errors for each particular analysis. The Metro District reserve the right to specify maximum counting errors and/or minimum counting times, as appropriate, for radionuclide analyses. Compliance with this limitation shall be determined by the arithmetic average of all composite samples collected during discharge from process operations over a 24-hour period.

(i)

Per 40 CFR 141.26(b)(1), gross beta activity is used to demonstrate compliance with the beta particle and photon radioactivity drinking water standard used to derive this effluent limitation.

The limitation on explosion hazard applies at Monitoring Point 002, and at any point downstream in the sanitary sewer system where explosion hazard may be reasonably attributed to the discharge as described in this permit. In the event there is a single reading of more than 10% LEL at Monitoring Point 002, the Metro District shall determine, to its satisfaction, that the reading was caused by actual discharge and not by equipment malfunction, electrical power fluctuation or other similar circumstances beyond the capability of the equipment or site operator to control. The Metro District shall then have the option to: (1) revoke the permit; or

(2) require the permittees to cease discharge until such time as the treatment system is upgraded to a level that will prevent recurrence, 2. Prohibited Discharges

Unless otherwise provided above, Sections 6.17 and 6.18 of the Metro Districts Rules and Regulations shall govern all discharges to the Publicly Owned Treatment Works (hereinafter referred to as the POTW) during the term of this permit. The POTW includes City and Metro District sewer lines and treatment plants. 3. Additional Limitations

Additional limitations may be developed by the Metro District at any time, based upon a determination that the permittees do not have the capability to adequately treat the discharge. or the potential exists for jeopardizing the Metro Districts treatment operations or compliance status with all applicable regulations, the environment worker/public health and safety, or for any other reasons.

All equipment, instrumentation and ancillary devices used to comply with the provisions of this permit must be maintained and calibrated according to the manufacturers specifications. Manufacturers specifications must be kept on-site or made available within five (5) working days for inspection. At the discretion of the Metro District and after written notification to the permittees, explosion hazard and discharge flow monitoring equipment and ancillary devices will be required to be calibrated at a specified frequency, andlor automatic system shutdown at or above 10% LEL will be required to be verified monthly. The permittees are required to record all maintenance, calibration activities and tests. These records must be kept on site or made available within five (5) working days for inspection. Compliance with the limitations for organic compounds shall be determined by samples collected using procedures contained in Appendix B of this permit. Failure to collect the minimum number of samples at the frequency specified is considered a violation of the terms of this permit. Definitions:

Unless specifically stated otherwise, all samples must be handled, preserved and analyzed according to Title 40, Part 136 of the Code of Federal Regulations (40 CFR 136), Guideilnes Establlshing Test Procedures for the Analysis of Pollutants under the Clean Water Act, and amendments thereto. 1.

A grab sample is defined as an individual sample collected over a period of time not to exceed 15 minutes, and collected so as to be representative of the wastewater at the moment of sampling and of the parameter being monitored.

A flow composite (Flow-Comp) sample is defined as a single sample composited from a minimum of four (4) grab samples collected at equally spaced intervals over a 24 hour period, and proportioned according to flow, or a minimum of four successive samples collected over a 24 hour period by an automatic sampler set in the flow-proportioned mode and run in conjunction with a continuously monitoring flow meter. Each grab sample or each successive sample collected automatically must be preserved according to 40 CFR 136. (c)

The analytical procedures used in the analyses of samples collected for selfmonitoring purposes for the referenced pollutants shall have reporting limits equal to or less than those listed. If approved reporting limits are not achieved, and compliance with any effluent limitations contained in Section D of the permit cannot be determined. resampling and analysis must be performed. Self-monitoring analytical results that are less than the reporting limits listed shall be considered to be zero for compliance purposes. For radionuclides, the limits are reporting limits calculated in accordance with the Minimum Detectable Concentration (MDC) protocol described in Upgrading Environmental Radiation Data, EPA 520/1-80-012, rather than method detection limits.

Chronic toxicity tests shall be conducted in accordance with the latest revision of Short Term Methods for Estimating the Chronic Toxicity of Effluent and Receiving Waters to Freshwater Organisms, Fourth Edition, EPA-821-R-02-013, the Region Vlll EPA NPDES Chronic Test Conditions Static Renewal Whole Effluent Toxicity Test. Test species shall consist of Ceriodaphnia dubia and fathead minnows, At a minimum, the tests shall be run at a dilution of Lowry effluent: dilution water, made in accordance with the above EPA guidance, of 1 :750.

There shall be no chronic toxicity to the survival or reproduction of Ceriodaphnia dubia or to the survival or growth of fathead minnows at or below the effluent dilution ratio of 1 :750. Chronic toxicity occurs when the survival, growth or reproduction for either test species, when exposed to a dilution less than or equal to 1:750, is significantly less (at the 95/a confidence

At the discretion of the Metro District, the permittees will be required to perform additional WET testing, for the failed species, to confirm the presence of chronic toxicity, conduct a Preliminary Toxicity Investigation (PTI) and/or undertake a Toxicity Reduction Evaluation (TRE)/Toxicity Identification Evaluation (TIE) to establish the cause of the chronic toxicity, and develop control of, or treatment for the chronic toxicity. Discharge may not resume without permission from the Metro District.

At the discretion of the Metro District, and upon written notice to the permittees, additional WET self-monitoring may be required at any time to verify the absence of chronic toxicity. (h)

Samples collected by the Metro District may be used to fulfill this monitoring requirement. It is the responsibility of the permittees to ascertain whether or not the Metro District has successfully monitored for this parameter during the calendar year.

(i)

Temperature must be continuously monitored and recorded over a 24 hour period, one day a week to ensure the discharge temperature does not exceed an average of 20C over any duration of fifteen minutes or longer.

Test Procedures

Unless specifically stated otherwise, test procedures for the analysis of pollutants shall conform to the analytical techniques described in 40 CFR 136. Where 40 CFR 136 does not contain sampling or analytical techniques for the pollutant(s) in question, or where the Administrator of the United States Environmental Protection Agency determines that the Part 136 sampling and analytical techniques are inappropriate for the pollutant(s) in question, sampling and analysis shall be performed by using validated analytical methods or any other applicable sampling and analytical procedures, including procedures suggested by the Metro District, or other parties, approved by the Administrator. Appendix C contains a list of pollutants that do not have any analytical procedures approved by 40 CFR 136, along with the analytical procedures that must be used for those analyses, If an alternative method is preferred, a written request describing the alternative method must be submitted to the Metro District for approval. Alternative methods may not be used until approval is granted by the Metro District.
