CODE OF ETHICS FO0R BAC OBSERVERS

An Effective BAC Observer

• Partners with Government Entity to ensure transparency and assist in the


improvement of the entity’s procurement system.
• Adopts a systemic approach to combating corruption in public procurement.
• Recognizes that corruption, and not Government is the enemy.
• Avoids “witch hunting”.

the part of the BAC observers

belongs;
• Solve the ethical dilemmas BAC observers may face while carrying out their

• BAC observers avoid accusations of conflict of interest and corruption;

Diagnostic Report Writing and E-Reporting

OBSERVERS

• Section 13.1 – In addition to COA representative, two (2) observers may be


invited:

- At least one (1) shall come from duty recognized private group sector or
discipline relevant to procurement at hand;

- The other observer shall come from non-government organization (NGO)

CRITERIA

• Section 13.2 – shall come from an organization duly registered with the Securities
and Exchange Commission (SEC)
- Must have knowledge, experience or expertise in procurement or in the
subject matter of the contract to be bid;
- Absence of direct or indirect interest in the contract to be bid; and
- Any other criteria that may be determined by the BAC

RESPONSIBILITIES OF OBSERVERS

Section 13.4
• Preparation of report
- Head of procuring entity or Local Chief Executive, copy furnish BAC
Chairman;
- In cases on deviation, may submit a copy of report to the Office of the
Ombudsman
• Sign the abstract bids; and
• Sign the post-qualification summary report

DIAGNOSTIC REPORT

• Must be concise,
• Accurate, and
• Cite relevant provisions of the Law and its IRR

• Copy of Newspaper advertisement;


• G-EPS Reference number;
• Bid Documents including Supplement/Bid Bulletins;
• Eligibility, Technical & Financial Checklists;
• Attendance Sheet
• List of Bidders who Secured Bid Documents
• List of Participating Bidders

ADDITIONAL DOCUMENTS

• Minutes or related proceedings of BAC meetings;


• Abstract of Bids;
• Post-qualification summary report;
• APP and related PPMP; and
• Copies of “opened” proposals
