Re: Inteilectual Property Rights of ZeniMax Media Inc.
Dear Sir or Madam: Our firm is counsel to ZeniMax Medla Inc. and its related companies (collectively, "ZeniMax") with respect to its inteHectual property matters. As you may know, ZeniMax is a leading video game publishing company, and the owner of the world famous video game series The Elder ScroUs ("TES"). in connection therewith, ZeniMax is the owner of numerous related trade/service marks, inciuding THE ELDER SCROLLS, registered in association with video games, motion pictures, printed pubiications, clothing and other related goods and services, under U.S. Trademark Reg. Nos. 1943732, 2634683, 354564, 3375520, 3421731, and 2861127, U.S. Trademark App. Ser. No. 77635645, and European Community Trademark Reg. Nos. 2840098 and 8283161, among others (the "TES Marks"). These holdings also inciude Registrations and pending Applications for the TES Marks in a iarge number of other jurisdictions around the world, inciuding Australia, Canada, Hong Kong, india, Japan, Malaysia, New Zealand, and South Africa, among others. A complete listing of such Registrations and pending Applications is attached hereto as Exhibit A. The above-identified intellectual property is very valuable to ZeniMax. As a result, ZeniMax has developed specific guideiines relating to any and all uses of its inteliectual property and proactively and arduousiy regulates any such authorized (and unauthorized) use of the same. It has recently come to our attention that, despite ZeniMax's rights in the TES Marks, Mr. Persson, Mojang AB, Notch Development AB and/or a related organization (coilectively, "Mojang") apparently plan to develop a fantasy-themed video game under the title "SCROLLS."See Exhibit B. We also note that Notch Development AB currently owns pending European Community Trademark Application No. 9728321 for the mark SCROLLS for use in connection with computer games, as weil as other related goods and services. We believe that such proposed use of the term SCROLLS infringes on ZeniMax's valuable intellectual property rights and is highiy likely to cause confusion concerning the origin, association and sponsorship of the proposed video game. Moreover, as you are likely aware, The Elder Scrolis series is composedof fantasy role-playing games. Therefore, there is an extremeiy high iikeiihood of of overlap between ZeniMax's consumers and the potential consumers Mojang's proposed video game. ZeniMax has expended tens of millions of dollars developing, advertising and promoting The Elder Scrolis series. Since the launch of the first title in The Elder Scrolls series in 1994, The Elder Scrolls has been a of tremendous success, with worldwide sales of tens millions of units, and has garnered extensive media coverage and extraordinariiy high consumer recognition. The Elder Scroiis series has received numerous

industry awards and THE ELDER SCROLLS IV: OBLIVION was named the "Game of the Year" for 2006 by the Spike TV and the Golden Joystick Awards, among many others. See Exhibit C. Furthermore, ZeniMax has recently announced the fourteenth title in The Elder Scrolls series, THE ELDER SCROLLS V: SKYRIM. ZeniMax continues to market The Elder ScroUs series under the TES Marks. As a result of the worldwide fame of the TES Marks and the efforts of ZeniMax to finance, develop, advertise and promote The Elder Scrolls series over severa! years, ZeniMax's customers and the public in general have come to know and recognize the TES Marks and to associate the marks with ZeniMax. ZeniMax has thus built up extensive goodwill in connection with the offenng of its goods under the TES Marks. As such, the TES Marks are an asset of substantial value and importance to ZeniMax. Given ZeniMax's extensive rights to the TES Marks, most importantly in association with video games and related goods and services, and the worldwide fame of the TES Marks and the games in The Elder Scrolls series, Mojang's proposed use of the term SCROLLS in association with closely-related activities is highly likely to cause consumer confusion.
or Please note that Mojang's use of the proposed title, SCROLLS, any other title confusingly similar to the TES Marks in connection with video games and related goods and services, could subject Mojang to substantial liability to ZeniMax as such use constitutes trademark infringement, as weil as unfair competition. Such liability could inciude profits resulting from use of the proposed title or any designations confusingly similar thereto, as weil as permanent injunctive relief. Moreover, you are now certainly on notice of our client's prior rights in the TES Marks and continued use of any confusingly similar designation could be considered willful infringement and could subject Mojang to additional liability, inciuding treble damages, as weil as costs and attomeys' fees in bringing a lawsuit to rectify the situation and protect ZeniMax's inteUectual property rig hts relating to THE ELDER SCROLLS.
Due to the nature of this matter, we require your confirmation in writing within five (5) business days of receipt of this letter that Mojang will immediately cease any and all current or proposed uses of the title SCROLLS (and any designation confusingly similar thereto) in connection with video games and related goods and services, and expressly withdraw/abandon European Community Trademark Application No. 9728321. We anticipate and expect Mojang's full cooperation in bring ing this matter to a swift conclusion. Please note that this letter is made without prejudice to any other rights or remedies that may be available to ZeniMax. Nothing contained herein should be deemed a waiver, admission, or licease by ZeniMax, and ZeniMax expressly reserves the right to assert any other factual or legal positions as additional facts come to light, or as the circumstances warrant. Redguard is still my favorite game that lve worked on. Todd, Michael Klrkbride and myselfworked up the story and all the puzzies over a few weeks of continual brainstorming. Uni pretty sure Fuddruckers was heavily involved in the process. Redguard was thelast of ourXnGine games, and one where we really ivorked on buildingthe world by hand, as opposedto the random generation of Arena and Daggerfall. 3Dfx hardware It alsobad acceleration, and was our fl.-st hardware based 31) game. It was one of the last popular DOS based titles,just as Windows gaming was getting popular. The.-3D acceleration only works in 3Dfxs glide -Todd Howard system.

Ive always found it interesting that the art style for each game isa direct reaction to the previous game. After finishing Morrov.ind 1 wanted to take the Lider Serolls ina more realistic direction, with some high fantasy elements. 1 brought this to Todds attention and surprisinglyl found out we were on the same page. Similarly, at the end of Oblivion 1 felt the art atvie could go in acompletely for different direction, which drove the look Shivering Isles. Ortce again, excfted about a Todd vas stylistic change and we ended up with our most unusual aesthetic since the Lider Scrolls series began. 1 think changing the visual stylebetween gameshetps keep the series interesting for as as developers and for the people wiso it. - Matt Carofano, Art Director play Oblivion featured another engine update, using parts of Morrowinds base. but with a new renderer, a new face stem, real ph es moving trees and mora went all our technicafly as sy s Ave we were now working on and pushing the latest generation of hardware. But we did put down a few ideas on paper about what we'd do after Fallout, and that featuring the return of dragons to the Elder Scrolls. We usually start with an overall would be Skyriin. tone of the game. And Skyrirn spoke to all of us. The original home of men: rugged, weathered. The ancient power of the Nords would come to life through their shouts. You would battle with dragons, using their language, and becorne the one thing they fear: Dovahkiin, the Dragonborn. Five years later and we're excited to finally share some of this vision as it comes to life on the screen. Like you, we're fans as weil. We simply make the game we'd love to play. The game we'd book vacation time to play. And like you, we've waited a long time to see the Elder ScrollsFul/out 3 return. Skyrimis was an arnazing experienec for us and we learncd a lot. In sorne ways, both our follow up to Fallout 3. Each time we strive to improve on the style of game we enjoy; Oblivion, and our follow up to one where you can be who you want, and do whatever you want.
To do that this time, we knew, like before, we had to start over. We needed to reinvent large parts of the game and its technology. We started with the grapbics renderer, and how we would bring the scale of snow covered mountains, dynamic weather systems, and massive dragons to life along with the small details of how people lived; from the forks they used, to the fish they caught, and the meat they cooked. We then rewrote all the major graphics and gameplay systems inciuding lighting, shadows, level of detail, animation, interface, scripting, dialogue, quest systems, melee, magic, and more. All of those changes made it into our internal editor as weil. So much had changed that we decided to call the engine and &eation Engineand the('reation Kit. We can't wait to see what all the editor b a new name, the y brilliant mod makers do with these tools. All of this is done to bring epic f'antasy to life in a game unlike w&ve done beibre. We try to improve each game we do, but we also try to make each stand on its own. For whatever the ycar, be it 1994 with

Morrowind with the exact same goal, but with a team of 40, which scemed 1 can remember directing Oblivionand a team of 60 people for the next four years. This enormous in 2000. And again directing time we're up to 100 people. We've added some amazing new talent. We also have the bulk- of our original team. People I've been lucky enough to call my coworkers and friends for over a decade. Our Red, Lead Programmer Guy Carver worked with me since uard.Our Lead Designer Bruce Nesmith and Daggei:fall.Production Director Ashicy Cheng was here for Co-Lead Designer Kurt Kuhimann since Morrowind. Lead Artist Matt Carofano has had that role on TES Redguard, lefi, and came back for for sinceMorrowind. Lead Producer Craig Laffertv joined usOhlivion afler working at Epic on Unreal Oblivion. and Unreal 2. Audio Director Mark Lampert has worked his one-man magic here since And there are so many more. Across the board, new and veteran, the talent, expertise, and hard work of this team still inspire me. We're all incredibly thankful to be given the opportunity to make a game like this.
