31) A Supervisory Employee must conscientiously endeavor to prevent employment actions and
4 correct personnel situations within his or her area(s) of supervision that have apparent potential
5 to:
6 a) Interfere with employee safety, security, fair supervision or general morale; or
7 b) Be a conflict of interest.
8 The City Manager has the authority and accountability to develop, implement and maintain
9 procedures, forms and controls that facilitate compliance with this requirement.
102) A decision to promote or advance an Employee must not be influenced by that Employee’s
11 close personal relationship2 with another Public Servant. A decision to hire a Job Applicant must
12 not be influenced the Applicant’s close personal relationship with a Public Servant.
133) 3City Council is to exercise final approval authority over any action to hire, appoint, promote,
14 transfer or advance a person who has a close personal relationship with a Council Member, the
15 City Manager, the City Attorney or the City Clerk. Such matters are to be brought to Council by
16 the City Manager and dealt with in public Council Meetings.
174) 4The City Manager is to review and exercise final approval authority over any personnel action
18 distinctively involving an Employee or Job Applicant who has a close personal relationship any
19 Executive Employee.
205) A Supervisory Employee may not supervise, directly or indirectly, anyone with whom he or she
21 has a close personal relationship. The City Manager may grant a waiver of this requirement
22 provided:
23 a) The waiver, the reason for it and relevant conditions are promptly announced at a public
24 Council meeting; and
25 b) All personnel action distinctively affecting the subordinate Employee are subjected to the
26 City Manager’s review and approval..

31 A061229:This section addresses some “nepotism” issues.
42 A061229: “Close personal relationship” requires definition. To include family and household members and anyone else
5that a reasonable person would see as “close” and personal. Also include domestic partners, fiancés, and “intimate”
6relationships. Assumes both sides of the relationship are aware of the relationship. How can you have a close personal
7relationship with someone if he or she is not aware of it??
83 A061229: The intent of this item is to ensure that employment actions in which a Council Member, City Manager, City
9Attorney or City Clerk has a personal interest are known to the public – and that Council is held accountable for such.
104 A061229: The purpose of this item is to ensure that an employment action in which any department head or other
11“executive” employee has a personal interest is subject to a higher level of approval. For example, Department Head B
12wants to hire Department Head A’s sister. Although this would not violate item 5, it should be subject to City Manager’s
13approval.
