Dear Ted:

I am writing in response to your letter of June 5 , 2007 regarding representative parts. Let
nit. respond to your paragraphs in order:

First. nly letter of May 3 1, 2007, was intended to be a response to Hynix's representative
parts proposal As I indicated there, subject to working out details, we can likely agree on
Hynix's proposed DDR2 part as being representative of Hynix's accused DDR2, Graphics
DDR:! and GDDR3 parts. While you had proposed a separate representative GDDR3 part, you
indicated that once Rambus had identified its 25 claims. you could determine whether, in
Hynix's view, a single representative part would suffice. Since Rambus did identify its 25
claims a week ago. there should be no impediment to your letting us know Hynix's views on
this.

Seconcl. the caveat in my May 3 1 letter "subject to agreement as to precisely what


[agreeing on a representative part] will mean" simply meant that we had yet to agree on the exact
language of a stipulation. Presumably, such a stipulation would provide that a determination of

infringement or noninfringement of the representative part would bind the parties as to all other
Hynix parts for purposes of the '334 case. Likely, Hynix will want the agreement to provide that
Hynix would need to produce complete schematics only for its representative part. I am
confident that we will be able to agree on precise language for a stipulation along these lines.

Third, as previously noted, Rambus would like the manufacturers to propose a single part
as representative of their DDR2, Graphics DDR2 and GDDR3 parts or, if they are unable to do
so, explain the differences among the parts that, in the manufacturers' view, preclude such a
proposal. Judge Whyte has ordered the manufacturers to do this. See Tr. (5124107) at 19
(indicating that the manufacturers should disclose to Rambus "their basic thoughts on what
makes a difference as to representative products so that hopefully we can avoid a problem").
Judge Whyte also indicated that if the manufacturers ultimately propose "a number of products
that they think are involved, I will be willing to reconsider the identification of claims." Id. Of
course. Rambus does not intend Hynix to develop such a proposal alone, but, rather, as you
suggest to confer with the other manufacturers and make a joint proposal. We expect that the
manufacturers should be able to designate a single representative part - or explain why not - no
later than Thursday, June 14 (at which point they will have had Rambus's list of 25 claims for
two weeks).
