What is Magistrate?s Court? Magistrate?s court is Georgia?s court of small claims.

Its purpose is to allow p eople to resolve relatively minor conflict such as property damage, failure to pay a debt, or properly perform a service. The person filing the claim is referred to as a plaintiff; the party responding to the charge is referred to as the defendant

A Sessions Court is a court of law which exists in several Commonwealth countrie s. Malaysia Somewhat like the former Quarter Sessions in England, the but does not exceed RM 250,000, except in matters relating to motor vehicle accidents, landlord and ten ant and distress, where the Sessions Courts have unlimited jurisdiction. Libel is defamation that is written. When libel occurs, general damages are pre sumed. However, the plaintiff may offer actual evidence of damages to increase his or h er award. Slander Slander is defamation that is spoken. In cases of slander, plaintiff must prove damages unless the defamation is slander per se. Remoteness of damage relates to the requirement that the damage must be of a for eseeable type. In negligence claims, once the claimant has established that the defendant owes them a duty of care and is in breach of that duty which has cause d damage, they must also demonstrate that the damage was not too remote. Remoten ess of damage must also be applied to claims under the Occupiers Liability Acts and also to nuisance claims. Trespass to land is one of the oldest actions known to the common law (although it no longer is a crime at common law), and can be defined as an unauthorised in terference with a person s possession of land. It is the direct invasion of posse ssion which is actionable, thus, once the invasion has been proved, it is for th e defendant (the person committing the invasion) to justify his actions. Fraudulent misrepresentation is one of the three recognized varieties of misrepr esentations in contract law. Basically, it means that you not only lied or mis represented something about a transaction, but that you did it on purpose, in or der to trick the other party. Therefore, it is the most serious of all the type s of misrepresentation and has the worst penalties. Innocent misrepresentation is one of the three recognized varieties of misrepres entations in contract law. Essentially, it is a misrepresentation made by someon e who had reasonable grounds for believing that his false statement was true. So in the above example, if the seller didn't know the stereo was actually old, he would only be liable for an innocent misrepresentation Private law is the branch of law that governs individuals' relationships with ea
