Summary of the general regulations of educational institutions

The general regulations of the institutions are written in a single appendix divided into four
titles, which in turn are divided into chapters with their corresponding items.

Title I corresponding to the educational institution is divided into two chapters.

Title II, which deals with educational activities, is divided into two chapters

Title III, corresponding to the organization of institutional activity, is divided into four
chapters

Title IV, corresponding to infrastructure and equipment, is divided into three chapters

2. 1.- STUDENTS

Article 7. The students of each school are the main addressees and essential
subjects of the educational act.

Article 8. Describes the rights of students.

IS ENTITLED TO:

a) A comprehensive and egalitarian education that guarantees equal


opportunities and possibilities.
b) To enter, remain in and graduate from all public educational programs.
c) To be protected against any physical, psychological or moral aggression or
abuse.
d) Be evaluated on their performance and achievements, according to
scientifically based criteria,
e) Receive the necessary social, cultural and pedagogical support.
f) To have free and unrestricted access to public information.

i) Participate in the formulation of projects and in the selection of curricular


areas.
j) To develop their learning in adequate buildings and facilities.

Article 9. Describes the duties of the students.

ITS OBLIGATIONS ARE:

a) Attend school until completion of compulsory education.


b) To study and strive to achieve the maximum development according to
their abilities and possibilities.
c) Attend classes regularly and punctually.
d) Participate in all training and complementary activities.
e) Respect in every way all members of the educational community.
f) Participate and collaborate in the improvement of school coexistence and in
the achievement of an adequate study climate in the institution.
g) Respect the institutional project of the school and comply with the rules of
organization, coexistence and discipline of the school.
h) To conserve and make good use of the facilities, equipment and didactic
materials of the educational establishment".

2.2 PARENTS AND GUARDIANS

Article 12. The regulations governing the exercise of parental authority,


guardianship, conservatorship and guardianship shall be applicable to this title.

Article 13. The link established between those responsible for the student and the
educational institution includes:
1. The obligation of care on the part of the Institution and its personnel does not
exclude the exercise of parental rights.
2. Strict compliance with court decisions related to the student and those responsible
for the student.

Article 15. parents, guardians and/or persons responsible for the students HAVE
THE RIGHT TO:

a. "To be recognized as natural and primary agents of education.


b. To choose, for their children or those they represent, the institution that responds to
their educational, pedagogical, philosophical, ethical or religious convictions.
c. Participate in the activities of the educational establishments individually or through
school cooperatives, school councils, etc.
d. To be informed periodically about the evolution and evaluation of the educational
process of their children or represented.
e. To access public information freely and free of charge.
f. To be aware of and participate in the formulation of the guidelines and rules
governing the organization of school coexistence".

Article 16. the parents or guardians of the students HAVE THE OBLIGATIONS
TO:

a. "To enforce compulsory education for their children or represented persons.


b. To ensure the attendance of their children or those they represent at school for the
fulfillment of compulsory schooling, except for health or legal exceptions that
prevent them from attending school on a regular basis.
c. Follow and support the evolution of the educational process of their children or
represented.
d. Respect and make their children or those they represent respect the pedagogical
authority of the teacher and the school's rules of coexistence.
e. Respect and ensure that their children or those they represent respect the freedom of
conscience, convictions, legitimate authority, integrity and privacy of all members
of the educational community.
f. Respect the institutional project of the school and comply with the rules of
organization, coexistence and discipline of the school.
g. Contribute to the proper use of the facilities, equipment and didactic materials of the
educational establishment".

2.3 STAFF

Article 17. All the personnel of the educational institution will adjust their
actions to the principle of legality that arises from the regulations in force. The
directives and orders issued shall be in accordance with this principle. Staff shall
record in writing their rejection of any order that deviates from this policy.
2.3.1 TEACHING STAFF

Article 18. The rights and obligations of teachers working in state-run schools are
those prescribed by the Teachers' Statute, Law No. 10579, its amendments,
complements and regulations, the pertinent part of Law No. 13688, Law No.
13552, these Regulations, all other applicable public regulations, those
sanctioned for the protection of the general interest and specific regulations
covering the educational system.The rights and obligations of teachers are those
prescribed by the Teachers' Statute, Law Nº 10579, its amendments,
complements and regulations, the pertinent part of Law Nº 13688, Law Nº
13552, the present Regulations, any other applicable public order regulation,
those sanctioned for the protection of the general interest and the specific
regulations covering the educational system.
Teachers of privately managed educational establishments shall have the same
obligations, shall be subject to the same incompatibilities and shall enjoy the
rights established for the personnel of state-managed educational establishments,
without prejudice to the specific provisions of Law 13.688 and to the extent that
they are compatible with the nature of the private employment relationship,
obligations and rights arising from the labor legislation in force and the collective
bargaining of the sector.

2.3.2. ADMINISTRATIVE STAFF

Article 19. The rights and obligations of administrative and/or auxiliary


education personnel working in state-run establishments are those prescribed by
Law No. 10430, as amended and supplemented, its regulations, the pertinent part
of Law No. 13688, Law No. 13453, these regulations, any other regulation of
public order and those sanctioned in the protection of the general interest and
applicable regulations.The rights and obligations of administrative and/or
auxiliary education personnel working in state-run schools are those prescribed
by Law No. 10430, as amended and supplemented, its regulations, the pertinent
part of Law No. 13688, Law No. 13453, these regulations, any other regulation
of public order and those sanctioned for the protection of the general interest and
the applicable regulations.
Non-teaching personnel of privately managed educational establishments shall
have the rights and obligations arising from the Labor Contract Law, the
applicable professional statutes, the Collective Bargaining of the sector and these
regulations.
Cooperative management and social management institutions shall also be
governed by the specific regulations applicable to them.
2.4 ORGANIZED PARTICIPATION OF THE EDUCATIONAL
COMMUNITY

Article 20. The Educational Institution and the competent authority shall
guarantee the democratic participation of directors, members of the management
team, teachers, parents and/or guardians, children, adolescents, youngsters and
adults, former students, administrative and/or auxiliary educational personnel,
professionals of the support teams, members of school cooperatives, unions and
other organizations linked to the institution, according to the institutional project
and its own ideology in privately managed institutions.The competent authority
shall guarantee the democratic participation of directors, members of the
management team, teachers, parents and/or guardians, children, adolescents,
young people and adults, former students, administrative and/or auxiliary
educational personnel, professionals of the support teams, members of the school
cooperatives, unions and other organizations linked to the institution, in
accordance with the institutional project and the ideology of the privately
managed institutions.

Article 21. The Educational Institution and the competent authority shall promote
the creation of democratic and/or representative organizations, guaranteeing
institutional conditions for this purpose, in accordance with the institutional
project and its own ideology in privately managed institutions.

Article 22. The General Directorate of Culture and Education shall ensure the
exercise of the right to participate of the members of the educational community,
within the framework of the principles of associativism and solidarity
cooperation.

Article 23. Student participation - The institutional authorities shall encourage


the democratic participation of students in educational institutions at all levels,
modalities and areas, promoting and respecting their associative forms.

Article 24. Student Centers and other forms of organization. The educational
institutions shall recognize the student representation bodies, under the form of
Student Centers or other organizational modes, under the terms established in
these general regulations and in the regulations in force. The competent school
authorities shall recognize the Student Centers constituted and/or to be created.
Recognition shall be conditional upon the body ensuring the participation of all
students and implementing instances of deliberation in its decisions.
Article 25. From the Alumni Association. Educational Institutions may have
organic instances of participation of the alumni of the establishment within the
framework of the institutional project.

Article 26. From the Association of Parents and Guardians of Students.


Educational Institutions may have organic instances and/or participation groups
of parents, tutors, guardians, caregivers and/or persons responsible for the
students of the establishment, within the framework of the Institutional Project.

Article 27. From the Asociación Cooperadora Escolar. Each state-run educational
institution shall organize its School Cooperative, formed voluntarily by the
members of the educational community, with the primary purpose of supporting
the work of the institution. For the purposes of their organization, integration,
operation and economic-financial management, the regulations in force within
the scope of the General Directorate of Culture and Education apply to them.

Article 28. School Councils: The General Directorate of Culture and Education
shall promote the establishment of School Councils in educational institutions, in
accordance with the following prescriptions:
1. Each public and/or private educational institution may have a School Council, a
collegiate advisory body representative of all sectors of the educational community.
2. The main purpose of the School Council is to promote the organization and
strengthening of the educational community, stimulating its participation, unity and
coexistence in solidarity, within the framework of the institutional project. He/she
may also advise the management team on all matters of institutional interest.
3. Each School Council will be composed of the sectors that make up the educational
community, with representatives democratically elected from among their peers:
1. Students
2. Parents and/or guardians of students
3. Alumni
4. Teachers
5. Administrative and / or auxiliary of education
6. Cooperating Associations
7. Other organizations linked to the educational institution
The General Directorate of Culture and Education shall approve the necessary
arrangements for the organization, operation, coordination and supervision of the
School Councils.

Article 29. The aforementioned organizations will be included in the institutional


project and the General Directorate of Culture and Education will ensure that
each institution is provided with the necessary instruments to organically
implement the broadest possible community participation.
