UFAN Client Questionnaire & Pre-Disclosures

Thank you for spending time to provide information on your current home loan situation. This initial information shared during your case eligibility consultation with your UFAN legal assistant will allow the UFAN attorney to provide a better analysis of your case during your free consultation. Based on the information provided in this questionnaire and any other relevant information conveyed to the attorney during your consultation, you will be advised regarding the best possible legal action for you. UFAN provides varied services to cater to the individual client. Some clients may be better suited for complex joinder litigation, while others will prefer the more tailored approach of individual litigation. The UFAN attorneys strive to assist the client in determining the right course of action for the particulars of the clients circumstances. Settlement before a ruling on the merits: Most cases settle before trial. It is possible the banks do not want to risk a ruling that their contracts with homeowners were null and void. If so, it is possible that they will settle with us in order to avoid a judgment on the merits. Lose on motion or at trial: If we lose on motion or at trial, we will appeal. Often trial courts are reluctant to cause major turmoil by overturning the status quo. Courts of appeal are not so reluctanttending to rule on the law regardless of consequences. So we think it likely that the banks will settle with us before a court of appeals issues a published opinioneven if we lose before the lower court. We are here to fight for the following client goals:

Keep clients in the home throughout the litigation. We will fight for a settlement tailored to each clients needs. Adjustment of loan principal amount to reflect market value of property. Reduced interest rate to reflect current market rates. Get lender/bank to waive deficiency lawsuit after short sale. Clean the credit of the client via settlement agreement.

Client Engagement Process: We understand litigation is a serious process. Understanding the complex issues as well as tracking the process and how it may affect your home can be extremely stressful. Our commitment is to provide open and transparent communication with you at all stages of the litigation process.

Case Eligibility Consultation: A UFAN legal assistant has assisted you in walking through the required case eligibility questionnaire. Your specific information will be provided to a UFAN attorney who is licensed in the state of California. Once your retainer and initial fee is received, your free attorney consultation will be scheduled to make a final determination of your eligibility for either individual or joinder litigation. If the attorney decides that your case is not economically feasible, any amounts paid for litigation will be returned to you within 30 days. Because of the poor business practices uniformly conducted by the banks, most clients will likely benefit from legal action. Case Management: Through a combination of online case management software, customer support, and litigation webinars, clients will have open communication and support throughout the litigation process. UFAN Lawsuit Pre-Disclosures: 1. 2.
UFAN legal assistants do not practice law nor provide legal opinions. disclosure document.B) Signed Client Engagement Packet. C) Attorney Consultation. Once these stages are complete a client has officially retained the law firm of UFAN for litigation services.

3. 4. 5.

UFAN cannot and will not provide a guarantee of any specific outcome. The decision to pursue litigation is a calculated decision based on

various case and legal precedence. UFAN does not provide modification services or alternative loss mitigation services. Litigation alone does not provide protection for clients in default of their mortgage from possible foreclosure. While it is true many lenders will cease foreclosure activities on clients who have engaged in litigation with their lender, foreclosure defense must be specifically requested and address in the client retainer. UFAN utilizes attorneys and non-attorneys assigned to support clients with intake, boarding, case management, and litigation support. UFAN is not licensed to practice law in all 50 states. When judicial circumstances and venues require, UFAN will retain licensed litigation support in each judicial venue.

6. 7.

During the course of litigation UFAN may request documents from retained clients. In addition clients agree to fully comply with all

reasonable requests regarding the prosecution of this case. Clients agree to review all provided documentation throughout the intake process. Clients are encouraged to review all client engagement

documents in order to properly understand the legal relationship between client and UFAN.
