Distinguishing the Real, and the True from a Fact and Discussing Thinking or Reasoning like a Lawyer By Perpetual

Copyright (2011 C.E.) By Anthony J. Fejfar and Neothomism, P.C. (PA) and The People of God as a Public Domain Copyright. The real is that which is substantial or which is based upon substance. Substance is absolute relational love. Love is defined as a positive feeling flowing outward. The true is that which is

logical. The true is form. That which is logical is that which does not involve a logical contradiction, such as attempting to assert that (A) and (not A) can exist at and in the same time and the same place. There are four types of logic, concrete logic, analytic logic, analogical logic, an probabalistic logic. Analytic logic asks whether A is B or not. While analogical logic asks

whether A is analogous to B. A Fact is determined to be a fact which the data of experience, and an understanding of the data of experience are judged using analogical judgment or reason to be substantially analogous. This cognitive procedure avoids the hermeneutic circle as described by Gadamer. And, that which is substantially analogous is where two objects or subjects, or some combination thereof, have three or more, but not all, characteristics or attributes which are the same. Thus, legal reasoning is valid, in that a legal thinker, who thinks like a lawyer, can reason that Case B is factually analogous to Case A, and therefore the legal holding in Case B should follow, or be the same as that which was stated in Case A. However, it might also be argued that Case B is distinguishable from Case A, in that the facts are not exactly the same, and that the law in Case A in not on point in Case B, and perhaps that Public Policy dictates that Case A not be followed in Case B because this would arguably produce an absurd or illogical result, and thus would violate The Law of Logic, that is Sheriffs Law. The real natural law is The Law of

Logic, Sheriffs Law, which is the basis for the English Common Law as well as Canon Law. Thus, the Law of Logic, or natural law, or Sheriffs Law can be proved valid with the use of Logical Positivism, where Logical Positivism is defined as: experience and logical reasoning therefrom. Finally, it should be noted that being is the good and that reason is both good and the good. And, reason is defined as a composite of love, logic, and intuition. Intuition is defined as preconscious or unconscious analogical thought processes which can go quantum and produce Quantum Intuition. Quantum Physics proves that telepathy or direct apprehension of an object or subject, out there, can take place non-locally at a distance in an acausal manner. As a Zen Master once said: First I experience a tree with sense experience, then I met the hermeneutic circle and found that there really is no tree because of the world mediated by meaning, and then I judged the tree to exist using analogical judgment and unconscious, curvelinear, intuition.
