to establish harmonious relationship with management, the following shall be considered as the OFFENSE with their corresponding PENALTIES for the information and guidance of all concerned: NATURE OF OFFENSE PENALTIES OR DISCIPLINARY ACTIONS 1ST Offense 1. Serious misconduct or wilful disobedience by an employee of the orders by management or his representative in connection with his/ her works. 2. Gross and habitual neglect by the employee of his/ her work. 3. Fraud or wilful breach by the employee of the trust reposed in him by his representative. 4. Commission of a crime or offense by the employee against the person of the management or any member of his immediate family or his representative 5. Theft of company property and of personal properties of the coworkers. 6. Wilful destruction, misuse or unauthorized use of company properties resulting in serious damage to the same. 7. Gross negligence which cause serious damage or loss of the company property or injury to persons. 8. Possession of firearms, deadly weapons, explosives and flammable materials within company premises. 9. Falsificationand/or tampering of records and/or document of the company. 10. Carelessness resulting in the injury of co-employees or damage to company properties or materials. 11. Gross or deliberate inefficiency in the performance of his/her work. 12. 13. Smoking inside the NO SMOKING AREA. 14. Bringing in or drinking intoxicating liquor inside company premises, prohibited drugs, and reporting for work under the influence of liquor or habit forming drugs. 15. Gambling with company premises. 16. Provoking or instigating a fight Or fighting during office hours within company premises. 17. Leaving the premises during office hours without permission. 24. Failureto observe and comply with rules pertaining to cleanliness and health standards. 25. When the penalty to be imposed is dismissal or termination of employment, the following procedure shall be observed: 1. The concerned employee is furnished a written notice stating the particular acts or omission constituting the grounds for his dismissal. In case of abandonment of work, employee is served a notice of his last known address. 2. The employee, if so desires, answers the allegations stated against him/her in the notice of dismissal. Within a reasonable period, at most five days, to be prescribed by management as the situation requires. 3. The employee is afforded ample opportunity to be heard and define himself/ herself with the assistance of his her representative, if he/ she so desires. 4. In case management decides to dismiss the employee, the latter is immediately notified of such decisions.

If his/ her continued employment poses imminent danger or threat to the life and property of the employer or his/her co- workers, an employee may be placed under preventive suspension for a period of not more than 30 days. In case the suspension period is extended, the employee shall be paid the wages and the other benefits due him/her and shall not be found to reimburse the employer. Any decision taken by the management shall be without prejudice to the option of both or either parties to seek assistance from the Department of Labor and Employment or of the right of workers to contest the validity of his/her dismissal by filing a complaint with the regional branch of the National Labor Relations Commission. EFFECTIVITY These rules shall take effect one week from its posting in a conspicuous place within company premises for the information and guidance of all workers. Any worker may, within 5 days from posting of these rules, recommend to management the amendments of any provision of these rules and regulations which may consider as unreasonable or oppressive or that the penalty is too harsh or severe. Upon receipt of such recommendations and suggestions, the management shall make, at its discretion the necessary amendment. All other provisions without proposal for amendment shall take effect after one week from posting of the notice of the same. If no suggestion or recommendation, whether oral or written, is received by the management within five (5) days period, this shall mean that all concerned agree to the reasonableness of these rules and regulations and, therefore, shall be bound by the same. The management reserves the right and prerogatives to make amendments and/or adopt additional rules and regulations which shall take effect and regulations which shall take effect only after one week from its posting or notice to all concerned.
